LhEiuit.S, There has been created and established in the City of Paducah, Kentucky, Sevier District No. 3, which has been divided into Sub -Divisions A, B and C; and, :IhERE'aS, there is being constructed, in said Sewer District, trunk line sewers at the cost of the City of Paducah, nontucky, which trunk line severs have now been completed; and, Y.hisiiEaS, there has been created and established, Sewer Zone Plumber Four, in Sub -Divisions a and -B, Sewer District No. 3, by an Ordinance adopted by the Board of Commissioners on the 23rd day of Feb- ruary, 1923, v+herein said Zone is described by metes and bounds, and is hereinafter described, and a plat of which zone appears on file in the office of the City Engineer of the City of Paducah, nontucky, and may be inspected by anyone maxing application therefore at said office, and, s.FER&,ks, Sewer Zone Number Cour in Sub-Livisions A and g, Sevier District No. 3, is not provided with seviers and is in a thickly populated territory, and in order to provide adequate sewers for the property owners in said Zone, it is hereby deemed and declared a necessi- ty by the General Council of the City of Paducah, Kentucky, that sanitary sewers be constructed in said Zone in order to provide adequate se',ierage for the property owners residing in said Zone; NO)V., THEREFORE - BE IT RESOLVED B's UiE GEN'EHi,L COUNCIL OF THE CI TY OF PADUCAH, KEIT TUC..Y : SEC TION I. That it is hereby declared a necessity by the General Council of the City of Paducah, Kentucky, in order to secure adequate sewerage and in order to protect the health of the citizens residing in Sewer zone' /Number Four, Sub -Divisions i, and ij, Sewer District Plumber Three, that^s anitary/seviers be constructed and laid out at the cost of the lots. or parcels of lane benefitted thereby, and all of the lots or parcels of land embraced in said Zone are hereby declared to be the property bene- fitted, and subject to be assessed for the cost of constructing said sewers SECTIO14 2. Said Sevier Zone Number Four of Sub -Divisions , and & of Sevier District Number Three, in which said sewers are to be constructed is described by metes and bounds as follows, to -wit: rvo. uD Ordinances "Beginning at a point, the intersection of the center line of 13th street and the center line of an alley parallel to and 203 feet 3 inches southvard from Trimble Street, said point being on the boundary of Sewer District No. 2; thence southward with the boundary of Sewer District No. 2 along the center line of 13th street, to a point 206 feet 3 inches northward from the center line of Broadway; thence at right angles westward, continuing along the boundary of Sewer District No. 2, parallel to and 206 feet 3 inches northwardly from the center line of Broadway, to the center line of 16th street; thence at right angles southward with the boundary of Sewer bistrict No. 9, 206 feet 3 inches to the center line of Broadway; thence at right angles westward with the boundary of Sewer District No. 2 along the center line of Broadway to EL point on the west line, if extended, of property of Lars. dosena _V.bradshaw, said Best line being 673 feet from the east property line of that part of 17th street (Fountain Avenue) which extends south from Broadway; thence eastward along the center line of said al- ley to the center of 20th street; thence southward along the center line of 20th street to the north property line of the Hinkleville Road; thence eastward along the north property line of the Hinkleville Aosd and the north property line of Trimble street, to the point where the northeast boundary line, if extended, of the Oak Grove Cemetery intersects the north property line of Trimble Street, said point being 117 feet, more or less, west of the center of 16th street; thence northward with said northwest boundary•line of Oak Grove Cemetery to the center line of Tully Avenue, or to said center line of Tully avenue extended; thence northward, on a line with the center of Tully avenue to a point 180 feet northward from the center of Trimble street, measured at right an- gles, to Trimble street; thence eastward along the line of rear boun- daries of the lots which face on Trimble street in Block No. 46 of the Flournoy, Norton, Trimble and Harris Addition, to the line between lots numbers 3 and 4 of said Block No. 46; thence southward along said line between lots 3 and 4 to the center of Trimble street, a point 39 feet, more or less, westward from the intersection of the center line of Trimble street and the center line of 15th street; thence eastward along the center line of Trimble street to the center line of 14th street; thence southward along the center line of 14th street 203 feet 3 inches to the center line of an alley between Clay street and Trimble stree;.r thence westward along the center line of said alley to the center of 13th street, to the point of beginning." SECTION 3. Said zone embraces the hereinafter named streets and alleys, and all of the property in said Zone that is benefitted by said sower zone does not abutt on said streets and alleys; some of said property not abutting on any of said streets or alleys so named. Said sewers shall be constructed along