I'--RrSOLUTTOP7 ZONE NO. 2-- A RESOLUTION DECLARING THi,; CONSTRUCTION OF SANITARY i SEWERS IN SEPJER ZONE NUIdBER TWO, IN SUB -DIVISION B, SE',VER DISTTRICT NUMBER THREE, TO BE . NECESSITY, and,SETTING OUT, IN GENERAL TERMS, THE PROPERTY SUBJECT TO �'HE PAYMENT OF `_'HE CObT OF SAIiE, j ,VHEREAS; There has been created and established in the City of Paducah, Kentucky, Sewer District No. 3, which has been divided into Sub -Division A, B and C; and, '',HEREAS;. There_ is being constructed, in said Sevier Dis- trict, trunk hirie sewers at the cost of the City of Paducah, Kentucky, which trunk line sewers have now been completed; and, :dfEREAS; There has been created and established, Sevier Zone Number Two, in Sub -Division B, Sewer District No. 3, by an II Ordinance adopted b.,r the Board of Commissioners on the, 23rd day of February, 1923, where in said Zone is described by metes and -bounds, and is hereinafter described, and a plat of which Zone appears on file in the office of the City Engineer of the City of Paducah, Kentucky, and may be inspected by anyone making application therefore at said office; and, %r:REAS; Sewer Zone dumber Two, in Sub -Division B, Sewer District No. 3, is not provided with sewers, and is in a thickly populated territory, and in order to provide adequate sewers for the property owners in said Zone, it is hereby deemed and declared a necessity by the General Council of the City of i Paducah, Kentucky, that sanitary sewers be constructed in said Zone in order to provide adequate sewerages for the property owners residing in said 'Lone; NOW, THEREFORE - BE IT,RESOLVED BV THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: --SECTIOPd That it it is hereby declared a necessity by the General Council of the City of Paducah, Kentucky, in order to secure adequate sewerage, and in order to protect the health of the citzens residing in Sevier `Lone Number Two, Sub -Division B, Sewer District Number Three, that sanitary sewers be constructed and laid out at the cost of the lots or parcels of land benefitted thereby, and all of the lots or parcels of land emhraced in said Zone are hereby declared to be the property benefitted, and sub- ject to be assessed for the cost of constructing said sewers. --SECTION 2.-_ Said Sewer 'Lone Number Two of Sub -Division B, of Sewer District Number Three, in which said sewers are to be con - V No. 274 strutted is described by metes and bounds as follows, to -wit: "Beginning at a point in the center line of Jones Street, if extended, and 76 feet and 6 inches east- ward from the center line of 2nd street, if extended, said point being the southeast corner of First Sewer District; thence northward with the boundary line of First Sewer District, and parallel to and 76 feet and 6 inches from the center line of 2nd street, if extended, a distance of 423 feet to the center of Tennessee Street; thence at right angles eastward and with the center line of Tennessee Street and with the boundary of the First Sewer District 93 feet and 2 inches, more or less to the center of the 36 inch trunk line sewer for Sub - Division B, and C, of Sewer District No. 3; thence, deflecting 54 minutes to the right, up the center of said trunk line sewer, as follows; 160 feet, more or less, to a manhole; thence deflecting 7 degrees 50 minutes right, 180 feet; thence deflecting 13 degrees 52 minutes left 233 feet and 6 inches; thence deflec- ting 7 degrees 28 minutes left, 615 feet to a point in Walnut Street, on Island Creek Bank; thence deflec- ting 8 degrees and 05 minutes right, 325 feet; thence deflecting 5 degrees 15 minutes right, 390 feet; thence southwest up the Tennessee River Bank with the center line of said main trunk sewer as follows; From the center line of Washington Street deflecting 115 degrees 10 minutes to the right, 127 feet to a man -hole; (2) In the event the cost of construction of said sewers shall exceed °,2.00 per abutting foot, along said streets, alleys or highways whereon said sewer shall be constructed, then such cost shall be apportioned against all of the lots or lands in said sewer zone, benefitted by said sewer, according to the area in square feet of the lots or lands so benefitted. And which streets alleys and highways along which said sewer shall be constructed are described as follows, to -wit: On 12th Street, commencing at the present trunk sewer line in the southwest corner of the intersection of 12th and Caldwell Streets and running thence north- wardly on 12th Street to a point 340 feet northward - from the center line of Caldwell Street, a total distance of approximately 370 feet. 6n 11th Street, commencing at the present trunk line sewer,on Husbands Street and running thence north- wardly on 11th Street, crossing Caldwell Street, to a point 360 feet northward from the center line of Cald- well Street, a total distance of approximately 770 feet. On 10th Street, commencing at the present trunk line sewer on Husbands street and running thence north- wardly on 10th Street crossing Caldwell Street to a point 350 feet northward from the center line of Caldwell Street, a total distance of approximately 770 feet. On 10th Street, commencing at the present trunk line sewer on Husbands Street and running