AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SANITARY SEl4ERS IN SEWER ZONE N0. 1, SUB -DIVISION C, SEINER DISTRICT NO. 3, IN THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE PROPERTY OVJNERS THEREIN, AND PROVIDING THAT SAID SEWER SHALL BE CONSTRUCTED UPON THE 10 YEAR PAYMENT PLAN, AND NAI,IING THE STREETSAND ALLEYS ALONG, UNDER AND THROUGH WHICH SAID SEWERS' SHALL BE CONSTRUCTED, AND SETTING OUT IN GENERAL TERMS, THE PROPERTY BENEFITTED THEREBY AND SUBJECT TO PAYMENT OF THE COST OF SAME. i WHEREAS, The Board of Commissioners of Paducah, Kentucky, adopted an ordinance on February 23rd, 1923, dividing part of Sub -Divisions A, B and C, in Sevier District No. 3, into five sewer zones for the purpose of constructing sewers therein, so as to i Provide adequate sewers for the property owners within said zones; and, I'll.' REAS, -Since the adoption of the af6resaid ordinances the City of Paducah has by a vote abandoned the Commission Form of Government, and has returned to the old form of Aldermanic Government, and by the express provisions of the law the acts, ordinances and laws, enacted under either form of government remains in force under the succeeding form of said government; and, I WHEREAS, the General Council of said City has adopted a resolution declaring the construction of such sewers in said Sewer Zone No. 1 to be a necessity; NOlI, THEREFORE, BE IT ORDAINED BY THE GENERAL COUNCIL OF THE CITY OF PADUCAH; KENTUCKY: SECTION 1. That sanitary sewers be constructed in, under and along the streets, alleys and highways, in Sewer 'Lone No. 1, in Sub - Division C, Sewer District No. 3, in the City of Paducah, Kentucky, as follows, to -wit: Ashcraft Avenue, from the Benton Roard pr JI, Bridge Street, northwardly to a -point near, Powell Street, a distance of 1125 feet. s. Fo. 172. Hays Avenue, from the Benton Road or Bridge Street, northwardly, to a point near Sowell Street, a distance of 590 feet. Hays Avenue from Yeiser Htreet southwardly to a point near Sowell Street, a distance of 925 feet. Ashbroo'p, Avenue from the Benton Road, or Bridge Street northwardly to Sowell Street, a distance of 494.36 feet. Farley Place from Meyers Street, southwardly towards Short Street, a distance of 770 feet. Jarrett Street from Powell Street, northwardly to a point near Yeiser Street, if extended, a distance of 494.25 feet. Jarrett Street from Powell Street southwardly a distance of 342.05 feet. Bridge Street from Vassuer Avenue to the City Limits at Mill Street a distance of 2296.5 feet. Bridge Street from Clements Street northward, a,distance of 525 feet. Powell Street from Ashbrook Avenue, westwardly a distance of 292.5 feet. Powell Street from Clements Street, westwardly to Jarrett Street, a distance of 321 feet. Yeiser Street from Clements Street, eastwardly to a point between Hays Avenue and Ashcraft Avenue a distance of 1050 feet. Short Street, from Clements Street westwardly to a point near Farley Blace a distance of 350 feet. Meyers Street, a point about 770 feet easterly from Woodward Street to the City Limits at Mill Street, a distance of 2000 feet. Sowell Street from Ashbrook Avenue westerly 105.65 feet. Ashbrook Avenue from Yeiser Street southwardly to a point near Sowell Street, a distance of 975 feet. Woodward Street from Yeiser Street northwardly, a distance of 230 feet. Woodward Street from Meyers Street southwardly, a distance of 675 feet. All the above described lateral sewer lines are to be constructed with 6 inch house connection service lines, from the sewer proper to the property lines of all property abutting on the streets or alleys in which the above described lateral sewers are to be built, in such manner as to properly serve the property benefitted r+.rrWOO." 110. 272. • Six inch house connection service li4es afe to be con- structed from the present sewer lines, (built under the yp600,000 Bond Issue), to bhe property lines of ull abutting property on the following streets or alleys in such manner as to properly serve the property benefitted. Meyers Str(-et from a point 435 feet northwardly from Farley Place to a point 440 feet southwardly from Woodward Street. Clements Street frpm i,!eyers Street to Bridge Street, or the Benton Road. �t Bridge Street, or the Benton Road, from Clements Street to Vasseur Avenue. SECTION 2. The cost of constructing said sewers shall be apportioned equally against the abutting lots or parcels of land, according to the number of feet abutting thereon, and shall be paid £or• by the owners of said lots or parcels of land abutting or bounding upon such streets, alleys and highways, provided the cost of ame does not; exceed $2.00 per abutting foot. In the event the cost of said improvement shall exceed the sum of $2.00 per abutting foot,.then all the lots or parcels of ground in sadd zone are hereby declared to be the property benefitted, and the entire cost of the construction of said sewers shall be assessed against each of said lots or parcels I of ground embraced in said zone in the proportion that the area in square feet of such lots or parcels of ground shall bear to the area in square feet of all of the lots or parcels of ground located in said zone; and the Genera? Council shall fix end assess the amount of tax to be levied upon each of said lots or parcels of ground in said zone as required by law. SECTION 3. The lots or parcels of ground which are hereby declared to be benefitted by the construdtion of said sewer, and subject to the payment of the cost of same, are located in said Zone No. 1 which is particularly described in the ordinance establishing said Sewer Zone No. 1, adopted by the Board of Commissioners of said City on the I 23rd day of February 1923, and also particularly described in the resolution declaring said sewer to be a necessity, adopted by the General Council of said City on October the 6th, 1924, and particularly described as follows: "Beginning at a point on the center line of Bridge Street 166 feet north of the intersection of said center line with the north property line of Jarrett Street; thence along the bank of Island Creek eastward 169 feetrp more or less, to a point off the center line of an alley, said point being 150 feet north of the north property line of Jarrett Street, measured along the center line of said alley; thence