HomeMy WebLinkAboutOrdinances Book 8, Page 47, No Resolution NumberOrdinances - A RESOLUTION DECLriRING THE CONSTRUCTION OF SANITARY SEWERS IN SEVER ZONE NUMBER Ti3O, IN SUB -DIVISION B SE_ivER DISTRICT NU[dBER THREE, TO BE A NECESSITY eND SETTING OUT IN GENERAL TERNS TIIE RtOPERTY SUBJECT TO 'THE PAYMENT OF THE COST OF SAGIE. .%HEREAS, There has been created and established, in the City of Paducah, Kentucky, Sevier District No. 3, which has been divided into Sub - Divisions A, B and C; and, 1+HEftL•'AS, there is being constructed, in said Sevier District, trunk line sewers at the cost of the City of Paducah, nentucky, which trunk line sewers have now been completed; and, ".HERE,,S, there has been created and established, Sevier Zone Number Two, in Sub-Livision B. Sevier District No. 3, by an Ordinance adopted by . the Board of Commissioners on the 23rd day of February 1923, wherein said Zone is described by metes and bounds, and is hereinafter described, and a plat of which zone appears on file in the office of the City Engineer of the City of Paducah, nentucky, and may be inspected by anyone making application therefor at said office; and, LHEHSaS, Sevier Zine Number Two, in Sub -Division B, Sewer District No. 3, is not provided with sewers and is in a thickly populated territory and in order to provide adequate sewers for the property owners in said Zone, it is hereby deemed and declared a necessity by the General Council of the City of Paducah, Kentucky, that sanitary sewers be constructed in said Zone in order to provide adequate sewerage for the property owners residing in said Zone, NOV,, THEREFORE - BE IT RESOLVED BY 'rHE GEITERriL GOUNCII. OF THE CITY OF PADUCAH, KENTUCnY: SECTION I. That it is hereby declared a necessity by the General Council of the City of Paducah, nentuoky, in order to secure adequate sewerage, and in order to protect the health of the citizens residing in Sewer Zone Number Two, Sub -Division B, Sewer District Number Three, that sanitary sewers be constructed and laid out at the cost of the lots or parcels of land benefitted thereby, and all of the lots or parcels of land embraced in said Zone are hereby declared to be the property benefitted, and sub- ject to be assessed for the cost of constructing said sewers. SECTION 2. Said Sewer Zone Number Two of Sub -Division B, of Sewer District Number Three, in which said sewers are to be constructed is described by metes and bounds as follovis, to -wit: No.11- � Ordinances- "Beginning rrdin unces "Beginning at a point in the center line of Jones street, if; SEC TI Ord 3. Saie zone embraces the hereinafter named streets and alleys and all of the property in said Zone that is benefitted by said sewer does not abutt on said streets and alleys; some of said property not abutting on any of said streets or alleys so named. No. j/ Ordinances • Said sewers shall be constructed along and under the follow- ing named streets and alleys in Serer 'Lone No. 2 in Sub -Division B, Sevier District No. 3, and the cost of same shall be apportioned against all of the property in said Sevier zone as -follows: (a) all the lots or parcels of land bounding or abutting on the hereinafter named streets, alleys or highways along or under which such sewers shall be constructed are hereby declared to be the property bene- fitted thereby, and said cost shall be apportioned and assessed equally against said abutting lots or lands according to the abutting feet there - On, provided that the costs of said construction does not exceed N2.00 per abutting foot. (b) In the event the cost of construction of said sewer shall exceed y2.00 per abutting foot along any of said streets, alleys or highways whereon said sewer shall be constructed, then such cost shall be apportioned against all of the lots or lands in said sewer zone Which are hereby declarea to be equally benefitted by said Sevier, according to the area in square feet of the lots or lands so benefitted. Along Island Creek from the present sewer under the concrete arch bridge where 4th street crosses Island Creek; thence southward in the same general direction of the creek to Allen street and thence southward along Allen street to Bridge street. All the above described lateral sewer lines are to be constructed with 6 inch house connection service lines extending from the sewer proper to the property lines of all property abutting on the streets or alleys in which the above described lateral sewers are to be built, in such man- ner as to properly serve the property benefitted. Six inch house connection service lines are to be constructed from the present savior lines (built under the 600.000 bond issue) to the property lines of all abutting property on the following streets or al- leys in such manner as to properly serve the property benefitted. Caldwell avenue from Caldwell street to a point 830 feet southward from Caldwell street and from Brown street otherwise known as Union street northwardly, a distance of 298.42 feet from the center line of Brown street, otherwise known as Union street. Brown street and that part of Brown street known as Union street from Caldwell avenue to Green street. Little avenue, that portion which the railroad tracks near the Union depot from the center line of Brown street, otherwise known as Union street, to a point in the western right of way line of the Nash- ville, Chattanooga and St -Louis Rail++ay, which point is 132.5 feet westwardly from the center line of Brown street, otherwise known as Union street. SECTION 4. Notice is hereby given to the owners of all property in said Gone and all property bounding or abutting on any of said streets, alleys or highways, that the cost of construction of said sewer will be assessed against such property in the manner hereinabove provided. SECTION 5. A blue print or plat showing the boundary of sewer zone No. 21 naming and showing the streets embraced in said Zone, and showing the line and course of the sewer to be constructed hereunder, is filed herewith and made a part hereof, marked exhibit A. SECTIO14 6. For additional information of the public and owners of property in said Zone, a blue print or plat showing the boundary of said zone and showing the streets embraced ttherein, and the line and course of the sewer to be constructed hereunder, will be found on file in the office of the City Engineer of the city of Paducah, and may be inspected at any time upon application at said office. SECTION 7. This resolution shall take effect and be in force after its pas- sage, approval and publication; and any previous resolution in conflict herewith is hereby repealed. ae �I"o V "7L q
