HomeMy WebLinkAboutOrdinances Book 8, Page 208, No Ordinance NumberAN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES OF ROCK ALLEY '.'FEICH RUNS FROM JEFFERSON STREET T09JARDS BROAD,7AY STREET, BETPIEEN 3RD AND 4TH STREETS, IN THE CITY OF PADUCAII, KENTUCKY, THE Sum OF $1.9885 k,ER FOOT OF ABUTTING PROFS RTY FOR THE CONSTRUCTION OF SAID ALLEY WITH CONCRETE; TOGETHER ;'LITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS AND SMTER PIPE CONNECTIONS AS SHOWN BY THE CITY ENGINEER'S ESTIIaATE OF SAME, AND PROVIDING THAT SAID ESTIM:: TE '4AY BE PAID IN TEN ANNUAL INSTALLMENTS, BEING ONE EACH YEAR FOR A PERIOD OF TEN YEARS. I'MEREAS, the General Council of the City of Paducah, Kentucky, has heretofore, to -wit: on July 28th, 1924, adopted an ordinance entitled "An ordinance for the construction of concrete of Rock Alley, together with all necessary manholes, intakes, catch basins and sewer pipe connections, in the city of Paducah, Kentucky, in accordance with the plans and specifications provided therefor by the City Engineer, at the cost of the abutting property owners, and providing that the cost of same may be paid under the ten year payment plan; and, WHEREAS, in accordance with said ordinance it was provided that the cost of construction of said alley be paid for by the abutting property owners; and, ':IHEREAS, pursuant to said ordinance contract was entered into on the 5th day of September 1924, between Yancey & Johnson of Paducah, Kentucky, and said City for the construction thereof; andl l'MEREAS, said contract has been completed and duly accepted by the City of Paducah, on the 20th day of October, 1924, pursuant to recommendation made therefor by the Board of Public %7orks of said City; NOVI, THEREFORE, BE IT ORDAINED BY THE GENER_'.i COUNCIL OF THE CITY OF PADUCAH, KENTUCKY. SECTION 1, That all of the propertyx on both sides of Rock Alley, which runs from Jefferson Street towards Broadway between 3rd and 4th Streets/ commencing on the south fine of Jefferson Street and running in a uniform width of 16 feet and 6 inches towards Broadway Street, a distance of 173 feet and 3 inches; thence in a straight line towards Broadway Street 20 feet; thence at right angles and towards 4th Street 38 feet and 3 inches; thence at right angles and towards Jefferson Street 20 feet; thence at right angles and towards 3rd Street 21 feet and 9 inches , to i the west line of said alley, in the City of Paducah, Kentucky, as shown by the City Engineerts estimate of the cost of same, be and the same is hereby assessed for the cost of construction with concrete of said alley,' together with.:alh, 0 6_1 esariy:iWNbles, intakes, catch basins and sewer pipe connectioh. d,,..the...awa-af 07:9885 per front or abtitting foot of said property, as particularly shown by the estimate of such cost in the office of the City Engineer, now referred to and made part hereof. NO. 209. SECTION 2. That the funds derived from the assessment of said property shall be used for the purpose of paying off the special tax bills issued against such property, or such bonds as may be issued by the City of Paducah, Kentucky, pursuant to Section 3101, Kentucky Statutes. SECTION 3. That pursuant to Section 3101, Kentucky Statutes, said tax assessment, may at the option of the property owners, be payable in cash without interest within thirty days from date of Passage and publication of this ordinance, or in ten annual installments, provided that the property owners shall before the expiration of said thirty days enter into an agreement in writing with said City in accordance with the provisions of Section 3101 of the Kentucky Statutes. SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessment herein provided for, which spay be paid on the installment plan as hereinbefore provided, the City aay issue and sell improvement bonds and to secure the payment of such bonds there is hereby pledged such taxes and liens on the property assessed 'herein for the payment of the principal and interest, but such bonds shall not be sold for less than par and the proceeds derived therefrom shall be applied exclusively to the payment of the cost of said construction as hereinbefore provided; and such bonds, jj if issued, shall bear interest and be payable in accordance with the II provisions of 3101, Kentucky Statutes as amended by Act/ of 1910.
