FOR TEE COST OF CONSTRUCTION OF SAID IMPROVI-!S:di:T, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PADUCAH, I',ENTUCKY, AND PROVIDING THAT SAID COST MAY BE PAID IPI TEN ANNUAL PAYI,E`NTS, BEING ONE EACH YEAR FOR A PERIOD OF TEN YEARS. WHEREAS, the General Council of the City of Paducah has heretofore, to -wit: on July 28th, 1924, adopted an ordinance entitled, "An ordinance providing for the improvement by grading and graveling the same, of the following streets in the City of Paducah, Kentucky, to -wit: - Kentucky Avenue from 20th Street to 25th Street; Clark Street from 17th Street to 21st Street; Leach Avenue from 10th Street to 11th Street; 11th Street to Leach Avenue to Burnett Street; Jackson Street from the intersection of 19th Street and Guthrie Avenue to 25th Street; Monroe i Street from 21st Street to 25th Street, 21st Street from Monroe Street to the alley between Monroe Street and Jefferson Street; 23rd Street from Monroe Street to Jefferson Street; 21st Street Brom Broadway to Jackson Street; 23rd and 24th Street between Broadway and Kentucky Avenue Streets; and 22nd Street from Broadway to Jefferson Street, together with all necessary manholes, intakes, catch basins and sewer pipe connections, in accordance with the plans, specifications and grade provided therefor by the City Engineer of said City, at the cost of the abutting property owners, and providing that same may be paid for upon the ten year payment plan;" and, WHEREAS, in accordance with said ordinance it was provided' that the cost of construction of said improvements be paid for by the abutting property owners of both sides thereof, except that portion bo be paid by the City of Paducah, Kentucky, as required by law; and, L M�� NO. �41. WHEREAS, pursuant to said ordinance, a contract was entered into on the 15th day of September, 1924, between Yancey & Johnson of ;Paducah, Kentucky, and said City for the construction thereof, and, 11MEREAS, said construction has been completed and duly accepted by the General Council on the 18th day of hiay, 1925, purduan to the recommendation of the Board of Public Works and said City; NOWT THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAII, KENTUCKY: ' SECTION 1. That all property on both sides of the following named streets in the City of Paducah, Kentucky, to -wit: Kentucky Avenue from 20th to 25th Street, Clark Street from 10th to 21st Street; Leach Avenue from 10th Street to 11th Street; 11th Street from Leach Avenue to Burnett Street; Monroe Street .from 21st to 25th Street; 21st Street from Monroe Street to an alley between Monroe Street and Jefferson Street; 21st Street from Broadway to Jackson Street, 23rd Street and 24th Street from Broadway to Kentucky Avenue; 22nd street from Broadway to Jefferson; be,and the same are hereby assessed for the cost of construction by grading and graveling same, together with all necessary manholes, intakes, catch basins, and sewer pipe connections and cast iron drain pipes as follows: ! Gravel of 42 Feet in width ..... $2.50 per abutting foot.1 Travel of 40 feet in width..... 2.38 per abutting foot.! Gravel of 37 feet in width..... 2.15 per abutting foot. Gravel of 17 feet in width..... 1.05 per abutting foot., Interest cost per dollar of construction cost.......... ....0.020838, as particularly shown by the City Engineerys estimate of such cost on file in his office, which estimate is now referred to and made part !; hereof. SECTION 2. I� I That the funds derived from the assessment of said property! shall be used for the purpose of paying off the special tax bills issued against said property, or such bonds as may be used by the City I'of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. i That pursuant to Section 3101 of the Kentucky Statutes, said tax assessment may, at the option of the property owner, be payable in Icash without interest within 30 days from the date of passage and (!publication of this ordinance, or in ten annual installments, provided, ! the property owner shall before the expiration of said 30 days, enter jinto a written agreement with said City, in accordance with the provisions of Section 3101 of the Kentucky Statutes. ! No.'A42. SECTION 4. In order to provide a Fund for the immediate payment of the cost of that portion of the special assessment herein provided for which may be paid for on the installment plan, as hereinbefore proijided, the City of Paducah may issue and sell improvement bonds, and to secure the payments of such bonds, there is hereby pledged such taxes and liens on the property assessed herein for the payment.of the principal and interest, but such bonds shall not be sold for less than par, and the proceeds derived therefrom shall be applied exclusively, to the payment of the cost of said construction as hereinbefore provided, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes as amended by Act 1910.
