A NT';CESSITY, ,iNl, OUT, IN GENERAL _FRMS, THE PROPERTY-UBJLCT TO -= PAYLENT OF _HE COS'_ OF 1YHEREA6: There has been created and established, in the City of Paducah, Kentucky, bewer District No. 3, which has been i divided into Sub -Division A, B and C; and, ".'h R iS, "here is being constructed, in said Sevier District trunk line sewers at the cost of the City of Paducah, Kentucky, which trunk line servers have now been completed; and, Hi;_EAS, There has been created and established, Server Zone Number Five, in Sub -Division A, Sewer District No. 3, b y an ordinance adopted by the Board of Commissioners.on the 23rd day of February 1923, wherein said 'Lone is described by metes and bounds, and is hereinafter described and a plat of which Zone appears on file, in the office of the City Engineer of the .City of Paducah, Kentucky, and i may be inspected by anyone making application therefor at said office; and, VrHEREAS, Serer Zone Number Five in Sub -Division _Y, Sewer District No. 3, is not provided with sewers and is in a thickly populated territory, and in order to provide adequate sewers for the property owner in said Zone, it is hereby deemed and declared a necessity by the General Council of the City of Paducah, Kentucky, that storm and sanitary sewers be constructed in said Zone in order to provide adequate sewerage for the property owners residing inFZone, NOW, THEREFORE _E 12 R;6OLVED BY THE G;N-ERAL COUNCIL OF ^HE Ci2Y OF E'nDUCAH, KEN'T'UCKY: --SECTION 1. -- That it is hereby declared a necessity by the General Council of the City of Paducah, Kentucky, in order to secure adequate sewerage, and in order to protect the health of the citzens residing in Sewer 'Lone Number Five, Sub -Division A, Sewer District dumber Three, that storm and sanitary severs be constructed and laid out at the cost of the lots or parcels of land benefitted thereby, and all of the lots or parcels of land embraced in said Zone are hereby declared to be. the property benefitted, and subject to be assessed for the cost of con- structing said severs. --SisCTION 2. -- I Said Sewer 'Lone Number Five of Sub -Division _1, of Sevier I District Number Three, in which said sewers are to be constructed is described by metes and bounds as follows, to -wit: "Beginning at the intersection of the center line of 14th Street and Trimble Street; thence southward with the center line of 14th Street 203 feet 3 inches to the center line of an alley; thence eastward with the center line of said alley to the center line of 13th Street; thence northward with the center line of 13th Street 203 feet 3 inches to the center line of Trimble Street; thence eastward with the canter line of Trimble Street to a point 203 feet .3 inches east- ward from the center line of 6th Street; said point being the intersection of the center line of Trimble Street and the center line of an alley which runs south from Trimble St��r�P,� t; thence with the center Line of Trimble Street to the intersection of the center lines of 14th street and Trimble Street, to the point of beginning." --bEC'TION 3. -- Said sewers shall be constructed along and under the following named streets and alleys in Se�!er one ho. 5, in pub-Divisi Sewer District Ido. 3, and the cost of same shall be. apportioned a.ainst all the property in said se,•aer zone as follows: (1) All .the lots or parcels of land bounding or abutting on the hereinafter named streets, alleys or high:,iays along or under which such se:=iers shall be constructed are hereby declared to be 'he property benefitted thereby, and said cost shall be, apportioned and assessed equally against said abut;ting lots of lands according to the abutting feet thereon, provided that the costs of said construction does not exceed ;,2..00 per abutting foot. (2) In the event the cost of construction of said sewer shall exceed 4•2.00 per abutting foot, along said streets, alleys or highways :+hereon said se:,ier shall be constructed, then such co:,ts shall be apportioned against all of the lots of lands in said sewer zone benefitted by said sewer, according to the area in square feet of the lots or lands so benefitted. and which strffts, alleys and highways along which said sewer. ohall be constructed are described as follows, to-wl t: No. 305. On Rushing Street, commencing at the proposed sewer on `_ully Avenue and running thence westwardly on Rushing Street a distance of 354.5 feet from the center line of Tully Avenue. On 14th Street, commencing at the present trunk line sewer on Burnett Street and running thence westwardly on 14th Street, crossing 4u11,y Avenue to a point 370 feet westward from the center line of Tully Avenue, u total distance of ,010 feet. On 14th Street, commencing at the present trunk line sewer on Burnett Street, and running thence east- wardly on 14th Street to the center line of Trimble street, a distance of 211 feet to the center line of Burnett Street. On Tully Avenue, commencing at the proposed sewer on 14th Street and running thence southwardly on Tully Avenue to the center line of Rushing Street, a distance of 395 feet. A an alley lying between 13th and 14th streets and running parallel thereto, commencing at the pro- posed sewer on Faxon Street and running thence west- wardly along the alley, a distance of 370 feet from the center line of Faxon Street. In an alley lying between 13th and 14th Streets and running parallel thereto, commencing at the pro- posed serer on Faxon Street and running thence eas4- wardly alongnthe alley, a distance of 379 feet from the center line of Paxon Street. On 13th atreet, commencing at the proposed sewer on Faxon Street and running thence eastwardly on 13th street, a distance of 440 feet from the east property line of Faxon Street. On 13th Street, commencing at the present trunk line sewer on Burnett Street and running thence:•;est- wardly on 13th Street a distance of 789.6 feet from the center line of Burnett Street. On Trimble Street, commencing at the proposed sewer at the intersection of the center lines of 14th Street and Trimble Streets and running thence eastwardly along Trimble Street to the center line of 13th Street, a distance of 402 feet. In an alley lying between Trimble Street and Bernheim avenue and running parallel thereto,commencing at the proposed sewer on 12th Street and running thence along the alley in a southwestwardly direction to a point 570 feet from the center line of 12th Street. On 12th Street, commencing at the present trunk line sewer on Burnett Street and running thence south- eastwardly on 12th Street crossing Bernheim avenue to point 370 feet southeastward from the center line of Bernheim -venue, a total distance of approximately 695 feet. On 11th Street, commencing at the present trunk line sewer at a point on 11th Stroat 400 fe=t north- westward from the center line of Burnett Street and running thence southeastwardly on 11th Street, crossing Burnett Street and Leech :venue to a point 190 feet southeastward from the center line of Leech "venue, a distance of 1040 feet. All the above described lateral sewer lines,to be constructed 1:11ith six inch house connection service lines extending from the sewer proper to the property lines of all property abutting on the streets or alleys in which the above described sewers are to I be built, in :-.uch manner as to properly serve the property benefitted.