and under the following named streets and alleys in Sevier Zone No. 4, in Sub -Divisions a and C, 0-9 Sewer District No. 3, end the cost of same shall be apportioned against all the property in said senor zone as follows: (a) All the lots or parcels of land bounding or abutting on the hereinafter named streots, alleys or highways along or under which such sewers shall be constructed are hereby declared to be the property bene- No. Ordinances fitted thereby, and said cost shall be apportioned and assessed equally against said abutting lots or lands according to the abutting feet there- on, provided that the cost of said construction does not exceed.F?2.Uu per abutting foot. (b) In the event the cost of construction of said sewer shall ex- ceed $2.uu per abutting foot along any of said streets, alleys or high- rays whereon said sewer shall be constructed, then such cost shall be ap- portioned against all of the lots or lands in said Sevier Zone which are hereby declared to be equally benefitted by said sewer, according to the area in square feet of the lots or lands so benefitted. (c) Stith reference to all the lots or lands not bounding or abutt- ing on the said streets, alleys or highways along and under which said sewer shall be constructed, the cost of same shall be apportioned against all of such lots or lands according to the area ins quare feet. And which streets, alleys and highways along which said sewer shall be constructed are described as follows, to—reit: 25th street from Jefferson street southwardly to the north prop- erty line of Broadway a distance of 349.2 feet. 24th street, from Hinxleville road northwardly to dildred street, a distance of 1623 feet. 23rd street from Jefferson street, southwardly to an alley between Jefferson street and Broadway, a distance of 192.5 feet. 23rd street from Kentucky avenue southwardly to an alley between Kentucky avenue and Broadway, a distance of 206.3 feet. 23rd street, from Hinnleville road, northwardly to Mildred street a distance of 1612 feet. 22nd street from Hin,tleville road, northwardly to Mildred street a distance of 1583 feet. An alley between 20th street and 21st street and running parallel thereto, from Clarn street to a point near Adams street, a distance of 357.9 feet. An alley between 20th street and 21st street, running parallel thereto, from Adams street to a point near Jacxscn street, a distance of 356.4 feet. "C" street, from Guthrie avenue southwestwardly to '+heeler avenue a distance of 554 feet. "B" street, from Y,heeler avenue northeastwardly to a point near an alley between c,heeler avenue and Guthrie avenue, a distance of 280 feet. i;heoler i+venue, from "B" street, northwestwardly to "C" street, a distance of 396 feet. House service lines to be connected to present sewer across pri- vate property, northwardly from a point 383.8 feet more or less from the east property line of 19th street to 21st street and Hinkleville road. hinkleville road house service lines to be connected to present sewer from 21st street westwardly to 24th street. 6 inch house service lines shall be connected from the sewer to property line to all lateral sewers to be constructed in Zone No. 4. All the above described lateral sewer lines arV &*'k oristructed with 6 inch house connection service lines extending from the sewer proper to the'prdperty lines of all property abutting'on'thb s`tsebts or alleys in-;-V-hick if is prioposed to construct the above describedlateral sewers in such manner as to properly serve the property benefitted. Six'inch house connection service lines are to be constructed from the present sewer lines (built under the $600,000 bond issue) to the property lines of all abutting property on the following streets, or alleys, in such manner as to properly serve the property benefitted., No. LO�. Hinkleville road from a point about 30 feet westward from the center line of 20th street westward to 24th street. 19th street from Clay street southward to Jackson street. 15th street from the intersection of Trimble,Burnett, and 15th street southward to Clay street. SsCTION 4. Notice is hereby given to the oz;ners of all property in said Zone, and all property bounding or abutting on any of said streets, alleys or highways, that the cost of construction of said sewer will be assessed against such property in the manner hereinabove provided. SECTION 5. A blue print or plat showing the boundary of sever zone NO -4 naming and showing the streets embraced in said zone, and showing the line and course of the sewer to be constructed hereunder, is filed herewith and made a part hereof, marked exhibit A. SECTION 6. For additional information of the public and owners of property in said Zone a blue print or plat showing the boundary of said Sevier zone End showing the streets embraced therein and the line and course of the sewer to be constructed hereunder, will be found on file in the office of the City Engineer of the City of Paducah, and may be in- spected at any time upon application at saic office. SECTION 7. This resolution shall take effect and be in force after its Passage, approval and publication; and any previous resolution in con- flict herewith is hereby repealed. 0.