thence south- wardly on 10th Street, crossing Leech Avenue and Bookman Street to a point in the center line of Elizabeth Street, if extended, a total distance of 1!370 feet from the center line of Husbands Street. I On 9th Street, commencing at the present trunk line sewer On Husbands Street, and running thence north- wardly on 9th Street, corssing Caldwell Street to a point 360 feet northward from the center line of Cald- well Street, a total distance of approximately 763 feet. On 9th Street, commencing at the present trunk line sewer on Husbands Street, and running thence south- wardly on 9th Street crossing Leech Avenue and Bockman Street and Fisher Street to a point 140 feet sotthward from the center line of Fisher Street, a total distance of approximately 1602 feet. On 8th Street, commencing at the present trunk i line sewer on Husbands Street, and running thence north- wardly on 8th Street, crossing Caldwell and Norton Streets to a point 370 feet northward from the center line of Norton Street, a total distance of approximately 1189 feet. On 8th Street, commencing at the present trunk line sewer on Husbands Street, and running thence south- wardly on 8th Street to the center line of Bockman Street, a total distance of 1128. 4 feet On 7th Street, commencing at the presenttrunk line sewer on Husbands Street, and running thence northwardly on 7th Street, crossing Caldwell to a point 330 feet northward from the center line of Caldwell Street, a total distance of approximately 720 feet. On 7th Street, commencing at the present trunk line sewer on Husband Street and ruining thence south- wardly on 7th Street, crossing Murray Street to a point 120 feFt southward from the center line of I3urray Street a total distance of approximately 600 fart. On 6th Street, commencing at the present trunk line sewer on Husbands street and running thence north- wardly, crossing Norton Street to a point 350 feet northward from the center line of Norton, a total dis- tance of approximately 1170 feet. On 6th Street, commencing at the present trunk line sewer on Husbands Street and running thence southward - 1y on 6th Street to the center of I.furray Street, a distance of 680 feet from the center line of Husbands Street to the center line of I.?urray Street. On 6th Street, commencing at the proposed sewer on Elizabeth Street and running thence northwardly on 6th Street, crossing George Street to a point 300 feet northward from the center line of George Street, a total distance of approximately 641.4 feet. On 6th Street, commencing at the proposed sewer on Elizabeth street and running thence southwardly on 6th street, crossing '.!illie and Lc�inley streets, to the center line of 3road Street, a distance of 1181.6 feet. On 5th Street, commencing at the present trunk line sewer on Husbands street and running thence northwardly on 5th street, crossing Caldwell and Norton streets to a point 350 feet northward from the center line of Norton Street, a total distance of approximately 1200 feet. On 5th Street, commencing at the present trunk line sewer pn Husbands street and running thence south- wardly on 5th street, a distance of 590 feet from the center line of Husbands street. On 5th street, commencing at the proposed sewer on Elizabeth street, and running thence northwardly on 5th street, crossing George street to a point 350 feet northward from the center line of George street, a total distance of approximately 691.4 feet. On 5th street, commencing at the proposed sewer on Elizabeth street and running thence southwardly on 5th street to the center line of an alley, which alley lies immediately west of Broad street and runs parallel j thereto, the center line of said alley being 200 feet westward from the center line of Broad Street. In an alley lying between 4th and 5th streets and running parallel thereto, commencing at the present trunk line sewer on Husbands Street and running thence northwardly along the alley, crossing Caldwell and Norton streets to a point 350 feet northward from the center line of Norton street, a total distance of approximately 1190 feet. On 4th street, commencing at the proposed sewer at the center line of George street and r:mning thence southwardly on 4th street, crossing Elizabeth street i and to a point in Broad street 15 feet southward from the center line of Broad Street, a total distance of approximately 777 feet from the center line of George street. In an alley lying between 3rd and pith streets and running parallel thereto, commencing at the present trunk line sewer on Husbands street and running thence northwardly along the alley, crossing Norton street to a point 380 feet northward from the center line of Morton street, a total distance of approximately 1340 feet. I In an alley lying between 3rd and 4th streets and running parallel thereto, commencing at the present trunk line sewer on Husbands Street and running thence south- wardly along the alley, crossing George street to a point 300 feet southward from the center line of George street, a total distance of approximately 1446 feet. On private property, commencing at the end of an ex- isting, sewer, said end of sewer being located at a point 170 feet eastward from the center line of 3rd street and 