MAY BE CONSTRUCTED UPON TEN YEAR PAYMI'NT PLAN. BE IT ORDAINED BY THF BOARD OF COTRW1 ,EIONFRS THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the driveway on Jefferson Street from the Nest y line of 32nd Street to its junction with 35th Street; and 35th from its junction with Jefferson Street to the South property line f Central Avenue, in the City of Paducah, Kentucky, with all necessary orbs, gutters, driveways, manholes, intakes, catch basins, sewer and rain pipe, end all necessary engineering, advertising and legal and lerical service in connection therewith, be, and the same is hereby rdered to be constructed a,d reconstructed with concrete, asphalt, lithic, or other improved paving material as may be determined by Board of lommissioners as the best and most economical material the construction and reconstruction thereof, upon bids made therefor, all to be done in strict accordance with the plans, specifications, ades, widths, profiles and drawings of the Commissioner of Public Works epared by him for such purposes, all of which are hereby adopted as a rt Of this ordinance as fully as if embraced herein or attached hereto d made part hereof and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the rection and supervision of the Commissioner of Public Works, and shall commended at a time designated by contract for the performance of said rk, and completed on or before eight months after the passage and cording of this ordinance. SECTION 3. That all the cost incident to said construction and econstruction of said streets, as provided in Section 1 hereof, shall be aid for wholly by the property owners and property abutting or fronting n both sides of said streets and to be apportioned to end assessed against he property owners and property abutting on both sides of said street ecord ng to the number of feet or abutting feet thereon, except that the ity of Paducah shall pay such portion of cost of construction as required Page 336 by lavr. Provided that said improvement shall be made upon the ten year payment plan as provided in Sections 3101 and 3102 of the Kentucky Statutes. SECTION 4. The contractor awarded the uork herein provided for shall be paid only from the funds arising from the special tax bills and assessments against- the property abutting the improvement herein provided for, and in no other way, except that the said contractor may be paid out of such bonds issued in accordance with the law of the City of Paducah and charter cities of the second class of the State of Kentucky, and for the payment of .­hieh, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said contractor for the excess of fifty (50%) per cent of the value of any property assessed for the construction of the wobk herein provided for. SECTION 5. The contractor awarded tl,e contract for the work herein provided for shall be paid monthly by Improvement 'Marrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Works, to the extent of sixty-five (65%) per cent of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improvement 'Harrants shall bear six (6/) per cent interest fr an date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners; Said Improvement 1°larrants shall be negotia- ble and shall constitute a lien upon the local taxes to be hereafter levied for such improvement and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation t f such local taxes. The interest on such Improvement Warrants hall be estimated and assessed as a part of the cost of the improve - herein provided for. SECTION 6. The mayor is hereby authorized and directed to execute all tten contracts and bonds with the successful bidder for the construction of said improvement, as required by law. Page 337 SECTION 7. Bids shall be received for the construction of said work out of concrete, asphalt, bitulithic, or any other improved paving material according to plans and specifications made and provided therefor by the Commissioner of Public YJorks and reported to the Board of Commissioners at the next regular or called meeting and said Board of Commissioners shall determine the material with which said street shall be constructed and award the contract therefor to the lowest and best bidder, except that the right is expressly reserved to reject any and all bids within the discretion of the hoard of Commissioners. SECTION 8. This ordinance shall take effect and be in force ten days rafter its passage.
