AN ORDINANCE ASSESSING THE A'iUTTING PROPERTY ON BOTH SIDES OF CLAY STREET, FROM THE WEST -PROPERTY LINE OF 9TH STREET TO THE WEST PROPERTY LINE OF 10TH STRE:'T, AND THE ABUTTING PROPERTY ON BOTH SIDES OF 10TH STREET, FROM THE NORTH PROPERTY LINE OF CLAY STREET TO THE NORTH PROPERTY LINE OF'TRIMBLE STREET,; IN THE CITY OF PADJCAH, KENTUCKY, FOR THE COST OF CONSTRUCTION OF A HARD SURFACE ROADWAY CONSISTING OF A CONCRETE FOUNDATION WITH SHEET ASPHALT TOP, AS SHOWN ON PLANS, TO- GETHER'WITH THE NECESSARY MANHOLES, INTAKES, DRIVI71AYS AND DRAINAGE CONNECTIONS•, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADJCAH, AND PROVIDING THAT SAID COST MAY BE PAID IN TEN ANt1UAL INSTALLMENTS IN COMPLIANCE WITH THE PROVISIONS OF THE KENTUCKY STATUTES APPLICABLE THERETO. WHEREAS, the General Council of the City of Paducah, Ken- tlzcky, has heretofore, to -wit; on the 2gth day of July, 1926, adopted anho-rdinance, entitled, "AN ORDINANCE PROVIDING FOR'THE IMPROVEMENT OF CLAY STREET, FROM THE WEST PROPERTY LINE OF 9TH STREET .TO,zT-1 ,WEST PROPERTY LINE OF 10TH STREET; 10TH STREET, FROM THE NOf;TH PROPERTY fy .�.• LINE OF CLAY STREET TO THE NORTH PROPERTY LINE OF TRIvh1BLE STREET, IN THE CITY OF PADJCAH, KENTUCKY, BY THE CONSTRUCTION OF A HARD SURFACE ROAD^1AY, TOGETHER PITH ALL NECESSARY MANHtLES, INTAKES, AND SEWER PIPE CONNECTIONS, IN ACCORDANCE WITH THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AT THE COST OF THE ABUTTING PROPERTY OI'-NERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCRODANCE WITH THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN:" and, WHEREAS, it was provided in such ordinance that the cost i i of construction of said roadway, together with 'the necessary manholes, intakes and drainage connections be paid for by the abutting property owners on both sides of said streets, except that portion to be paid by the City of Paducah as required by law; and, l^lHEREAS, pursuant to said ordinance a contract was entered into on the 8th day of Sept. 1926, between the D. J. Ryan Construction Company, of Davennort, Iowa, and the City of Paducah, Kentucky, for the construction of same; and, WHEREAS, said contract has been completed and duly ac- cepted by the General Council on the First day of August, 1927, pur- suant to the recommendation of the Board of Public Works of said City;. NOW, THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADJCAH, KENTUCKY: SECTION 1. That all property on both sides of Clay Street, from the west property line of 9th Street to the west property line of 10th Street, and all property on both sides of 10th Street, from the north No. 988. property line.of Clay Street to the north property line of Trimble Street, In the City of Paducah, Kentucky, be, and the same is, hereby assessed folr 1. the cost of construction of hard surface roadways, consisting of concreted foundation with a sheet asphalt top wherever constructed, as shown on plans, together with all necessary manholes, intakes and drainage connections, as follows: I From the west property line of 9th Street to the west property line of 10th Street, per lineal foot ............................ $5.3284B53; From the north property line of Clay Street to the north property line of Trimble Street per lineal foot ....................... $5.0039939; as particularly shown by the City Engineer's estimate of said cost, filed and approved by the General Council of .said city, and which will appear on file in the offices of the City Clerk and City Engineer, respectively, and which is now referred to and -made part hereof.- . SECTION 2. That the funds derived film the assessment of said property shall be used for the purpose of paying off special tax bills issued a- gainst said property on such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That nursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owners, be paid in cash without interest within thirty days after the date of passage and pub- lication of this ordinance, or in ten annual installments, provided the pro- perty owners within thirty days enter into a written agreement with said I City, in accordance with the provisions of said Section 3101 of the Ken- tucky Statutes. SECTION 4. In order to provide the funds for the immediate payment of the cost of that portion of the special assessments herein provided for, which may be paid on the ten year installment plan, as hereinabove provided, the City of Paducah may issue and sell improvements bonds, and to secure payment of such bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment of principal and interest, but such bonds shall not be sold for less than par, and the proceeds de -i i rived therefrom shall be applied exclusively to the payment of the cost of such construction as hereinabove provided; and such bonds, if issued,il shall bear interest and shall be payable in accordance with the provi- sions of Section 3101 of the Kentucky Statutes.
