VJHEP.EAS, the Board of Commissioners of the City of Paducah, entucky has heretofore on the 8th day of May, 1928, adopted an rdinance entitled, ::AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF ONCRETE SIDEWALKS, CURBS AND GUTTERS AND ALL NECESSARY MANHOLES, NTAKES, SEWERS, CATCH BASINS AND SEWER PIPE ON BOTH SIDES OF MADISON TREET FROM THE WEST CURB LINE OF THIRD STREFT TO THE EAST PROPERTY INE OF FIFTH STREET AND FROM THE YJEST CURB LINE OF EIGHTH STREET TO 1E EAST PROPERTY LINE OF ELEVENTH STREET, AND SIDEi'IALKS ON BOTH EDES OF 14ADISON STREET FROM TIIE WEST CURB LINE OF FIFTH STREET TO IE EAST CURB LINE OF EIGHTH STREET, PITH ALL NECESSARY DRIVE'wJAYS, I THE CITY OF PADUCAH, KENTUCKY, INCLUDING ALL NECESSARY ENGINEERING, )VERTISING AND LEGAL AND CLERICAL SERVICE IN CONNECTION THERE1,7ITH, :CEPT THAT PORTION OF SAID SIIIEPJALKS, CURBS AND GUTTERS WHICH HAVE READY BYEN CONSTRUCTED IN ACCOFDANCE 1J7ITH THE CITY LINE, GRADES D SPECIFICATIONS SHALL NOT BE RECONSTRUCTED AND !,RE HEREBY EXCLUDED JI OM THE WORK TO BE DONE UNDER THIS ORDINANCE AND ALL TO BE DONE AT I PAGE 142 THE COST OF THE ABUTTING PROPERTY OWNERS AND PROVIDING THAT SAt4E MAY BE PAID FOR UPON THE TEN YEAR PAYIVENT PLAN, and i"MEREAS, in accordance with said ordinance it is provided that the cost of construction of said sidewalk, curb, gutter, driveways and all other work done thereunder be paid for by the abutting property owners on both sides of Madison Street where said work was done, except that portion to be paid by the City of Paducah, as required by law, and WHEREAS, pursuant to said ordinance a contract was entered into on the __day of 1928, heretofore, between Yancy Brothers, Contractors, and the City of Paducah, Kentucky for the construction thereof, and 11EREAS, said contract has in all respects been completed and the work thereunder finished and accepted by the Board of Commissioners of the City of Paducah on the 20th day of August, 1928, pursuant to the recommendation made therefor by the Commissioner of Public *V+orks and pursuant to a motion made by said Commissioner, which motion was duly ado -ted by the Board of Commissioners, NOVI, THEREFORE, BE IT OF.DAINFD BY THE BOARD OF COYIiISSIONERS OF THE• CITY OF PADUCAH, KENTUCKY: SECTION 1. That all of the property on both sides of MadSson Street, from the 'r?est curb line of Third Street to the East property ;line of Fifth Street and from the West ftrb line of Eighth Street to the :East property line of Eleventh Street, be, and the same is hereby assessed for the cost of construction of concrete sidewalk, curb and :gutter, and all necessary mahnoles, intakes, sewers, catch basins and 'sev:er pipe and all necessary engineering, advertising and legal and clerical service in connection therewith; and that all of the property on both sides of Madison Street, from the ',,!est curb line of Fifth Street to the East curb line of Eighth Street, be, -nd the same is hereby :assessed for the cost of construction of sidewalks, with all necessary 'driveways, including all necessary engineering, advertising and legal and clerical service in connection therewith. All of said work has been done in the City of Paducah, Kentucky under the ordinance and contract a"oresaid and said assessment is as follais: Concrete sidetsalk $0.14' per sq, ft. SECTION! 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying orf the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passing and recording of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes: SECTIONI 4. In order°to provide a fund for the immediate payment of the cost of that portion of the special assessments herein pro- vided for, and which may be paid on the ten year installment plan, as hereinbefore provided for, the City of Paducah may issTm and sell improvement bonds, and to secure the payment of which bonds, there is hereby pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but such bonds shall not be sold for less thagpar, and the proceeds thereof applied exclusively to payment for the improvement of said streets as hereinbefore mentioned,°and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the 11er_tucky Statutes, as amended and reenacted by the General Assembly of the Commonwealth of Kentucky and now in force and effect'.
