BE IT ORDAINED PY THE BOARD OF COE4MIS£IOTTERS OF THF CITY OF. PADUCAH, KENTUCKY: SECTION 1. That both sides of Washington Street, from the :'lest property Tine of Nineteenth Street to a point 150 feet ';lest of the !?est property line of Twentieth Street be improved by the constructing thereon concrete sidewalks, and concrete curbs and gutters on both sides of :9ashington Ltreet, from the West property line of ITineteenth Street to the East curb ine of Twenty-first Street, in the City of Paducah, Kentucky, with all ecessary manholes, intakes, sewers, catch basins and sewer pipe, in- luding ell necessary en-ineering, advertising and legal and clerical ervice in connection therewith, be and the same is hereby ordered to be mproved by the construction of concrete sidewalks, curbs and gutters, anholes, intakes, and catch basins and the placing of all drain tile, :elder pipe and other work necessary, including engineering, advertising nd legal and clerical service in connection therewith, upon bids made i It:'^.erefor, and .all to be done in strict accordance with the plans, 'pecifications, widths, grades, profiles and drawings in the office of the pormnissioner of Public Works and prepared by him for such purposes, all If which are hereby adopted as a part of this ordinance as fu`.ly as if P embracod herein or attached hereto and made part hereof and marked "A" ('.or :sorb specific identification. SECTION 2. That said work shall be constructed un,er the direction and Supervision of the Cormnissioner of Put -lie 7.ror'ks, and shell be commended tt a time designated by contract for the performance of said i'ork, and :ompleted on or before eic^at months after the nassage and recordino of 'ris ordinance. SECTION 3. That all the cost incident to said construction of said street provided in Section 1 hereof, shell be pais? for wholly by the. property ors and property abutting or fronting thereon on both sides of said PAGE" 203 street and to be apportioned to and assessed against the property ormers and property abutting t'�ereon on both sides of said street according to the number of feet or abutting feet thereon, except that the City of Paducah shall pay such portion of cost of construct- ion as required bj law. SECTION 4. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the SFecial Tax Bills and assessments against the property abutting the improvement herein provided for, and in no other way, except that the said contractor may be paid out of such bonds as may be issued, in accordance r,ith the law bf the City of Paducah and charter cities of the second class of the State of Kentucky, and for the payment of :hich, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said contractor for the excess of fifty (50a) per cent of the value of any property assessed for the construction of the work herein provided for. SECTION 5. The contractor awarded the contract herein provided for shall be raid mont%ly by Improvement ilarrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public !;!orks, to the extent of sixty-five (65%) per cent of the value of the work done or materials funnished by the contractor during the progress of the work, and said improvement warrants sgall bear six (6%) per cent interest from date of issual and shall be issued by the (Commissioner of Public Finance upon order of the Board of Commission- ers. Said Improvement !Varrants shall be negotiable and shall con- Istitute a lien upon the local taxes to he hereafter levied .for such improvement, and whall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon com- pletion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement 3-arrants shall be estimate ' and assessed as a part of the cost of the improvement herein pro- vided for. SECTION 6. The vlayor is hereby authorized and directed to execute all written contracts and bonds with the successful bidder for the construction of said improvement, as required by law. PAGE 104 SECTION 7. Bids sball bo receive(, for the construction o,: said work .c^ording to plans and specifications made and provided therefor by the Co minal6 rar of Public V!orks and reported to the Board of Commissioners at the next regular or called meeting and the contract therefor awarded to the lowest and best bidder, except that the right is expressly re- served to reject any and all bids within the discretion of the Board of Commissioners'. SECTION 8. This ordinance shall take effect and be in force ten days after its passage.
