'.:H=AS, The Board of Commissioners of Paducah, Lentucky, adopted an ordinance on February 23rd, 1923, dividing part of Sub - Divisions A, B and.C, in Sevier District Tlo. 3, into five sewer zones i'or the purpose of constructing sewers therein, so as to provide dd.equate sewers for the property owners within said zones; and, H,EFAS, Since the adoption of the aforeaaid ordinances the City of 'Paducah has b:;, a vote abandoned the Commission Form of uovernment, and has returned.to the old form of :,ldermanic Government, and by the express provisions of the law the acts, ordinances and laws, enacted under either form of government remains in force under the succeeding form of said government; and, „IFPFAS, .the General Council of said City has adopted a resolution declaring the construction of such sewers in said Sewer ,Zone, No. 1, to be a necessity; NOV,, THEREFORE, BE IT ORDAINED BY THE GEIr RAL COUNCIL OF T1II: CITY OF PADUCAH, XEUTUCI:Y: s SECTION 1. That sanitary servers be, constructed in, under and along the streets, alleys and highways, in Sevier Zone No. 1, in Sub - Division C, Sevier District No. 3, in the city of Paducah, Kentucky, as follows, to -wit: On ashcraft tivenue commencing at the proposed sever on Bridge Street or the Benton Road, and rurming thence Northward on Ashcraft .venue, crossing Soviell Street to a point 500 feet northward from the south property line of Sowell Street, a total distance of approximately 1225 feet. On Bayes Avanue, commencing at the proposed Sevier on Bridge Street, or the Benton Road, and running thence north�riardkon Tiayes Avenue, a distance of 600 feet from the cent(,,`"o"'_'_)ridge Street or the Benton Road. On Hayes Avenue, commencing at the proposed server on Yeiser Street and running south:•rardly a1onE Hayes Avenue, crossing Powell Street to a point 450 feet south of the center line of Powell Street a total distance of appro-Ximately 925 feet. On Ashbrooke Avenue, cor,mencing at the present trunk line Sevier on bridge Street or the 3enton load, and -running thence northwardly on :shhrook Avenue from the center line of Bridge street or the 3enton Road, to the No. 50. center line of Sowell Street, a distance of approximately 500 feet. Farle�r Place, commencing at the present trunk line server on L-eyers Street and running thence southwardly on Farley Place, a distance of 770 feet from the center line of I.Ieyers Street. On Jarrett Street, commencing at the proposed secrer on Powell Street and running thence northwardly on Jarrett Street, a distance of 494.25 feet from the center line of "Powell Street. On Jarrett Street, commencing at the proposed sewer on Pose11 Street and runnin€ thence southwardly on Jarrett Street, a distance of 342.05 feet from the center line of "Powell Street. On 3ridge Str-et, or the Benton Road, cormi!encing at the end of the present trunk line se-ier on !ridge Street, or the 3enton Road, at the center line of `Jasseur :venue, and running southward along Bridge Street or the 3enton Road to the point of intersection of the center lines of 3ridge Street, or the 3enton-Road and Lill Street, a total distance of ap:oro.:imately 2296 feet. On Bridge Street, or the irienton Road, comrnencing at the present trunk line se:,.er on Clements Street and running thence northwardly on 3ridge Street, or the Benton Road, crossing .''inkead -venue and crossing Jarrett Street to a point 120 feet north of the center line of Jarrett Street, a total distance 'if approximately 525 feet. On P,well Street, comrnenc:i,n[ at the proposed sewer on .skbrook Avenue, and running thence weet:vardly on Powell Street, a distance of .300 feet from the cent�:r line of Askbrook _venue. On P�,rel1 Street, commencing at the present trunk line sever on Clements Street and running thence west- wardly on Powell Street, a distance of 321 feet to the center line of Jarrett Street. On Yeiser Street, commencing at the present trunk line sewer On Clements Street and running thence east- wardly on Yeiser Street crossing 19oodward Street, nshbrook Avenue, Cooley avenue and Hayes Avenue to a point 150 feet eastward from the center line of Hayes Avenue, a total distance of a-pproximately 1050 feet. On Short Street, commencing at the present trunk line sewer on Clements Street, and running thence west- wardly on Short Street to a point 360 feet westward from the center line of Clements Street. On L:eyers Street, commencing at the end of the pre- sent trunk line sewer on I.leyers Street, which point is 440 feet eastward from the center line of Wood:•iard Street and running from this -point (the end of the present trunk line sewero, thence