A RESOLUTION DECLARING THE CONSTRUCTION OF SANITARY SEWERS IN SEWER ZONE NUMBER ONE, IN SUB -DIVISION C, 6E4'IER DISTRICT NUMBER THREE, TO BE A NECESSITY, AND SETTING OUT IN GENERAL TERI:IS, THE PROPERTY SUBJECT TO THE PAYMENT OF THE COST OF SA14R. WHEREAS; There has been created and established, in the City of Paducah, Kentucky, Sevier District No. 3, which has been divided into Sub -Divisions A, B and C; and, WHEREAS; There is being constructed in said Sewer District trunk line sewers at the cost of the City of Paducah, Kentuuky, which trunk line sewers have now been completed; and, idHEREAS; There has been created and established i Sewer Zone Number One, in Sub -Division C, Sewer District No. 3, by an Ordinance adopted by the Board of Commissioners on the 23rd day of February, 1923, wherein said Zone is described by metes and bounds, and is hereinafter described, and a plat of which zone appears on files in the office of the City Engineer of the City of I Paducah, Kentucky, and may be inspected by any one making applica- tion therefor at said office; and, ','HEREAS; Sewer Zone Number One, in Sub -Division C, P Sewer District No. 3, is not provided with sewers and is in a I thickly populated territory, and in order to provide adequate i sewe-rsgfti:lhe property owners in said Zone, it is hereby deemed and declared-a•necessity by the General Council of the City of Paducah, Kentucky, that sanitary sewers be constructed in said Zone in order to provide adequate sewerage for the property owners re- siding in said 'Zone; NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY: That it is hereby declared a necessity by the General Council of the City of Paducah, Kentucky, in order to secure adequate sewerage, and in order to protect the health of the citzens residing in Sewer 'Zone Number One, Sub -Division C, Sewer District Number Three, that sanitary sewers be constructed and laid out at the cost of the lots or parcels of land benefitted thereby, and all of the lots or parcels of land embraced in said Zone are hereby declared to be the property benefitted, and subject to be II assessed for the cost of constructing said sewers. --SECTION 2. Said Sewer 'Zone Number one of Sub -Division C, of Sewer District Number three, in which said sewers are to be con- strutted, is described by metes and bounds as follows, to -wit: "Beginning at a point on the center line of Bridge Street 166 feet North of the intersection of said center line with the North property line of Jarrett Street; thence along the bank of Island Creek eastward 169 feet, more or less, to a point on the center line of an alley, said point being 150 feet north of the north property line of Jarrett Street, measured along the center line of said Alley; thence eastward along the bank of Island Creek to a point on the west property line of Jarrett Street 130 feet northward from the center line of Powell Street, if extended; thence northward along said west property,line of Jarrett Street to the north property line of the alley which runs from Clements Street to Jarrett Street on a line with Yeiser Street; thence westward along said north property line of the alley 31 feet; thence northward to the point where the south property line of Short Street intersects the center line of Farley Place; thence north- ward along the center line of Farley Place 78.5 feet; thence at right angles westward 161 feet; thence at right angles northward 42 feet; thence at right angles west- ward 33 feet; thence at right angles northward, parallel to Farley Place, 584.5 feet, more or less to a point 155.5 south of the south property line of Layers Street, said 155.5 feet being measured at right angles to Meyers Street; thence westward, parallel to Meyers Street 270 feet to a point 435 feet from the west property line of Farley Place; thence at right angles north;,jard 415.5 feet,crossing 1a11eyers Street at an angle of 90 degrees, thence at right angles eastward, parallel to and 200 feet north of the north property line of Meyers Street to the east property line of Farley Place, if extended; thence at right angles southward a distance of 4 feet; thence at right angles eastward, parallel to Irieyers Street, to the east prop- erty line of Clements Street, if extended; thence at fight angles southward a distance of 13.5 feet; thence at right angles eastward, parallel to and 200 feet north of the north property line of I'eyers Street to a point -/-�80 feet eastwardly from the east property line of Wood- ward Street if extended; thence at right angles southward 233 feet to the south property line of Meyers Street; thence at right angles eastward with the south prope"rty line of Irieyers Street 60 feet; thence at right angles southward 200 feet; thence at right angles westward, parallel to Meyers Street, 307 feet to a point 133 feet from the east property line of i7oodward Street; thence at right angles southward, parallel to Woodward Street 597 feet to a point 160 feet northward from the north property line of Yeiser Street; thence at right angles eastward, parallel to Yeiser Street, 589 feet to the center line, if extended, of an alley between Hays and Ashcraft Avenue; thence at right angles southward along the center line of