HomeMy WebLinkAboutOrdinances Book 8, Page 75, No Ordinance NumberOrdinances AN ORDINANCE REGULATING THE COLLECTION .:ND DISPOSITION OF WET GARBAGE IN THE CITY OF PADUCAH, MITUCKY ; AND FI=NG PENALTIES FOR THE �• VIOLATION OF ANY PROVISIONS HEREOF. BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCL"Y. SECTION 1.- DEFINITION. The term wet garbage as used herein is hereby defined as the organic waster matter both animal and vegetable from houses, kitchens, -restaurants, hotels, hospitals, etc., comprised chiefly of waste foods. SECTION 2.- A system for the collection and dispostion of wet garbage in the City of Paducah, Kentucky, is hereby established and for the purpose of facilitating the handling of same, said City is divided and laid off into five districts, bounded and described as follows: DISTRICTS NO. 1. All that portion of said City lying South of Island Creek and extending to the City Limits shall comprise the first district. No. 2. All that portion of s»id City lying between district No. 1, and the center of Tennessee Street, and extending ';lest to the City Limits shall comprise the Second District. Ido. 3. All that portion of said City lying between center of Tennessee Street, and the center of Broadway street and extending west to the City Limits shall comprise the Third District. No. 4. All that portion of said City lying between the center of Broadway street and the center of Trimble Street and extending 'West to the City Limits shall comprise the Fourth District. No. 5. All that portion of said City lying between center of Trimble Street and the City Limits on the Forth and ;lest shall comprise the Fifth District. SECTION 3. It shall be the duty of every housekeeper or occupant of any building wherein any food is prepared or wet garbage produced, to furnish a garbage can, of type and size specified herein, and to remove, or cause to be removed, the garbage placed in same from the premises as here- inafter provided. And a charge of ten (10�) cents per week will be made for such service, and paid each week by such housekeeper or occupant of any house as above provided, to the official garbage collector in the District in which such house or building is located. SECTION 4.- GARBAGE Cello. Each housekeeper or occupant of building as aforesaid shall provide for the sanitary keeping and disposition of such garbage, a metal can which shall hove a capacity of not mm e than 15 gallons, and which can shall have a tight fitting cover and strong handles. If one can is not sufficient to hold tine garbage accumulated for collection, then a sufficient number of cans shall be provided therefor. I No. It shall be the duty of each housekeeper or occupant to furnish such cans and keep the same in a clean, sanitary condition, free from leaks, cracks or loose covers. And it shall be the duty of said garbage collector to take good care of said cans, and to handle same in such manner as not to injure or break same, in so far as practicable. SECTION 5.- TIDE FOR COLLECTION. Said garbage shall be re- moved from said premises three times per week during the months of Ilay, June, July, August and September of each year, and.twice per week during the remainder of the year. The official garbage collector shall prepare a schedule of the day and hour of each week ,ahen such collection will be made at each particular house or premises within such district, and shall notify such housekeeper or occupant of the time of collection so fixed, and it shall be the duty of such housekeeper or occupant to place such garbage can either in front of the property or near the alley line at the beginning of the hour so desi,nated and fixed for the collection of same by said garbage collector so as to be accessible to such collector. And it shall be the duty of such collector to call and remove such garbage within the hour designated. SECTION 6. - HOTELS AND BIISI11_:SS ESTABLISH12?1dTS. All hotels, restau,ants, stores, markets, boarding houses or other establishments in the City of Paducah, Xentucky, wherein any garbage is accumulated or pro- duced shall remove such garbage from the premises each day during the months of ]Jay, June, July, August and September of each year, and at least three times per week during the 'remainder of the ,year. however, no garbage shall be removed from any such establishment by the official garbage collector, unless the owner or proprietor of same desires to secure the benefits of the service provided hereunder, and shall notify the Health Officer of said City, or such official garbage collector to such effect, when it shall be the duty of such garbage collector to serve such establishment in accordance with the provisions hereof. And in event such owner or proprietor shall elect to secure the service herein pro- vided, then the garbage can or cans provided therefor shall be placed so as to be accessible to said garbage collector, and in accordance with the directions of City Health Officer; and in other respects said hotels, i.estaurants and establishments shall comply with the provisions of this Ordinance, and keep and maintain their premises in a clean sanitary condition, and subject to the approval of the City Health Officer; pro- . vided small boarding. houses may, upon application, be classed as residences upon order of the City Health Officer. M No. Ordinances- SECTION rr'di nancesSECTION 7.