I• FOR THE COST OF CONSTRUCTION OF SAID IMPROVE-IENT, EXCEPT THAT PORTION TO BE PAID FOR BY THE CITY OF PALU CAH, KENTUCKY, AND PROVIDING THAT SAID COST i7A7 BE PAID IN TEN ANNUAL PAYMENTS, BEING ONE EACH YEAR FOR A PERIOD OF TEN YEARS. i i j WHEREAS, The General Council of the City of Paducah, i' entitled, "An ordinance providing for the construction of j Kentucky, has'heretbfore, to=wit; on October 16th, 1924, adopted an ordinance concrete sidewalks, curbs and gutters, lbeluding all intersections I not heretofore constructed, as shown by the plans of the City Engineer provided therefor, together with all necessary manholes, intakes, catch basins and cast iron drain pipes and sewer pipe connections, on I both sides of Jackson Street from the ,vest property line of.lOth Street .. I to a point about 235 feet west of the west property line of 13TH Street in the City of Paducah, Kentucky, in accordance with the plans' and specifications furnished by the City .Engineer, at the cost of the i abutting property owners, and providing that the same may be paid for upon the ten year payment plan"; and, on November 24, 1924, adopted an ordinance entitled "An ordinance providing for the con- struction of concrete sidewalks, on both sides of north 9th Street from the north property line of Monroe Street to the south curb line of Madison Street, excepting the intersection heretofore constructed as shown on the plans of the City Engineer, together with all necessary manholes, intakes, drain pipes and sewer pipe connections, r. HE in the City of Paducah, Kentucky, in accordance with the plans and specifi- cations furnished therefor by the City Engineer of said City at the cost of the abutting property owners, and providing that such cost may be paid under the ten year payment plan"; and, Whereas, in said ordinances it was provided that the cost of construction of said sidewalks, curbs and gutters be paid for by the abutting property owners on both sides thereof, except that portion to be paid by the City of Paducah as .required by law; and, Whereas, pursuant to said ordinance a contract was entered into on November 28, 1924, between G. 71. Katterjohn, Jr., of Paducah, Kentucky, and the said City; for the construction thereof; and, Whereas, said contract has been completed and duly accepted by the General Council on the 18th day of May, 1925, pursuant to recommendations of the_Board of Public "lorks of said City; NOW; THEREFORE, BE IT RESOLVED BY THE GENER:iL COUNCIL OF THE CITY OF PADUCJ�H, KENTUCKY: SECTION 1. That all property on both sides of Jackson Street from the west property line of 10th Street to a point about 235 feet west of the west property line of 13th Strect and on both sides of north 9th street from the north property line of T;lonroe Street to the south curb line of II Madison Street, in the city of Paducah, Kentucky, be, and the same is, hereby assessed for the cost of construction of concrete sidewalks, curbs and gutters as follows: I Concrete sidewalks ............ 17- per sq. ft. Concrete Cupb:.Circular..... ...70� per lin. ft. Cost of expansion joints where used for sidewalks, driveways, curbs and gutters.............$0.0467884 per abutting foot. Interest Cost..................�O.007743 per dollar of construction cost, as particularly shown by the said Engineerts estimate of said cost on file' in his office, including the cost of all necessary manholes, intakes, catch basins, cast iron drain pipes and sewer pipe connections used in such construction, and which estimate is referred to and made part hereof.l, : SECTION 2 : That the funds derived from the assessment of said property, shall be used for the purpose of paying off the special tax bills issued I against such property, or such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101 of the Kentucky Statutes, SECTION 3 That pursuant to Section 3101 of the Kentucky Statutes, said tax assessments may, at the option of t:ie property owner, be payable in No. cash without interest within thirty days from the date of passage and publication of this ordinance, or in ten annual installments, prov the property owner shall before the expiration of said thirty days, enter into a written agreement with said pity, in accordance with the provisions of section 3101 of the Kentucky Statutes. SECTION 4 In order to provide a fund for the immediate prtyment of the cost of that portion of the special assessment herein provided for which may be paid for on the installment plan, as hereinbefore provided, the City of Paducah may issue and sell improvement bonds, and to secure the payment of such bonds, there is hereby pledged such itaxes and liens on the property assessed herein for the payment of the Iprincipal and interest, but such bonds shall not be sold for less 1 than par, and the proceeds derived therefrom shall be applied exclusi% ly, to the payment of the cost of said construction as hereinbefore provided, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes as amended by Act 1910.