said alley to the north property line of Powell Street; thence at right angles eastward along said North property line of Powell Street to a point 175.5 feet Eastward from the center of Ashcraft Avenue, -said 175.5 feet being measured along the north property line of Powell Street; thence at right angles southward ori a line parallel toand 175.5 feet from the center line of Ashcraft Avenue to a point 160 feet eastward from the center line of Bridge Street; said 160 feet being meas- ured at right angles to Bridge Street; thence southward along a line 160 feet from the center line of Bridge street, said line conforming to the turns in Bridge Street, and remaining at all points 160 feet from said center line of Bridge Street, to the line of the cor- porate limits of the City of Paducah, Kentucky; thence southward along the line of the City of Paducah, to the center of Bridge Street, thence northward along the center 200 feet; thence westward at right angles to Bridge Street 160 feet; thence northward along a line, 160 feet from__,���,I� the center line of Bridge Street, and'j- the conforming to the turns of Bridge Street, and remaining at all points 160 feet from said Center line of Bridge Street, to a point 166 feet northward from the north property line of Jarrett Street, if extended,`16 6 feet measured parallel to Bridge Street; thence at right angles east- ward 160 feet to the point of beginning." --AND FU THER1.10 HE -- "Beginning at a point on the east property line of Hill Street, if extended, 200 feet northward from the 1 269. north property line of Meyers Street, said point being on the line of the City Limits of the City of Paducah; thence southward along the said City Limits line and said east property line of Llill Street, to a point 200 feet southward from the south property line of Ideyers Street; thence westward, parallel to and 200 feet from the south property line of Meyers Street to a point 770 feet eastward from the east property line of Woodward Street, said 770 feet being measured parallel to Meyers Street; thence northward parallel to Woodward Street, to a point 200 feet northward from the north property line of 11eyers Street; thence eastward, parallel to and 200 feet from the north property line of Meyers Street, to the point of beginning ." --SECTION 8.__ Said sewers shall be constructed along and under the follow- ing named streets and alleys in Sewer Zone No. 1, in Sub -Division C, Sewer District No. 3, and the cost of same shall be apportioned against all the property in said sewer zone as follows: i (1) All the lots or parcels of land bounding or abutting on the hereinafter named streets, alleys or highways along or under which such sewers shall be constructed are hereby declared to be the property benefitted thereby, and said cost shall be apportioned and assessed equally against said abutting lots or lands according to the abutting feet thereon, provided that the costs of said construction does not exceed ��2.00 per abutting foot. (2) In the event the cost of construction of said sewer shall exceed `;2.00 per abutting foot, along said streets, alleys or highways whereon said sewer shall be constructed, then such cost shall be apportioned against all the lots or lands in said Sewer 'Lone benefitted by said sewer, according to the area in square feet of the lots or lands so benefitted. And which streets, alleys and highways along which said sewer shall be constructed are described as follows; to -wit: On Ashcraft Avenue commencing at the proposed sewer on Bridge Street or the Benton Road, and running thence nobthward on Ashcraft Avenue, crossing Sowell Street to a point 500 feet northward from the south prop erty line of Sowell Street, a total distance of approximately 1225 feet. On Hays Avenue, commencing at the proposed sewer on Bridge Street, or the Benton Road, and running thence northward on Hays Avenue, a distance of 600 feet from the center line of Bridge Street or the Benton Road. On Hays Avenue, commencing at the proposed sewer on Yeiser Street, and running southwardly along Hayes Avenue, crossing Powell Street to a point 450 feet south of the center line of Powell Street a total distance of approximately 925 feet. On Ashbrook Avenue, commencing at the present trunk line sewer on Bridge Street or the Benton Road, and running thence northwardly on Ashbrook Avenue from the center line of Bridge Street or the Benton Road, to the center line of Sowell Street, a distance of approximately 500 feet. Farley Place, commencing at the present trunk line sewer on Iieyers Street, and running thence southwardly on Farley Place, a distance of 770 feet from the center line of Meyers Street. On Jarrett Street commencing at the proposed sewer on Powell Street and running thence northrardly on Jarrett Street, a distance of 494.25 feet from the center line of Powell Street. On Jarrett Street commencing at the proposed sewer on Powell Street and running thence southwardly on Harrett Street, a distance of 342.05 feet from the center line of Powell Street. On Bridge Street, or the Benton Road, commencing at the end of the present trunk line sewer on Bridge Street, or the Benton Road, at the center line of Vasseur Avenue, and running southward