BE IT ORDAIiILD BY THE BOF -RD OF COMMISLIONERS OF THE CITY OF PADUCAH, K11TUCKY: SECTION 1. That the driveway on Broadt'ray Street, from the West property line of Twenty -Fifth Street to the East property line of Thirty-Secor_d Street in the City of Paducah, Kentucky, with all necessary curb, gutter, driveways, manholes, intakes, catch basins and 'sewer pipe and sll necessary engineering, advertising and legal and clerical service in connection therewith, be, and the ssme is hereby ord.ere~ to be constructed and re -constructed with•concrete, asphalt, bitulithic, or other improved paving material as may be determined by the Board of Commissioners as the best and most economical material for the construction thcreo£, upon bids made therefor, and all to be ,done in strict accordance with the plans, specifications, grades, widths, profiles and drar!in�s of the Commissioner of Public 'Yorks, prepared by him for such purposes; all of rhich are hereby adopted as a part of this ordinance as fully as if embraced herein or attached hereto and made . part hereof and marked "9" for more specific identification. But said improvement shrll consist of the construction of the drivec:ay or street only, from the '.lest property line of Trienty-Fifth Strn i i i-- v— side o: Tvienty-Eighth Street, but from the !'Fest property line of Trrenty- Eightn Street to the East prone rty line of Thirty -Second Street said imnrovement shall be made as herein first above described. SECTION 2. TLat said .fork shell be constructed une.er the direction and supervision of the Commissioner of Public ':;orks, and sh,-.111 be com_nenced at a time designated by contract for the perforr-_r)ncc of said work, and completed on or before eight months after the passae and recordin,r1r of this ordin-mee', PAGE 173 SECTION 3. That all the cost incident to said construction of said street, as provideC in Section 1 hereof, shall be paid for wholly by the property owners and property abutting or fronting thereon on both sides of said street and to be apportioned to and assessed against.the propertyowners and property abutting thereon on both sides of said street accordinG to the number of feet or abutting'feet thereon, except that the City of Paducah shall pay such portion of cost of construction as required by law. Provided that said improvement shall be made upon the ten year payment plan as provided in Sections 3101 and 3102 of the Kentucl�y Statutes.' SECTION 4. The Contractor awarded the :rook herein provided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improvement herein provided for, and in no other way, except that the said contractor may be paid out of such bonds issued in accordance with the law of the City of Paducah and charter cities of the second class of the state of Kentucky, and for the payment of �;rhich, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the scid City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said contractor for the excess of fifty (50'p) per cent of the value of any property assessed for the construction of the ;•cork herein provided for SECTION 5. The Contractor awarded the contract for the work herein provided for shall be paid monthly by Improvement ;'Warrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public ':forks, to the extent of sixty-five (65,') per cent of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improvement Warrants shall bear six (6,',) per cent interest from date of issual and shall be issued by the Commissioner of Public Finanue upon order d the !'card of Commissioners. Said Improvement 'warrants shall be negotiable and shall constitute a lien upon the local taxes to be hereafter .levied for such improvement, and shall be payable a-1; the office of the Commissioner of 'ublic Finance, -ithout notice to the holder thereof, upon completion qnd acceptanue of the work herein provided for, out of the first collection of such local taxes, or gut of the proceeds of the sole of any Imbrovanent Bonds iscued j Ln anticipation of such local taxes; 1$e interest on such ■ Pn G'�: 174 Improvement",'farrants shall be estimated and assessed as a part of the - cost of the improvement herein provided for'. i SECTION G. The Idayor is hereby authorized and directed to exacute all written contracts and bonds with the successful bidder for the con- struction of said improvement, as required by lavi. SECTION 7. Bids shall be received for the construction of s^id work out of concrete, asphalt, bitulithic, or�ther.improved paving material according to the plans and specifications made and provided therefor by the Conunissioner of Public ::forks and reported to the Board of Commissioners at the next regular or called meeting and the said Board. of Commissioners shall determine the material with which said street sh ^ll be constructed and acrard the contract therefor to the lo -:rest end best bidc:er, except that the right is expressly reserved to reject any and. all .bids •:•:it;rin the discretion of said Board of Com^iscioner•s. SECTION 8. This ordinance shall take effect and be in force ten days after its passage.
