OF TC'FNTY-BIGFTIi STRFFT TO TIE EAST PROPTFT'Y LITIT' OF THIFTY- SFCOND STRFT'T SHALL BF MADr AS NFRrIN FIRST ABOVE 1,7ENTIONED.° and !Tff 'FFAS, in accordance ?ith said ord6nance it is provided that the cost of construction of said driveway, together with all necessary curb, gutter, driveways, manholes, intakes, catch basins, drain tile and server pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and all other erork done thereunder be paid for by the abutting property owners on both sides thereof, except that portion to be paid by the City of Paducah as required by law, and "IiEREAS, pursuant to said ordinance, a contract was entered into on the _day of 1928, between the Southern Roads Compnr_y, Contractors, and the CJtty of Paducah, Kentucky for the construction thereof, 'and 7HFREAS, said contract has in all respects been com- pleted and the work thereunder finisred and accepted by the Board of Commissioners of the City of Paducah on the 25th day of February 1929, pursuant to notice duly liven and inspection of said work and the recommendation of acceptance made therefor by the Commissioner of Public`Norks of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly aaopted by the hoard of Commissioners, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF CO?4P5ISSIONTRS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That all of the property on both sides of Broadway Street, from the 1,7est property line of Twenty -Fifth Street to the East property line of Thirty-second Street, in the City of Paducah, McCracken County, Kentucky, as shown L -y the Engineerts Estimates, be, and the same is hereby assessed for the cost of construction of an improved, or asphalt street with all necessary curb, gutter, driveways, manholes, intakes, catch basins, drain tile and sewer pipe, and ^11 necessary engineering, advertising and legal and clerical service in connection therewith. All of said work has been done under the ordinance and contract aforesr+id and said assessment is as follows, to -'.'.'it: Cost of Paving and Excavation. As shown by the Engineers Estimates on file in the office of the Commissioner of Public Works, which estimates are adopted and made part hereof. SECTION 2. That all of ti -e funds derived from the assessment of said property aforesaid shall be used for the pur-ose of paying off the tax bills issued against said nroperty, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in forcem said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passing and recording of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, and which may be paid on the ten ,year installment plan, as hr-reinbefore peovided for, the City of Paducah may issue and sell improvement bonds, and to secure the payment of ^rich bonds there is bereby pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds,but said bonds shall not br sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the i'entucky Statutes, as amended and re-enacted by the General Assembly of the Commonwerlth of Kentur•ky and now in force and effect'.
