AN ORDINANCE: FIXING AND REGULATING TIE LICENSE TAXES, APED MANNER AND FORM OF GRANTING AND ISSUING SAME ON TIP, VARIOUS LINES OF BUSINESSES, OCCUPATIONS, PROFESSIONS, TRADES AND CALLINGS IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING PENALTIES FOR NON-PAYK:r]NT THEREOF AND FOR VIOLA- TION THEREOF, AND MAKING IT UNLAWFUL TO ENGAGE IN ANY SUCH LINES OF BUSINESS, OCCUPATIONS, PROFESSIONS, TRADES AND CALLINGS i'IITHOUT FIRST PAYING THE LICENSE TAX AND PROCURING LICENSES AS PROVIDED HER.^.^^.IN. BE IT ORDAINED BY THE BOARD OF COITIISSION I?S OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. That on and after the first da;T of January, 1923, and on the same day in each succeeding year hereafter, it shall be unlewful for any I itperson, firm, company or corporation to engage in any business, occupa- tion, profession, trade or calling hereinafter mentioned, in the City of Paducah, Kentucky, until such person, firm, company or corporation have first paid the amount of license tax to the Commissioner of Public Finance, and have obtained from him license as hereinafter specified and required; I iiif any such license tax be not so paid and the license procured on or before the first day of February in each year hereafter, there shall be added to such license tax a pen"lty of Ten (10) Per Centum thereof, and I. any and all such persons, firms, companies or corporations paying, or ii offering to pay such license taxes, after same have become delinquent, Ii i shall also pay said Ten (10) Per Cent penalty thereon; provided, that such penalty shall not be added to sny such license tax where the person, firm, company or corporation, so lirble for same, shall not be engaged in business, occupation, profession, trade or calling in said City until after the first day of February in the year in which said license tax shall be due and payable. Said license taxes and penalties may be recov- ered as other delinquent taxes. All such licenses shall have printed or stamped on the face of same, in large fiF_.ures, the year for which same are issued, and it shall be the duty of the person procuring or having such license to keep same posted or otherwise exposed in some conspicuous place in his or their place of business, where the same shall, at all times, be within the pub - lie view. I! i! No person, firm, company or corporation to whom any license is issued, as herein provided for, shall be authorized to do any business thereunder, other than that specified in such license. SECTION 2. Each license shall state the name of the person, firm, company or corporation to whom it is issued, and no such license shall be assign- No._gFl Ordinance No. able or transferable, nor shall any such license authorize any person, firm, company or corporation, other than the one mentioned in the license, to do any business, or to follow any occupation, profession, trade or calling, other than that provided in such license. SECTION 3. All licenses granted under this ordinance, except as otherwise herein provided, shall expire on the .31st day of December of each and every year, and no license, except as otherwise herein provided, shall be issued for a less period of time than one month, nor for a fractional part of a month, nor for a less fee than One (1) Dollar. No portion of any license tax shall be refunded to any person, firm, company, or cor- poration, or to anyone else for their use or benefit. SECTION 4. An advertisement of any kind by any person, firm, company or corporation, that he, they or it, is engaged in any calling, occupation, trade, business or profession,, for the carrying on of which a license is required under this Ordinance, shall be conclusive evidence of the lia- bility of such person, firm, company or corporation for such license tax as provided in this Ordinance. SECTION 5. 'very person., firm, company or corporation desiring to procure a 'license, as herein provided, shall, when required, make application, in writing, to the Commissioner of Public Finance, giving and disclosing the information necessary to enable the Commissioner of Public Finance to determine the amount of license tax to be paid, the character of bus- iness to be conducted, and such other facts as may be necessary or pro- per to determine whether the applicent for such license shall be granted the license applied for, and in order to ascertain any facts necessary to determine the amount of license tax to be paid, the Commissioner of !Public Finance may require e�!ch applicant, so applying, to furnish such information, under oath, as may be required by the Commissioner of Publi Finance. SECTION 6. Upon violation of any provision of this Ordinance by any person, firm, company or corporation holding a license to engage in any business, occupation, profession, trade or calling, as herein provided, such license may be revoked by the Board of Commissioners. Each person, firm, company or corporation, carrying on or con- ducting any business, trade, occupation, employment or profession, for which a license is required under the provisions of this Ordinance, or any! other ordinance not repealed by this Ordinance, where a fine has not been provided for, without first having obtained a license to carry on and conduct such business, trade, occupation, employment or profession, shall be guilty of a misdemeanor; and, upon conviction in the Police Court of i the City of Paducah, shall be fined not less than Five ($5.00) Dollars nor more than One Hundred (+;100.00) Dollars, and each day that such busi- ness, trade, occupation, employment or profession is carried on without such license shall be considered a separate offense. SECTION 8. Every persoi, firm, company or corporation, before engaging in any business, occupr,tion, profession, trade or calling, hereinafter men- tioned and described, shall pay the license tax hereinafter provided, and I set opposite the name of the business, occupation, profession, trade or calling. The businesses, occupations, professions, trades and callings for which license taxes are required, together