That North Thirteenth Street, from the ';Test curb line of Atkins -:venue to the present city limit line, rhich line is approximately 149 feet 'gest of the 'Fest property line of Reed Avenue, in the City of Paducah, Kentucky, be, and the same is hereby ordered to be improved by the grading and graveling of same, together .-ith all necessary engineering, advertising and legal and clerical service in connecti,:n therewith, upon bids made therefor, and all to be done in strict accordance with the plans, specifications, widths, grades, profiles and drawings in the office of the Co•missioner of Public ''Forks and pre- pared by him for such purposes, all of wl ich are hereby adopted as a hart of this ordinance as fully as if embraced herein or attached hereto and :a de Dart hereof and marked "A" for more specific identification'. SECTION 2. That said cork shall be constructed under the direction and supervision of the Cor,missioner of Public orks, and shall be co. meed at a time designated by contract for the performance of said work, and completed on or before eight months after the passage and recording of this ordinance. SECTION 3. That all the cost incident to said construction of said street as provided in Section 1 hereof, shall be paid for wholly by the property owners and property abutting or fronting thereon on both sides of said street and to be apportioned and assessed against the property owners and property abutting thereon on both sides of said street according to the number of feet or abutting feet thereon, except that the, City of Paducah shall pay such portion of cost of construction as re- quired by law. Provided that said improvement shall be made upon the j ten year payment plan as provided in Sections 3101 and 3102 of the Kentucky Statutes. c PAGE 197 SECTION 4. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improvement herein provided for, and in no other way, except that said contractor may be paid out of such bonds'as may be issued, in accordance with the law of the City of Paducah and charter cities of the second class of the State of Kentucky, and for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah;and in no event shall the s^id City of Paducah be liable to the said contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to said contractor for the excess of fifty (50jo) per cent of any property assessed for the construction of the work herein provided for; SECTION 5. The contractor awarded the contract herein provided for shall be paid monthly by Improvement 1,19rrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public works, to the extent of sixty-five (65°x) per cent of the value of the work done or materials furnished by the contractor ducting the progress of the work, and said Improvement Warrants shall bear six (6%) per cent interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement warrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied for such improvement and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first col- lection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement Warrants shall be estimated and assessed as a part of the cost of the improvement herein provided for. SECTION 6. The Mayor is hereby authorized and directed to execute all! written contracts and bonds with the successful bidder for the construction of said improvement, as required by law. SECTION F!: Bids shall be received for the construction of said work according to the plana and specifications made and provided therefor by the 6vommissioner of Public works, and reported to the Board of Commissioners at the next regular or called meeting and the contract PAGE 198 therefor awarded to the lowest and best bidder, except that the right j is expressly reserved to reject any and all bids within the discretion i of the Board of Commissioners.
