I^_ROUT FIRST PAYING THE LICENSE V0,, iiilD PROCii:'ING LICENSE AS PROVIDED HEREIN. BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH, KENTUCKY. SECTION 1. That on and after the first day of January 1925, and on the same day in each succeeding year hereafter, it shall be unlawful for any person, firm, company or corporation to engage in any business, occupation, pro- fession, trade or calling hereinafter mentioned, in the City of Paducah, Kentucky, until such person, firm, company or corporation have first paid the amount of license tax to the City Treasurer and have obtained from her license as hereinafter specified and required; if any such license tax be not so paid and the license procured on or before the first day of February -in each year hereafter, there shall be added to such license tart a penalty of Ten(10) per centum thereof, and any and all such persons, firms, companies or cornorations paying, or offering; to pay such license taxes after same have become delinquent shall also pay said Ten(10) per cent penalty thereon; provided, that such penalty shall not be added to any such license tax where the person, firm, company or corporation so liable for same, shall not be engaged in business, occupation, pro- fession, trade or calling in said City until after the first day of February in the year in which said license tax shall be due and payable. Said license taxes and penalties may be recovered as other delinquent taxes. All such licenses shall have printed or stamped on the fact of same, in large figures, the year for vrhich same are issued, and it shall be the duty of the person procuring or having such license to keep same posted or otherwise exposed in some conspicuous place in his or their place of business, where the same shall at all.times, be within the public view. i No person, firm, company or corporation to whom any license is I issued as herein provided for, shall be authorized to do any business thereunder, other than that specified in such license. SECTION 2. Each license shall state the name of the person, firm, company orcorporation to whom it is issued and no such license shall be assignabl or transferable, nor -shall any such license a,ithorize any person, firm, company or corporation, other than the one mentioned in the license, to do any business; or to follow any occupation, profession, trade or callin other than that provided in such license. SECTION 3. All licenses granted under this ordinance, except as otherwise herein provided shall expire on the 31st day of December of each and every year, and no license, except as otherwise herein provided shall be issued for a less period of time than one month nor for a fractional part of a month, nor for a less fee than One (1) Dollar. No portion of any license tax shall be refunded to any person, firm, company or corporation or to anyone else for their use or benefit. SECTION 4. An advertisement, of any kind by any person, firm, company or corporation, that he, they or i'L, is engaged in any calling, occupation, trade, business or profession, for the carrying on of which a license is required under this ordinance, shall be conclusive evidence of the liability of such person, firm, company or corporation for such license tax as provided in this ordinance. SECTION 5. Every person, firm, company or corporation desiring to procure a license, as herein provided, shall when required, make application in wri ing to the City Treasurer, giving and disclosing the information necessary to enable the City T^ecsurer to detnrmiine the amount of license 'tax to be� paid, the character of business to be conducted, and such other facts as may be necessary or proper to deteri:ine whether the anplican for such license shall be granted the license applied for, and in order to ascertain any facts necessary to determine the amount of license tax to be paid the City Treasurer may require each applicant so applying to furnish isuch information, under oath, as may be re- quired by the City Treasurer. SECTION 6. Upon violation of any provision of this Ordinance by any person firm, company or corporation 'holding a license to engage in an&, business, occupation, profession, trade or calling, as herein pro- vided, such license may be revoked by the General Council. SECTION 7. Each person, firm, company or corporation, carrying on or condo in• any business, trade, occupation, employment or profession, for which a license is required under the nrovisions of this ordinance, or any other ordinance not repealed ,.) this Ordinance, where a fine has.not been provided for, without first having obtained a license to carry on .9n,d rondnct such business, trade, occupation, employment or profession, shall be guilty of a misdemeanor; and upon conviction of the Police Court of the Cit;; of Paducah, ^hall be fined not; less than Five (p5.00) Dollars nor more than Twenty (Sp20.00) Dollars, and each day that such business, trade, occunation, or profes- sion is carried on without such license shall beconsidereda separat offense. ZECTION 8. Every person, firm, company or corporation, before engaging in any business, occunation, profession, trade or calling, hereinafter mentioned and described, shall pay the license tax hereinafter pro- vided, and set opposite the naive of the business, occupation,pro- fession, trade or calling. The business, occupations, professions, trades and callings for w1aich license taxes are required, together with the amount of such license tax, except as otherwi-se specifically set out, are as follows:.. x. This does not include solicitors engaged by Insurance Companies writing indust-,ial insurance in the City of raducah, Ky. Insurance, Fire Insurance Oompany. Every fire insu-ance company doing business in this City shall, on the 31s1; day of December in each year, or within thirty days thereafter, return