AN ORDINANCE PROVIDING FOR THE IrPROVE?.SENT OF 5TH STREET FROM THE SOUTH PROPERTY LINE OF ELIZABETH STREET TO THE NORTH PROPER LINE OF BROAD STREET, IN THE CITY OF PAEUCAH, KENTUCKY, BY GRADING AND GRAVELING S0E; IN ACCORDANCE WITH TILE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEER, AT THE COST OF TILE O'INERS OF THE ABUTTING PROPERTY, AND PROVIDING THAT SUCH COSTS MAY BE PAID UNDER THE PROVISIONS OF THE TEN YEAR PAYMENT PLAN. BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADU CAH, KENTUCKY: SECTION 1. That 5th Street from the south property line of Elizabeth Street to the north property line of Broad Street, in the City of Paducah, Kentucky, be improved by the grading and graveling of same, i together with the installation of all necessary manholes, intakes, j catch basins, drain pipes and sewer pipe connections, in accordance illwith the plans and specifications provided therefor by the Engineer of said City, which plans and specifications on file in the office of said Engineer are now referred to and made part hereof as if I specifically set forth herein. SECTION 2. Said improvement shall be made under the direction and supervision of said Engineer and Board of Public IVorks of said City, and shall be commenced at the time designated by contract for the performance thereof and completed on or before December 1st, 1925. i The Board of Public :`forks is hereby directed to let contract for such work subject to the agreement of H. V. Keebler to furnish dirt i required for the filling of said street to grade level as shown by the plans aforesaid. j SECTION 3. The cost of said improvement shall be paid for wholly by the property owners abutting and fronting thereon, to be apportioned to and assessed against the property abutting thereon, according to i the abutting feet, except that portion to be paid for by the City of Paducah, as required by law. SECTION 4. The contractor awarded the contract for the improvement I I herein provided, shall be paid in accordance with the provisions of j, 3096, 3100, 3101 and 3102 of the Kentucky Statutes. I � No. *48. r SECTION 5. The -Mayor of said City is hereby authorized and directed to execute all written contracts that may be required of the successful bidder for the construction of said street. SECTION 6. Bids shall be received for the construction of said street,' in accordance with the plans and specification made and provided therefor, by the Engineer of said City, and the contract therefor shall be awarded to the lowest and best bidder, except the right is reserved to reject any and all bids within the discretion of the Board of Public Works and . the General Council, and said General Council may accept any bid which it deems best for the interests of said City. SECTION 7. The Board of Public Works of said City is hereby authorized and directed to advertise for bids for the construction of said improvement, which bids said Board is directed to report to the General Council with its recommendation for the acceptance of any of same, or the rejection of all of same.