westward along L;eyers Street to the center line of I:!i.11 Street, a total distance of apr.rox- imately 2000 feet; that portion of the sewer on L.eyers Street from a point 4,iO feet eastward from the center line of 47ood,:iard Street to a point 770 feet east;�;ard from the center line of C,`oodward -.trent, a distance of 5,50 'feet, being outside Zone i;o. 1, of Sub -Division C, �jewe'r District No. 3. On Sowell Street, conunencing at the proposed sewer on :.shbrook ,'venue and running thence ;vestwardly a dis- tance of 105.65 feet from the center line of -shbrook Avenue. On Ashbrook Avenue, commencing at the proposed sewer on Yeiser Stroet and runnins' thence southwardly on nshbrook .venue, crossing Powell �Dtree.t to a point 500 feet southward from the center line of Powell Street a total distance of appro::inately 975 feet. On Voodward Street from the present trunk line sewer on I-eyers Street and running thence south- wardly on GJoodward Street, a distance of 675 feet from the center line of Lieyers Street. All the above lateral sevier lines are to be con- structed !•jith 6 inch house service lines extending from the sewer proper to the property lines of all property abutting- on the streets or alleys in which the above described lateral se,jers are to be built in such manner as to properly serve the property benefitted. Six inch house service lines are to be constructed from the present sewer lines - built under the `600,000.00 bond issue, - to the property lines of all abutting property on the following streets or alleys in such manner as to properly serve the property benefitted. On I.:eyers Street from a point 435 feet north- :,!ard from the center line of FarleT; glace to a point 44P feet south-iard from the center line of Woodward street, a total distance of approximately 1600 feet. On Clements Street from the center line of L;eyers Street to the center line of 3ri4e Street or the Benton load. On 3ridge Street, or the 3enton Road, from the center line of Clements Street to the center line of Vasseur -venue. SECTIOU 2. - the cost on constrneting said se%,!ars shall be apportion - 3d equally against the abutting lots or parcels of land, according ;o the number of feet abuttin,. thereon, and shall be paid for by the owners of said lots or parcels of land abutting upon such street, alleys and highr!ays, provided the cost of same does not exceed 52.00 per abutting foot. In the event the cost of ;paid improvement shall exceed the sum of x2.00 per abutting foot, then all the lots or i ,,parcels of ground in said zone are hereby declared to be t;e prorerty ,benefitted, and the entire cost of the construction of said se:,aers shall be assessed against each of daid lots or parcels of ground em- 1,Draced in said zona in the proportion that the area in square feet of such lots or parcels of ground shall bear to the area in square feet of all of the lots or parcels of ground located in said zone; _nd the General Council shall fix and assess the amount of tax to be levied upon each of said. lots or parcels of ^round in said zone as required by law. SECTION 4. Said se�ier shall be constructed in strict accordance z�ith the plans, grades, :specifications and profiles as prepared and i'urnished by the City Engineer of said City of Paducah, and adopted by the General Council of said City. Bids shall be received for the construction of said seviers according to the plans, specifications and profile, and con- tract therefor shall be awarded to the lowest and best bidder, e:;cept the right is expressly reserved to reject and and all bids, within 'tI-e discretion of the General Council, and it may accept any bid which appears to be for the best interest of the City of Paducah. SECTION 6. The. Board of Public ',;orks of said City is hereby authorize :and directed to advertise for bids for the construction of said sewer land said Board shall report the bids received by it, with its recomm- i Iendation for the acceptance of any of same or the rejection of all of Lame. Said work shall be constructed under the. direction and I suaervision of the City .engineer and the Board of Public Works of id city, or their authorized agents, and the same shall com,:lence and jbe completed at a time designated by contract, j bEC`YIOId 8. The contractor awarded the contract for the .,ior, herein ovided, shall be paid only from the funds arising from special tax 11s or assessments made a;ainst the property located in said Sevier one, except that said contractor may be paid out of such bonds as be issued according; to law, and as provided in Section :101, 3102 and 3105, Kentucky Statutes. SECTIOA 9.