- SEPARATION OF GARBAGE. SIHREAS, it is necessary to secure the service herein provided at the cost fixed and assessed against the housekeeper that the garbage shall be suitable to be fed to hogs and fowls, and therefore it shall be the duty of all housekeepers or others herein embraced to separate such garbage and to keep the same free from any crushed glass, fish bones, poisons or other substance that might be injurious for such use, and anyone violating ti --is rule shall be subject to the zine imposed hereunder. And in addition to such fine, the garbage . collector may decline to accept such garbage, and thereupon shall place a tag provided therefor upon the can containing same, when it shall become the duty of such offender to cause said garbage to be removed in accordance with the provisions hereof. Such offender may be reinstated for service only upon order of the City Health Officer. SECTION 8.- APAR M—ENT HOUSES - It shaLl be the duty of the owner or proprietor of every apartment house in said City, containing six or more apartments, to provide and maintain sufficient garbage cans for the occu- pants of said building; but each housekeeper or occupant of any apartment therein, coming• within the provisions of this ordinance, shall comply with all requirements in the placing and separation of such garbage and the pay- ment of the weekly charge for its disposal. SECTION 9•- DISINFECTATITS - In the event it is deemed necessary by the City Health Officer to keep any hotel, restaurant or other premises, nhereon garbage is placed and collected in a clean sanitary condition, free from any odor, said Health Officer may require the use of disinfectants, and such owner or proprietor shall be required to furnish same for the maintenance of such sanitary premises. SECTION 10. COMPLAINTS.- In the event of any difference of opinion between any housekeeper, owner or proprietor or other persons herein pro- vided for, and the garbage collector, concerning the location of garbage can, removal of garbage or other matter herein provided for, then the City Health Officer is hereby authorized to settle and determine such matters and his decision shall be final. Any complaints with reference to service on the part of said garbage collector may be referred to said City Health City Officer for attention. (The number of the telephone of said„Health Officer and each official garbage collector shall be placed on the card of in- structions delivered to each housekeeper and business establishment so served). SEC'iION 11.- CONTRACT LOWEST BIDDER - For the purpose of the • protection of health in the collection and disposition of garbage in accordance with the provisions of this Ordinance, and to provide the most economic way obtainable, the Board of Health of said City is hereby authorized and empowered to advertise for bids for the collection and disposition of such garbage in each of the districts mentioned, in said City, No. ' in accordance with the provisions hereof, and to award such contract to the lowest and best bidder, provided such contractor shall comply with the requi.c-ements hereof, and any and all rules and regulations established by said Board of Health. SECTION 12. Each person who shall be awarded a contract for the collection and disposition of garbage hereunder shall as a condition precedent to the doing of such work be 'required to execute a bond in the sum of $500.00, conditioned upon the faithful performance of such contract in accordance with the provisions hereof for each district herein provided. Should the contract be awarded to the same person for more than one or all the Districts, then one bond covering the total amount provided for each dist,.ict shall be executed by such contractor and accepted by said Board of Health. SECTION 13. Every garbage collector shall be required to furnish sanitary garbage vehicle properly equipped and fitted with covered tops, so as not to leak any garbage on the streets or alleys in said City, and so as to be free from unsightly appearance or objectionable odors, and such vehicle shall be of some standard type to be approved by the Board of Health. SECTION 14. Any person, firm or corporation that shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and subject to a fine of not less than .55.00 nor more than j25.00 for each offense, and each day of such violation shall constitute a separate offense. SECTION 15. Said Board of Health is further authorized to establish such rules and regulations, not inconsistent herewith as may be deemed necessary and proper to facilitate the benefits of the service herein provided, and which rules and regulations by vittue of the authority of said Board, and by virtue of the authority herein conferred, shall be as binding and effective as if specifically set forth herein. SECTION lb. This ordinance shall take effect and be in force from its passage, apn.c•oval and publication.