eastward along the Bank of Island Creek to a point on the west property line of Jarrett Street 130 feet northward from the center line of Powell Street, if extended; thence northward along said west property line of Jarrett Street to the north property line of the alley which runs from Clements Street to Jarrett Street on a line with Yeiser Street; thence westwgrd along said north property line of the alley 31 feet; thence north- ward to the point where the south property line of Short Street intersects the center line of Farley Place; thence northward along the center line of Farley Place 78.5 feet; thence at right angles westward 161 feet; thence at right angles northward 42 feet] thence at right angles westward 33 feet; thence at right angles northward, parallel to Farley Place, 584.5 feet, more or less, to a point 155.5 feet south of the south property line of P,teyers Street, said 155.5 feet being measured at right angles to Meyers Street; thence westward, parallel to Meyers Street, 270 feet to a point 435 feet from the west property line of Farley Place; thence at right angles northward 415.5 feet, crossing U4eyers Street at an angle/ of 90 degrees; thence at right angles eastward, parallel to and 200 feet north of the north property line of i4eyers Street to the east Property line of Farley Place, if extended; thence at right angles southward a distance of 4 feet; thence at right angles eastward, parallel to Meyers Street to the east property line of Clements Street, if extended; thence at right angles southward a distance of 13.5 feet; thence at right angles eastward, parallel to and 200 feet north of the north property line of Meyers Street to a point 380 feet eastwardly from the east property line of "doodward Street, if extended; thence at right aggles southward 233 feet to the south property line of Meyers Street; thence at right angles eastward with the south property line of I4eyers Street 60 feet; thence at right angles southward 200 feet; thence at right angles westward, parallel to I4eyers Street, 307 feet to a point 133 feet from the east property line of Woodwa Street; thence at right angles southward, parallel to Woodward Street 597 feet to a point 160 feet northward from the north property line of Yeiser Street; thence at right angles eastward, parallel to Yeiser Street 589 feet to the center line, if extended, of an alley between Hays and Ashcr f Avenues; thence at right angles southward along the center line of said alley to the north property line of Powell Street; thence at right angles eastward along said north property line of Powell Street to a point 175.5 feet eastwar from the center line of Ashcraft 'venue, said 175.5 feet being measured along the north property line of Powell Street; thence at right angles southward on a line parallel to and 175.5 feet from the center line of Ashcraft Avenue to a poin 160 feet eastward from the center line of Bridge Street, sai 160 feet being measured at right angles to Bridge Street; thence southward along a line 160 feet from the center line of Bridge Street, said line conforming to the turns in Bridge Street, and remaining at all points 160 feet from said center line of Bridge Street, to the line of the corporate limite of the City of Paducah; thence southward along the line of the City of Paducah, to the center line of Bridge Street; thence northward, along the center line of Bridge Street, 200 feet; thence westward at right an -les to Bridge Street 160 feet; thence northward along a line 160 feet from the center line of Bridge Street, said line conforming to the turns of Bridge Street and remaining at all points 160 feet from said center line of Bridge Street, to a point 166 feet northward from the north property line of Jarrett Streetip if, extended, said 166 feet measured parallel to Bridge Street; thence at right angles eastward 160 feet to the point of beginning." AND FURTHERMORE . "Beginning at a point on the east property line of Mill Street, if extended, 200 feet northward from the north property line of Ideyers Street, said point being mn the line of the City Limits of the City of Paducah; thence southward along the City Limits line and said east property line of Mill Street, to a point 200 feet southward from the South property line of Meyers Street; thence ;westward, parallel to and 200 feet from the south property line of Meyers Street to a point 770 feet eastward from the east property line of 'tloodward:Street, said 770 feet being measured parallel to Meyers Street; thence northward, parallel to Woodward Street, to a point 200 feet northward from the north property line of Meyers Street; thence eastward, parallel to and 200 feet from the north property line of Irle,yers Street, to the point of beginning." SECTION 4. Said sewer shall be constructed in strict accordance with the plans, grades, specifications and profiles as prepared and furnished by the City Engineer of said City of Paducah, and adopted by the General Council of said City. SECTION 5. Bids shall be received for the construction of said sewers according to the plans, specifications and profile, and contract therefor shall be awarded to the lowest and best bidder, except the right is expressly reserved to reject any and all bids, within the discretion of the General Council, and it may accept any bid which appears to be for the best interest of the City of Paducah. SECTION 6. The Board of Public Works of said city is hereby authorized and directed to advertise for bids for the construction of said sewers, and said Board shall report the bids received by it, with its re- commendation for the acceptance of any of same or the rejection of all of same. SECTION 7. Said work shall be constructed under the direction and supervision of the City Engineer and the Board of Public Works of said City, or their authorized agents, and the same shall commence NO. 176. K9. 176. and be completed at a time designated by contract. SECTION B. i The contractor awarded the contract for the work herein provided, shall be paid only from the funds arising from special tax bills of assessments made against the property located in said Sewer Zone, except that said contractor may be paid out of such bonds as may be issued according to law, and as provided in Sections 3101, 3102 and 3105 Kentucky Statutes.