with the amount of such license tax, except as otherwise specifically set out, are as follows: A. This does riot include solicitors engaged by Insurance Companies writ- ing industrial insurance in the City of Paducah, Kentucky. Insurance, Fire Insurance Company. Ordinance No. Iall premiums received in this City during the year ending on the 131st day of December, and shall, at the same time, pay into the City 'Treasury a tax of Two Dollars upon each One Hundred Dollars of said ,premiums so ascertained, less return premiums allowed on cancelled policies, and any fire company doing also a Tornado, Wind or Cyclone business, shall include in the statement above referred to, the premiums received for such business, and the same shall be included i�in the total business and the tax paid on same, as above set out; provided, however, that the minimum tax under this Section shall be Twenty -Five Dollars. any company failing or refusing, for thirty days, to return the statement required under the oath of some 1principal officer or local agent, and to pay the tax herein re- quired, shall forfeit Fifty Dollars for each offense. And the Board of Commissioners may revoke the license of such Company u without notice. INSURANCE, P,?utual or Reciprocal Fire Insurance Companies. Every Reciprocal, Mutual and every other similar kir_d of insurance comp any, corporation, firm or association, exchange or concern writing any insurance in the City of Paducah, Kentucky, and which has received premiums on risks written in said City, shall file a sworn statement, either by the manager or the president or secretary of such insurance company, corporation, firm, association, exchange or concern or by the local resident anent thereof showing the various lines written and declaring the net premiums received, Such sown statement shall be made within thirty days after the 31st day of December in each year, to the Commissioner of Public Finance of the City of Paducah, Kentucky, and shall at the same time pay into the City Treasury a tax of $2.00 upon each $100.00 of said premiums so ascertained less returned premiums allowed on cancelled policies. The term premium as used herein shall include all payments in whatever form collected or paid, made or received for any character of insurance or similar protection named in this Ordinance. The minimum tax under this Ordinance shall be $25.00. Any Reciprocal, Mutual Company, Corporation, Firm, Association, Exchange or Concern failing or refusing for thirty days to return the statement required to be filed as set out herein end failing to pay the tax required herein, shall forfeit $50.00 for each and every offense and the Board of Commissioners may revoke the license of such company, corporation, firm, association, exchange or concern, without notice. INSURANCE, Mutual or Reciprocal Indemnity Compenies .................$50.00 It shall be the d,fty of each Reciprocal, Mutual or Indemnity Company, firm or corporation, which has received premiums on risks in the City of Paducah, Kentucky, to file a s:rorn st atement by the 1.7annger or President or Secretary of such Company, corporation, firm, association, exchange or concern or by the local resident agent thereof, showing the various lines written and setting out the net premiums received; such sworn statement shall be made within thirty days after the 31st day of December in each year to the Commissioner of Public Finance of the City of Paducah, Kentucky,and such statement shall be accompanied by the tax of 0.00. The term premium as used herein shall include all payments in whatever form collected, paid or received. Any company, corporation, firm or association, exchange or concern failing or refusing for thirty days to return the statement required under oath as set out herein and pay said.license, shall forfeit $50.00, and the Board of Commissioners may revoke the license of such company -.aithotit notice. SECTION 9. It shall be the duty of each person, firm, company or corporation, owning any dog or dogs, after paying the license tax herein required, to apply to the Commissioner of Public Finance for a numbered Dog Tag, which tag shall be placed upon a dollar or otherwise securely fastened about the' neck of such dog or dogs. SECTION 10. I?o license herein provided for shall authorize or entitle any holder hereof to conduct any business, or to en Page in any occupation, profession, trade or calling, in any manner or at any time, in violation of any ordinance of the City of Paducah, or of any law of the State of £entucky or of the United States. SECTION' 11. I£ any person, firm, company or corporation shall misrepresent any .,i material fact as to the nature of busir:ess in his application for such license, or any other fact necessary or proper to determine the amount of the license tax to be charged or paid, such license so procured by reason of such misrepresentation may be revoked bar the Board of Commissioners at any time. SECTION 12. All moneys derived from license taxes under the provisions of this Ordinance shall be paid to the Commissioner of Public Finance, and b,� him placed to the credit of the General Revenue Fund of the City of Paducah, and shall be used and expended in defraying the current and incidental expenses of said City. SECTION 13. Should any section, or part of section, or any provision of this Ordinance be declared by the Corm st, for any reason, to be invalid, such decision shall not affect the validity of this Ordinance as a whole, or any xart thereof, other than the particular section or provision of the Ordinance so held cr declared to be invalid. SECT ION 14. All ordinances and parts of ordinance which have been heretofore adopted, in conflict herewith, are, to the extent of such conflict, hereby) repealed, but this Ordinance shall not be construed as repealing any pro- vision or provisions for licenses or license fees or license taxes con- tained in any other existing ordinance or ordinances of the City of Paducah, or providing for any license or the payment of any license fee on'.