to the Commissioner of Public Finance for deposit, a statement, under oath, of all premiums received in this City during the year ending on the 31st day of December, and shall, at the same time, pay into the City Treasury, a tax of Two Dollars upon each One Hundred Dollars of said premiums so ascertained, less return premiums allowed on cancelled policies, and any fire company doing also a Tornado, '::ind or Cyclone business, shall include in the statement above referred to, the premiums received for such business, and the same shall be included in the total business and the tax, paid on same, as above set out; provided, ho-.everI that the minimum tax under this Section shall be Ts:enty-Five Dollars. Any company fail- ing or refusing, for thirty days to return the statement required under the oath bf some principal officer or local agent, and to pay the tax herein regizired,.shall forfeit Fifty Dollars for each offense. And the Board of Commissioners may revoke the license of such Company :without notice. Insurance, Yutual or Reciorocal Fire Insurance Companies. Every Reciprocal, L:utual and every other similar kind of insurance company, corporation, firm or associa- tion, exchange or concern writing any insurance in the City of Paducah, Kentucky, and which has received premiums on risks written in said City, shall file a sworn statement, either by the Manager or the President or Secretary of such insurance company, corporation, firm, association, exchange or concern or by the local resident agent thereof, showing the various lines written and declaring the n6t premiums received. Such scorn statement shall bo made withih thirty days after the 31st day of December in each ,year, to the Commissioner of Public Finance of the City of Paducah, Kentucky, and shall at the same time pay into the City Treasury a tax of 4(2.00 upon each ;;100.00 of said premiums so ascertained less returned premiums r allowed on cancelled policies. The tem premium as used herein shall include all payments in whatever form collected or paid, made or received for any character of insurance or similar protection named in this Ordinance. The minimum tax under this Ordinanue shall be ?25.00. Any Reciprocal, Mutual Company, Corporation, Firm, Association, Exchange or Concern failing; or refusing for thirty days to return the statement required to be filed as set out herein and failing to pay the 'tax required herein, shall forfeit x„50.00 for each and every offense and the Board of Commissioners may revoke the license of such company, corporation, firm, association, exhhange or concern, without notice. N0. 242. Insurance, Lutual or Reciprocal Indemnity Companies 50.00 It shall be the duty of each Reciprocal, ISutial or Indemnity Company, firm or corporation, which has received on risks in the ''ity of Paducah, _premiums Kentucky, to file a sworn statement by the Liana er Livery and Feed Stable or President or .Secretary of such company, corporation, 20.00 firm, association, exchange or coiecrn or by the local resident agent thereof, showing the various lines Lumber `card or Planing; ';fill .vritten and setting; out the net Premiums .received; such 50.00 sworn statement shall be made within thirty days after streets or sidewalks the 31st day of December in each ,year to the Commissioner (No license shall be construed of Public Finance of the City of Paducah, Kentucky, and such statement shall be accompanied by the tax to conduct his stand of X550.00. The term premium as used herein shall on any particular street include all payments in .ahatever form collected, paid or received. Any company, corporation, firm or be under the strict association, exchange or concern failing• or refusing supervision of the Police for thirty days to return the statement required under oath as set out herein, and pay said license, shall to place by order of forfeit 050.00, and the Board of Commissioners may said Department or the General revoke the license of such company without notice. No license herein provided for shall authorize or entitle any holder hereof to conduct any business, or to engage in any occupation, profession, trade or calling, in any manner or at any time, in violation of any ordinance of the City of Paducah, or of any law of the State of Kentucky, or of the United 6tates. SECTION 11. If any person, firm, company or corporation shall misrepresent any material fact as to the nature of business in his application foil, such license, or any other fact necessary or proper to determine 'the' amount of the license tax to be charged or paid, such license so procured by reason of such raisrepresenthtion may be revoked by the General Council at any time. SECTION 12. All moneys derived from license taxes under the provisions ofi this Ordinance shall be paid to the City Treasurer, and by her placed to the credit of tl:e General Revenue Fund of the City of Paducah, I and shall be used and expended in defraying the current and incidental expenses of said. Should any section, or part of section, or any provision of this Ordinance ve declared by the Courts, for any reason, to be invalid, such -decision shall not affect the validity of this Ordinance as a whole, or any part thereof, other than.the'particular section or provision of the Ordinance so held or declared to be invalid. SrUTION 14. All Ordinances and parts of ordinances which have been heretofore adopted in conflict herewith, are, to the extent of such conflict hereby repealed, but this Ordinance shall not be construed as repeating any provision or provisions for licenses or license fees or license taxes contained in any other existing ordinance or ordinances of the City of Paducah, or providing for any license or the payment of any. license fee on any business, trade, profession, or occupation not herein' specifically provided for. 2LCTION 15.
