WHEREAS, The Board of Commissioners of Paducah, _:entucky, adopted an ordinance old February 23rd 1923, dividing part of pub-Livision -a D and C. in Sewer iiistrict i4o. 3, into five sewer zones for t1m pur- pose of constructing sewers therein, so as to provide adequate sewers for the property owners within said zones; and, 71HEREAS, ince the adoption of the aforesaid ordinance the City. of Paducah has by a vote abandore d the Commission corm of "overnment, and has returned to the old form of ildermanic Government, and by the express provisions of the law the acts, ordinances and laws, enacted under either form of government remain in force under the succeeding form of said gov- ernment ; and, "dMREAS, the General Council of said city has adopted a resolu- tion declaring the construction of such sewers in said sewer -one i4o. 4, to be a necessity: NOW, THEREFORE: BE IT ORDAINED BY 'DIE GENHRAL COUNCIL OF THE CITY OF PADUCAH, ENTUCI•Y. C, Alley or private property between Broadway and Jefferson Street and running parallel thereto from the existing trunk line sewer at 19th Street'to.23rd Street. t Alley between Jefferson and Monroe Streets and running parallel thereto from the existing trunk line sewer at 19th -Street to 25th Street the present City Limits. � All the above described lateral sewer lines are to be con- structed with 6 inch house connection service lines extending from the sewer proper to the property lines of all property abutting on the streets or alleys in which it is proposed to construct the above described lateral sewers in such manner as to properly serve the property benefitted. Six inch house connection service lines are to be constructed from the present sewer lines ( built under the ${600,000 bond issue) to the property lines of all abutting property on the following streets or alleys, in such manner as to properly serve the property benefitted. Clay Street from 15th Street westward to a point about -� 447 feet westward from 19th Street. Across private property from a point on Clay Street about 447 feet westward from 19th Street, thence northward to a point on the Hinkleville Road, a distance of 315 feet, said point being about 30 feet westward from the center line of 20th Street. Hinkleville Road from a point about 30 feet westward from the center line of 20th Street westward to 24th Street. 19th Street from Clay Street southward to Jackson Street. Gl 15th Street from the intersection of Trimble, Burnett and 15th Street southward to Clay Street. SECTION 2. The cost of constructing said sewers shall be apportioned equally against the abutting lots or parcels of land, according to the number of feet abutting thereon, and shall be paid for by the owners of said lots or parcels of land abutting or bounding upon such streets, alleys and highways, provided the cost of same does not exceed $2.00 per abutting foot. In the event the cost of said improvement shall exceed the sum of $2.001 per abutting foot, then all the lots or parcels of ground in said zone are hereby declared to be the property benefitted, and the entire cost of the construction of said sewers shall be assessed against each of said lots or parcels of ground embraced in said zone in the proportion that the area in square feet of such lots, or parcels of ground shall bear to the area in square feet of i all of the lots or parcels of ground located in said zone; and the Genera; Council shall fix and assess the amount of tax to be levied upon each of said lots or parcels of ground in said' zone as required by law. NO. 196. SECTION 3. The lots or parcels of ground which are hereby declared to be benefitted by the construction of said sewer, and subject to the payment of the cost of same, are located in said Zone IVo. 4, which is particularly described in the ordinance establishing said Sewer Zone No. 4 adopted by the Board of Commissioners of said City on the 23rd day of February 1923, and also particularly described in the resolution declaring said sewer to be a necessity, adopted by the General Council of said City on October 6, 1924, and particularly described as follows: "Beginning at a point, the intersection of the center line of 13th Street and the center line of an alley parallel to and 203 feet 3 inches southward from Trimble Street, said point being on the boundary of Sevier District No. 2; thence southward With the boundary of sewer distret Ido. 2 along the center line of 13th Street, to a point 206 feet 3 inches northward from the center line of Broadway; thence at right angles westward, continuing along the boundary of sewer district No. 2, parallel to and 206 feet 3 inches northwardly from the center line of Broadway, to the center line of 16th Street; thence at right angles southward with the boundary of sewer District 110. 2, 206 feet I 3 inches to the center line of Broadway; he at right angles westward with the boundaryto£nce Sewer District No. 2 along the center line of Broadway* to a point on the west line, if extended, of property of Tars. Rosena W. SECTION 4. Said wewer shall be constructed in strict accordance with the plans, grades, siSealfl'cAtiont`and profiles as prepared and furnished by the City Engineer oi' said city of Paducah, and adopted by the General Coun- cil of said city. SECTION 5. Bids shall be received for the conbtruction of said sewers accord- ing to the plans, specifications and profile, and contract therefor shall be awarded to the lowest and best bidder, except the right is ex- pressly reserved to reject any and all bids, within the discretion of th General Council, and it may accept any bid which appears to be for the best interest of the city of Paducah. SECTION 6. The -board of rublic Works of said city is hereby authorized and directed to advertise for bids for the construction of said sewers, and aaid Board shall report the bids received by it, with its recommendation for the acceptance of any of same or the rejection of all of same. SECTION 7. Said work shall be constructed under the direction and supervisio) of the City Engineer and the Board of rublic 'Yorks of said city, or thei: authorized agents, and the same shall commence and be completed at a timl designated by contract. j SECTION 8. The contractor awarded the contract for the work herein provided shall be paid only from the funds arising from special tax bills or as- No. �1$Pj . . sessment made against the property located in said sewer zone, except that said contractor may be paid out of such bonds as may be issued according to law, and as provided in sections 3101, 3102 and 3105, Kentucky statutes. SECTION 9.
