That the alley in Block #10 Addition "A" Old Town City of Paducah, Kentucky, beginning at the North property line of Kentucky Avenue, be- tureen the property of the E. G. Boone Estate and the property of Frank H. Jones, and running ins Nartherly direction 173 feet 3 inches to the pro- perty belonging to I:attie C. Hale; thence at right an7les to the :lest property lire of Second Street, in the City of Paducah, Kentucky, be, and the same is hereby ordered to be constructed; that said alley shall be constructed with concrete, or any other improved paving material as may be, determined by the Board of Commissioners as the best and most economical material for the construction thereof, upon bids made thereof, and all to be done in strict a;cordance with the plans, grades, specifications, widths and profiles prepared in the office of the Commissioner of Public ':forks, and all of which are adopted as a rart of this Ordinance as fully as if embraced herein or attached hereto and made a part hereof, and mark-i ed "A" for more specific identification. SECTIOI! 2. il That sa id work shall be constructed under the direction and super- vision of the Commissioner of Public Works, and shall be commenced at the I No. 9 7y—_ Ordinance No...__. time designated by contract for the performance of sairl :7ork, and com- pleted on or before three months after the pas.saPo and recording of this ordinance. SECTI0h 3. That the cost of such construction of said alley shall be paid for wholly by the property o-rrniers abutting or fronting thereon, on both sides thereof, to be apportioned to and assessed against the property end property o^mers abutting thereon, according to the number of a.butt- inP feet thereon, except that portion to be paid by the City of Paducah, Y.erltucky, as required by law. S! TI0i1 4. The Contractor awarcled the contract for the work herein provided for shall be paid only from the funds arisin,P from the Special Tax bills and Assessments against the property abutting the improvement herein pro• vided for, and in no other Bray, except that the said Contractor may be paid out of such bonds;as may be issued, in accordance with the la,,-., of the City of Paducah and Charter of cities of the second class of the State of Kentucky-, and, for the payment of :hick, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the Contractor for the con- struction of any of the :,ork herein provided for, e:cce;.,t the said City of Paducah shall be liable to the said Contractor for the excess of Fifty ( 50'M per cent of the value of any proper t- assessed for the con- struction of the work herein provided for. SE TIOi: 5. The Contractor awarded the contract herein provided for shall be paid monthly by Improvement 7arrants issued by the Citi* of T'a3ucah upon, estimates furnished by the Commissioner of Public 'forks, to the extent of sixty-five (65;D) per cent of the value of the work done by the Contractor di<ring the Imo Press of the -rork, and said Improvement 7arrants shall. bear six (6,"o) Per Cent ii:terest from date of issue, and shall be issued by the Commissioner of rublic Finance upon order of the Board of Commissioners. Said Improvement darrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied.. for such improvement, and shall be payable at the office of the Commis- sioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The Interest on such Improvement '7arrants shall be estimated and assess- ed as a part of the cost of the improvement herein provided for. Ordinance No..._ S-CTIOI? G.