350 feet southward from the center line of Tennessee street,. running thence southwardly parallel to 3rd street, a dis- tance of 75 feet; the point of beginning of said sevier being 170 feet eastward from the center line of Third street and 350 feet southward from the center line of Tennessee Street, and the end of Said sever being 'at a point 170 feet eastward from the center line of 3rd street and 425 feet southward from the center line of Tennessee street. On private property, commencing at a point, said point being located at a distance of 70 feet northward from the center line of Husbands street, if extended, and 145 feet eastward from the center line of 3rd street, and running thence northwardly across private property parallel to 3rd street and 145 feet eastward from the center line of said 3rd street, a distance of 325 feet; the point of beginning being located 70 feet northward from the center line of Husbands street, if extended, and 145 feet eastward from the center line of 3rd stre6t,and the end of said sewer being,located at a point 395 feet northward from the center line of Husbands street, if extended, and 145 feet eastward from the center line of 3rd street. On Norton street, commencing at the proposed sewer on 5th street and running thence westwardly on 1orton street to a point 135 feet westward from the center line of 5th street. On Norton street, commencing at the proposed sewer in an alley lying betty -en 3rd and 4th street and running para- llel thereto, and running thence westward on Norton street, a distance of 75 feet from the center line of said alley. On Caldwell street, commencing at the proposed sewer in an alley lying between.4th and 5th streets and running parallel thereto and running thence eastward on Caldwell street, a distance of 80 feet eastward from the center line of said alley. On Caldwell street, commencing at the proposed sewer on 5th street and running thence westwardly on Caldwell street, a distance of 135 feet from the center line of 5th street. On Caldwell street, commencing at the proposed sewer on 7th street and running thence westward on Caldwell street, a distance of 215 feet from the center line of 7th street. On Caldwell street, commencing at the proposed sewer on 9th street and running thence eastwardly on Caldwell street a distance of 300 feet from the center line of 9th street. On Caldwell street, commencing at the proposed sewer on 9th street and running thence westwardly on Caldwell street, a distance of 310 feet from the center line of 9th street. On Caldwell street from the present trunk line sewer) on the southwest corner of the intersection of 12th and Caldwell streets and running thence eastwardly on Caldwell street to a point 143 feet eastward from the center line of 12th street, a total distance of approximately 160 feet. In an alley lying between Jones and Norton streets and running parallel thereto, commencing at the proposed sewer on 8th street and running thence eastwardly along the alley to the center line of 7th street, a distance of 406.5 feet from the center line of 8th street. On private property, commencing at a point on the present trunk line sewer along the bank of the Tennesseel river,which point is located at a distance of 380 feet northward from the center line of Husbands street,ex- tended, and 380 feet eastward from the center line of 3rd street and running thence westwardly, parallel to Husbands street, a distance of 212 feet to a point in a proposed sewer 145 feet eastward from the center line of 3rd street. I On Hymarsh -venue, commencing at the proposed sewer on Culley street and running thence southwardly on Hymarsh avenue, a distance of 430 feet southward from the center line of Culley street. Six inch House connection service lines are to be con- structed from the present sewer lines built under the °y600,000 bond issue to the property lines of all abutting property on the following stre,,ts and alleys, in such manner as to properly serve the property benefitted. Notice is hereby given to the owners of all property in Said Lone, and all property bounding or abutting on any of said streets, alleys or highways, that the cost of construction of said sewers will be assessed against such property in the manner hereinabove provided. A blue print or plat showing the boundary of Sewerj Zone No. 2, naming and showing the streets embraced in said Lone, and showing the line and course of the sever to be constructed hereunder, is filed herewith and made a part hereof, marked exhibit "A". Section 6. For additional information of the public and it owners of property in said Lone, a blue print or plat showing the boundary of said sewer zone and showing the streets embraced therein,. and the line and course of the sewer to be constructed hereunder, will be found on file in the office of the City Engineer of the City of Paducah, and may be inspected at any time upon application at said office. Section 7. The resolutions heretofore adopted by the General Council on April 21st, 1923, and October kith, 1924, respectively, or any previous resolution in conflict herewith, are hereby repealed, and this resolution shall take effect and be in force from and after its passage, approval and publication.
