AND CIFRICAL SERVICE IN CONNECTION TBEREWITH AT THF COLT OF THE ABUT TING PROPERTY O�;INF.RS AND PROVIDING THAT SAME MAY BE CONSTRUCTE: UPON TITS TEN YEAR PAYMENT PLAN°and WHEREAS, in accordance with said orclinance it is provided that the cost of construction of said driveway, together with all necess curb, gutter, driveways, manholes, intakes, catch basins, drain tile and Page 386 sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and all other work done thereunder be paid for Ly the abutting property ormers on both sides thei-of, except that portion to be paid by the City of Paducah as recuired by law, and WHEREAS, pursuant to said ordinance, a contract was enterei into on the day of _1929, between the Southern Roads Company, Contractors, and the City of Paducah, Kentucky for the construction thereof, and VUEREAS, said contract has in all respects been completed and the work thereunder finished and accepted by the Board of Commissioners of the City of Paducah on the 26th day of August, 1929 pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commissioner of Public Works of the City of Paducah, Kentuely, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the Board of Commissioners, NO';J, THERT'FORE, BE IT ORDAINED BY THE BOARD OF C015,1ISS IONFRS OF THE CITY OF PADUCAH, KFNTU-,KY: SECTION 1. That all of the property on both sides of North Thirteenth Street, from the East property line of "?illett Street to the East property line of Palm Strect; and on the Cairo Road, from the East property line of Palm Street to the '.lest property line of Atkins Avenue and to the present city limits, in the City of Paducah, McCracken County, Kentucky, as shown by the Engineer's Estimates, be, and the same is hereby assessed for the cost of construction of an improved, or asphalt street with al necessary curbs, gutters, driveways, manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith. As shorn by the Engineer's Estimates on .file in the office of the Commissioner of Public '.'forks, which estimates are adopted and made part hereof. SECTION 2. That all of the funds derived from the asses^went of said property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted an? now in force, said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passim; and recording of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, and Which may be paid on the ten year installment plan, as hereinbefore provided for, the City of Paducah may issue and sell improvement bonds, and to secure the payment of which bonds there is hereby Pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, ane the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky and now in force and effect. SECTION 5. This ordinance shall take effect and be in force from and after its passage, record and publication.
