That the driveway on north Thirteenth Street, from the East Property line of Tillett Street to the East property line of Palm Street, and or the Cairo Road, from the Bast property line of Palm reet to the 'west property line of tl;ins L.venue and to the present city limits, in the City of Paducah, I_entucky, ;;ith all necessary curb, gutter driveways, manholes, int^kes, catch basins and sewer pipe, and All necessary engineering„ odvertisinrn and legal and clerical service in connection thereerith,be, and -the same is hereby ordered to be constructed with asphalt, concretel bitalithic, or other improved paving material as may be determined :;y she Board of Commissioners as the best and most economical material for the construction thereof, upon bids made therefor, and all to be done in strict accordance .,,ith the plans, sPer ifications, grades,.r,idths, profiles and dra%;:ings of the Commissioner of Public i-!orks, prepare- by him for such purposes, all of which are hereby adopted as a part of this ordinance as fully as if embraced herein or at- tached hereto and made Part hereof and marled "A" for more specific identification. S-0TION 2. That'said cork shall be constructed'under the direction anO supervision of the Commissioner of Public !'Works, and shall be commenced at a time desi;:rated by contract for the performance of said -••ork, -.nd. completed on or before eight months after the passage ^nd recording of this ordinance. SECTION 3. That all the cost incident to said construction of soid street, as provide; in Section 1 hereof, shill be paid for ;;holly by the property ovmers and property abutting or fronting thereon on both sides of said street and to be apportioned to and assessed against the Property owners and property abutting thereon on both sides of said PAGE 185 street according to the number of feet or abutting feet thereon, except that the City of Paducah shall pay such portion of cost of construction as required by law, Provided that said improvement shall be made upon the ten year payment plan as provided in Section 3101 and 3102 of the Kentucky Statutes'. SECTION a'. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the Special Tax Pills and assessments against the property abutting the improvement herein provided for, and in no other ray, except that said contractor may be paid out of such bonds issued in accordance lith the law of the City of Paducah and charter cities of the second clans of the State of Zentgcky, and for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said city of Paducah shall be liable to the said contractor for the excess of fifty (500) per cent of the value of any property assessed for the construction of the work herein provided for. I SECTION 5. The contractor awarded the contract for the 7ork herein provided for shall be paid monthly by Improvement Warrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Works, to the extent of sixty-five (650) percent of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improvement Warrants shall bear six (61) per cent interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioner Said Improvement Warrants shall be negotiable and shall constitute a lien upon the local taxes to be hereafter levied for such im- provement, and shall be payable at the office of the Commissioner of Public Pinance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale )f any Improvement Bonds issued in anticipation of such local taxes. Che interest on such Improvement Warrants shall be estimated and issessed as a part of the cost of the improvement herein provided 'or. SECTION 6. The Mayor is h•roby authorized and directed to execute all mitten contracts and bonds with the suEcossful bidder for the PAGE 186 construction of said improvement, as required by law. SECTION 7. Bids shall be received for the construction of s -id work out of concrete, asphalt, bitulitbic, or other improved paving material according to plans and specifications made and provided therefor by the Commissioner of Public —orks and reported to the Board of Commissioners • i at the next regular or called meeting, and said Board of Commissioners shall determine the material with which said street shall be constructed and award the contract therefor to the lowest and best bidder, except that the right is expressly reserved to reject any and all bids within the discretion of the '_�oard of Commissioners. i SECTION 8.
