AND SAILORSt BURYING GROUND AND APPROPRIATING MONEY TO BE USED WITH OTIiER MONEYS TO BE APPROPRIATED BY THE MCCRACKEN COUPITY FISCAL COURT AND OTHER MONEYS TO BE APPROPRIATED, DONATED AND PAID FROirt OTHER SOURCES, WHICH ALTOGETHER ARE TO BE USED IN THE ERECTION, INSTALLING AND PAYING FOR A CERTAIN MONUMENT TO BE SELECTED AND AGREED UPON BY CHIEF PADUKE POST NUMBER 31 OF THE AMERICAN LEGION, AND PROVIDING FOR THE CONTROL AND MAINTENANCE OF SAID BURYING PLACE AND MONUMENT. WHEREAS, Chief Paduke Post Number 31, American Legion has procured the submitted plans, drawings and other descriptions of a certain monument to be erected at the burying ground of the soldiers and sailors of the American Army -and Navy resident in McCracken County, or the members of the said American Legion, and IATEREAS, it is estimated that Nineteen Hundred and Fifty (81950.00) Dollars to be appropriated by the City of Paducah and the like sum of Nineteen Hundred and Fifty 01950.00) Dollars to be i appropriatediby the McCracken County Fiscal Court, together with other money and funds appropriated and donated for such purpose will be required for the erection of said monument and the preparation of said burial space, NOl7,THEREFORE, BE IT ORDAINED BY THE BOARD OF COIsSijiISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. There is hereby appropriated the sum of Nineteen Hundred and Fifty ($1950.00) Dollars to be applied as a payment upon a certain monument to be erected in Oak Grove Cemetery on the burial ground and space set apart by this ordinance as a soldiers? and sailorst burying ground, and to be paid upon and as part of the cost of said monument whenever said monument has been erected according to the plans, specifications and agreements as required by Chief Paduke Post Number 31 .of the American Legion and indicated by report of its proper officers. SECTION 2. There is hereby set apart a space approximately sixty (60) feet by seventy (70) feet fronting upon the South side of the main driveway in Oak Grove Cemetery and directly across the driveway from a like space set apart for memorial services in said cemetery, which space so set apart hereby is to perpetually remain a burying ground for soldiers and sailors under the approval of the proper executive officer of Chief Paduke Number 31 of the American Legion, and said burial ground shall be used for no other purpose except that herein specifically des- ignated, except as a place for holding memorial services. The city authorities and its agents in charge of said cemetery shall keep said PAGE 133 burying space in good condition so as to prevent the same from having the appearance of neglect, and the foundation for said monument shall be sufficient to hold said monument in place and to prevent the same from falling or inclining. The city will not be liable beyond the appropriation herein made for the installs'gion and placing said monument and keeping same in place. SECTION 3. No mounds, vaults, slabs, curbs, shrubbery or other monuments 6r markers of any kind shall be placed upon said grounds, except the regulation headstone prescribed by the United States Government to be placed at the head of the soldiers and sailors graves; SECTION 4. The appropriation herein provided for shall become and be effective from and after the date a like appropriation has been made and made available for the payment of s@id monument as herein provided for. Should the said Fiscal Court of McCracken County fail to provide such appropriation, then this ordinance shall be inoperative. The.funds hereby appropriated shall be charged to the Contingent Fund and paid out upon order of the Board of Commissioners. SECTION 5. Upon the appropriation of the funds by the McCracken anty Fiscal Court as herein provided, and after said monument s been erected, then the plot of ground hereby set apart as such ldiers and Sailors burying ground shall be deemed perpetually dicated for such purposes and for no other purposes; nor shall id monument thereafter be removed therefrom, but the title to said nument shall not thereby be vested in the City of Paducah.
