CITY OF PADUCPH,McCRACKFN COUNTY, KENTUCKY, TOGETHER WITH ALL NRCE`FPRY MANHOLEF, INTAKFS, CATCH BASINS, SL'FJER AND DRAIN PIPE, AND ALL NECESSARY FNGINEEFIN-7, ADVERTISING !1"IP LEGAL AND CLERICAL SERVICE IN CONNECTION THrREWITH AT THE COST OF THF. ABUTTING PROPERTY 01.771ERS AND PROVIDING THAT SAI7 MAY BF CONSTFUCTED UPON THE TLN YEAR PAY?NrNT PLAN. BE IT ORDAINED BY THE BOARD OF COIe'r,?IEFIONrF.S OF THE CITY OF PADUCAH, KFPiJUCKY: SECTION 1. That sidewalks driveways, curb and gutter on Washington Street; from the west property line of Sixteenth Street to the east property line of Seventeenth Str,,et, in the City of Paducah, Kentucky, with all necessary manholes, intakes, catch basins, sewer and drain pipe, and all necessary engineering, advertising and legal and clerical service in con.iection therewith, be, and the same is hereby ordered to be.constructed with concrete, upon bids made therefor, and all to be done in strict accordance with the plans, specifications, grades, widths, profiles and drawings of the Commissioner of Public ITI rks, prepared by him for such purposes, all of vinich are hereby adopted as a part of this ordinance as fully as if embraced herein or attached hereto and made part hereof and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the direction and supervision of the Commissioner of Public Works, and shall be commenced at a time designated by contract for the performance of said work, and completed on or before eight months after the passage and recording of this ordinance; SECTION 3. I That all the cost incident to said construction of said street, as provided in Section 1 hereof, shall be paid for wholly by the property owners and property abutting or fronting thereon on both sides of said street and to be apportioned to and assessed age Inst the property owners and property abutting thereon on both sides I of said street according to the number of feet or abutting feet thereon, except that the City of Paducah shall pay such portion of cost of construction as required by law. Provided that said improvement shall be made upon the ten year payment plan as provided in Sections 3101 and 3102 of the Kentucky.Statutes. SECTION 4. The contractor awarded the work herein provided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improvement herein provided Page 412 for, and in no other way, except that the said contractor may be I paid out of such bonds is::ued in accordance with the law of the i City of Paducah and charter cities of the second class of the State of Kentucky, and for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be .liable to the contractor for the construction of any of the work herein provided for, except that said City of Paducah shall be liable to the said contractor for the excess of fifty (500) per cent of the value of and property assessed for the construction of the work herein provided for. SECTION 5. The contractor awarded the contract for the -,cork herein provided for shall be paid monthly by Improvement Warrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Works, to the extent of sixty-five (65%) per cent of the value of the viork done or materials furnished by the contractor during the progress of the work, •nd said Improvement Warrants shall bear six 90) per cent interest from date' of issual and shall be issued by the Commissioner of Public Finances upon order of the Board of Commissioners. Said;Improvement Warrants shall be negotiable and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the ork herein provided for; out of the first collection of such local taxes or ou:b of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement Warrants shall be estimated and assessed as a part of t'. cost of the improvement herein provided for. SECTION 6. The Mayor is hereby authorized and 'irected to execute all,' written contracts and bonds with the successful bidder for the construction of said improvement, as rewired by law. SECTION 7. Bids shall be received for the construction of said work out of concrete according to plans and specifications, made and provided therefor by the Commissioner of Public '.'forks, and reported l to the Board. of Commissioners at the next regular or called meeting , and the contract therefor awarded to the lowest and best bidder, except that the right is expressly reserved to reject any and all bids within the discretion of the Board of Commissioners.
