HomeMy WebLinkAboutOrdinances Book 9, Page 369, No Ordinance NumberPage 369 AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SIDEWALKS ON BOTH SIDES OF HARRISON STRFFT, FROM THE TEST PROPERTY LINE OF FOURTH STREET TO THE EAST CURB LINE OF EIGHTH STRFFT; AND ON CLAY STREET, FROM THE WEST PROPFRTY LINE OF FOURTH STRFFT TO THE EAST CURB LINE OF EIGHTH (STREET; AND ON EIGHTH STRFST, FROM HE NORTH PPOPfRTY LINE OF MADISON (STREET TO THE SOUTH CURB LINE OF PARK AVENUE, IN THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY, TOGFTHFR !^LITH ALL NECESSARY MP.NHOLES, INTAKES, CATCH BASINS, SEWER AND DRAIN PIPE, AND ALL NFCESSARY F.NGINEFRING, ADVFFTI,ING AND LT -GAL AND CLERICAL SERVICE IN CONNTCTION TH PF"'ITH AT THE COST OF THE ABUTTING PROP''RTY O"'MFRS AND PROVIDING THAT SAPS MAY BE CONSTRUCTED UPON THE TEN YEAR PAYMENT PLAN. BE IT ORDAINED BY TRE BOARD OF COM1,1IS3IONFRS OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. That sidewalks on both sides of Harrison Street, from the Fest property line of Fourth Street to the Fast curb line of Eighth street; and on Clay Street, from the West property line of Fourth Street ;o the Fast curb line of Eighth Street; and on Eighth Street, from the. forth property line of Madison Street to the South curb line of Park venue, in the City of Paducah, Kentucky, together with all necessary anholes, intakes, catch basins, sewer and drain pipe, and all necessary ngineering, advertising and legal and clerical service in connection herewith, be, and the same is hereby ordered to be constructed with oncrete, upon bids made therefor, and all to be done in strict ccordance with the plans, specifications, grades, widths, profiles and ravings of the Commissioner of Public Works, prepared by him for such irposes; all of vfhich are hereby adopted as a part of this ordinance as illy as if embraced herein or attached hereto and made part hereof and irked "A" for more specific identification. SECTION H. That said work shall be constructed under the direction id supervision of the Commissioner of Public Works, and shall be >mmenced at a time designated by contract for the performance of said irk, and completed on or before eight months after the passage and cording of this ordinance. SECTION 3. That all the cost incident to said construction of said treet, as provided in Section 1 hereof, shall be paid for wholly by the roperty o7.vners and property abutting or fronting thereon on both sides f said street and to be apportioned to and assessed against the property vners and property abutting thereon on both sides of said street ;cording to the number of feet or abutting feet thereon, except that the Page 370 City of Paducah shall pay such portion of cost of construction as required by law. Provided that said improvement shall be made upon the ten year payment plan as provided in Sections 3101 and 3102 of the Kentucky Statutes. SECTION 4. The contractor awarded the work herein provided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improvement herein provided for, and in no other way, except that the said contractor may be paid out of such bonds issued in accordance with the law of the City of Paducah and charter &ities of the second class of the State of Kentucky, and for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the s^id City of Paducah be li-ble to the contractor for the construction of any of the work herein provided for, except that said City of Paducah shall be liable to the said contractor for the excess of fifty (50%) per cent of the value of any property assessed for the construction of the work herein provided for. SECTION 5. The contractor awarded the contract for the work herein provided for shall be paid monthly by Improvement Warrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Works, to the extent of sixty-five (65%) per cent of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improvement Warrants shall bear six (6%) per cent interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board Of. Commissioners. Said Improvement Warrants shall be negotiable and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such loacl taxes. The interest on such Improvement Wattants shall be estimated and assessed as a part of the cost of the Improvement herein provided for. SECTION 6. The Mayor is hereby authorized and directed to execute all vritten contracts and bonds with the successful bidder for the ;onstruction of said improvement, as required by law. Page 371 SECTION 7. I Bids shall be received for the construction of said work out of concrete according to plans and PPecifications made and provided therefor by the Commissioner of Public Works, and reported to the B(a rd of Commissioners at the next regular or called meeting, and the contract therefor awarded to the lowest and best bidder, except that the right is expressly reserved to reject any and all bids within the discretion J lof the Board of Commissioners. SECTION 8. This ordinance shall take effect and be in force ten days after its passage.
