WHEREAS on the 22nd day of May, 1925, the General Council of the City of Paducah adopted an ordinance entitled "AN O'DINANCE TO CREATE AND ESTABLISH A FRANCHISE TO CONSTRUCT, 01JN5 ACQUIRE, I;IAINTAIN AND USE A WATER 17ORKS PLANT AND '"DATER DISTRIBUTING SYSTEM 1," [THIN TILE CORPORATE LIMITS OF PADUC:UI AND INVcSTING THE PURCHASER THEREOF 'IiITII THE RIGHTS, PO'. -,ER AND PRIVILEGES HEREIN SET FORTH AND IMPOSING UPON SUCH PURCHASER THE DUTIES AND RESPONSIBILITITES SET OUT IN THIS ORDINANCE." AND WHEREAS said ordinance directed the Mayor of the City of Paducah after reasonable advertisement to sell the franchise therein established to the highest and best bidder: AND WHEREAS the Mayor of Paducah has reported to the General Council that he did, after due advertisement, offer for sale the franchise in said Ordinance on the 12th day of June 1925, and that the Paducah Water Company became the purchaser of said franchise: AND WHEREAS the action of the I:layor in selling said franchise to the Paducah Water Company has been regularly and duly approved by the General Council of Paducah: AND WHEREAS under the terms of said Ordinance the rates to be charged to water consumers by the purchaser thereof are fixed and determined: AND WHEREAS Said Paducah 'Nater Company is now the owner of said franchise and empowered to take, have aid receive for supplying water to the City of Paducah and its inhabitants and other persns o using the water of said Paducah ''Vater Company the rates and prices fixed in said Ordinance. AND WHEREAS the Paducah 'Mater Company, in order to enable the citizens of Paducah, and the City of Paducah to become familiar with the rates so established and fixed in said Ordinance, has agreed that it will not put into effect the rates so established in said Ordinance until July 1st, 1925. NOW THEREFORE BE IT RESOLVED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, that the city of Paducah and the Paducah Water Company hereby agree that the rates as established in said franchise shall not begin to run until July 1, 1925, AND BE IT FURTHER RESOLVED: That the amount the Paducah i Water Company is authorized and empowered to earn, as set out in Section 18 of said franchAse, shall be computed ffom July 1, 1925, as the beginning date of the fiscal ,year. No.33. The purpose of this resolution is to show that the City and the Plater Company have agreed that under the terms of the Ordinance the Water Company's earnings from the rates as fixed in said Ordinance shall be determined by taking July 11 1925, as the beginning date for ascertaining the amount of such return. -, K.