along Bridge Street or the Benton Road to the point of intersection of the center line of Bridge Street, or the Benton Road, and Idill Street, a total distance of approximately 2296 feet. On Bridge Street, or the Benton Road, commencing at the present trunk line sewer on Clements Street and running thence northwardly on Bridge Street, or the Benton Road, crossing Kinkead Avenue and crossing Jarrett Street to a point 120 feet north of the center line of Jarrett Street, a total distance of approximately 525 feet. On Powell Street, commencig at the proposed sewer on Ashbrook Avenue and running westwardly on Powell Street, a distance of 300 feet from the center line of Ashbrook Avenue. On Powell Street, commencing at the present trunk line sewer on Clements Street and running thence westwardly on Powell Street, a distance of 321 feet to the center line of Jarrett Street. On Yeiser Street, commencing at the present trunk line sewer on Clements Street, and running thence east- wardly.on Yeiser Street, crossing Woodward Street, Ashbrook Avenue, Cooley Avenue and Hays Avenue to a point 150 feet eastward from the center line of Hays Avenue, a total dis- tance of approximately 1050 feet. ON Short Street, commencing at the present trunk line sewer on Clements Street, and running thence west- wardly on Short Street to a point 36o feet westward from the center line of Clements Street. On Meyers Street, commencing at the end of the present trunk, line sewer on Meyers Street, which point is a40 feet eastward from the center line of Woodward Street and running from this point, (the end of the present trunk line sewer), thence westward along Meyers Street to the center line of Mill Street, a total distance of approx- imately2000 feet; that portion of the sewer on I.teyers Street from a point 440 feet eastward from the center line of Woodward Street to a point 770 feet eastward from the center line of Woodward Street, a distance of 330 feet, being outside 'Lone No. 1, of Sub -Division C, Sewer District No. 3. On Sowell Street, commencing at the proposed sewer on Ashbrook Avenue, and running thence westwardly a distance of 105.65 feet from the center line of Ashbrook Avenue. On Ashbrook Avenue, commencing at the proposed Sewer on Yeiser street, and running thence southwardly on Ashbrook Avenue, crossing Powell Street to a point -500 feet southward from the center line of Powell Street, a total distance of approximately 975 feet. On Woodward Street, commencing at the proposed sewer on Yeiser Street, and running thence northwardly on Woodward Street to a point 250 feet northward from the center line of Yeiser Street. No. 271. II, i On Woodward Street from the present trunk line sewer on Myers Street, and running thence south- wardly on Woodward Street, a distance of 675 feet, from the center line of Meyers Street. i All the above lateral sewer lines are to be con- structed with 6 inch house service lines extending from the sewer proper to the property lines of all j property abutting on the streets or alleys in which the above described lateral sewers are to be built in such manner as to properly serve the property benefitted. Six inch house service lines are to be con- structed from the present sewer lines, -built under the `1.600,000 bond issue,- to the property lines of all abutting property on the following streets or alleys in such manner as to properly serve the property benefitted. r3J On Ideyers Street from apoint 835 feet north- ward from the center line of Farley Place to a point 1 440 feet southward from the center line of 67oodward Street, a total distance of approximately 1600 feet. On Clements Street from the center line of I;leyers Street to the center line of Bridge Street, or the Benton Road, On Bridge Street, or the Benton Road, from the center line of Clements Street, to the center line of Vasseur Avenue. --SEC TIOTd 4. -- Notice is hereby given to the o;rners of all property in said Zone, and all property bounding or abutting on any of said Streets, alleys or highways, that the cost of constructing s said sewer will be a.sessed against such property in the manner here- in above provided. --OECTION 5.-- A blue print or plat showing the boundary of Sewer Zone No. 1, naming and showing the Streets embraced in said Zone, and showing the line and course of the sewer to be constructed �i Whereunder is filed herewith and made a part hereof, marked isxhibit "A". l --SECTION 6.-- For additional information of the public and owners of property in said 'Gone, a blue print or plat showing the 'boundary of said Sewer Zone, and showing the streets eipbraced therein, .:and the line and course of the sewer to be constructed hereunder, will be found on file in the office of the City Engineer of the City of iPaducah, and may he inspected at any time upon application at said office. —SEC'TION 7, -- The resolutions heretofore adopted by�the General Council on April 21st, 1923, and October 16th, 1924, respectively No. 272 I:or any previous resolution in conflict herewith, are hereby repealed, land this resolution sh4lltake effect, and be in force from and after its passage, approval and publication. 1) V ENROLLVIL"- 'T I'LL - BY — — ------ — ------------------- CHAIHM- —.
