AN ORDINANCE CLOSING MkIDEN ALLY FOR A DISTANCE OF ONE HUNDRED FEET FROM THE NORTH END THEREOF, AND RELINQUISHING THE RIGHT AND TITLE THEREOF TO THE INT_;RNATIONAL SHOE COMEANY. WHEREAS, Maiden Alley extends from Jefferson Street to Broadway Street, between First and SecAnd Streets, in the City of Paducah, Ken- tucky; and, WHEREAS, all of the property owners abutting on said alley, de- sire that same be closed for a distance of one hundred (100) feet, from the North end thereof: and, WHEREAS, all the property owners have signed an agreement asking that Maiden Alley be closed for a distance of one hundred feet from the North end thereof and waiving all objections to the closing of same, and relinquishing any and all damages which might occur to their property on! Ordinance No. _-- account of said alley being closed: and, 1,9HEREAS, The International Shoe Company, in consideration of said Maiden Alley being closed for a distance of one hundred (100) feet from the North end thereof, agrees to deed and dedicate to the City of Paducah, Kentucky, an alley twenty (20) feet wide, beginning one hundred (100) feet and nine inches South of Jefferson Street, at the. intersection of Laiden Alley, and -running parallel with Jefferson Street to First Street a distance of one hundred and seventy-three (173) feet and three (3) inches, upon the rendition of a judgment in the McCracken Circuit Court closing said portion of Maiden Alley; said alley, so dedicated and deeded by said International Shoe Company, is to be used as a public alley; and, ,+HEREAS, a part of Sewer District #1 lies under the above des- cribed northern one hundred (100) feet of said alley, and the Internation- al Shoe Company is planning to construct a building on and over said northern one hundred (100) feet of said alley, or a part thereof; and, WIM M, S, the City of Paducah desires to give The International 11 Shoe Company the right to construct said building over any, or all of said northern one hundred (100) feet of said alley, and quit -claim said portion of said alley to The International Shoe Company, but, WI REAS, The City of Paducah desires to protect the sanitary sewer now lying under said northern one hundred (100) feet of Maiden Alley, from all interference by The International Shoe Company, and to provide that the International Shoe Company shall be liable for any damage, cost or expense resulting to the City of Paducah by reason of any interference, damage or injury to said Sewer and desires to provide that the City of Paducah shall, at all times, have free and full access to said portion of said alley, so far as same shall be necessary in fully caring for and protecting the said sanitary sewer non thereunder; and, WHEREAS, The International Shoe Company now owns the property on both sides of said Northern one hundred (100) feet of said alley; now, therefore, BE IT ORD _111110 BY THE BOARD Or COlUdISSION'RS OF THE CITY OF PADUCAH, iCNTUCY_Y: SECTION 1. That Maiden alley, for a distance of one hundred (100) feet from the North enl thereof, be, and the same is he_•eby closed, abandoned and I discontinued as a public alley. SECTION 2. That the City Solicitor is hereby directed to institute an action in the McCracken. Circuit Court for the purpose of havine said alley is closed by judgment of Court, and is directed to make defendants in said 9 action all parties ovining land abutting on Maiden Alley between Broadway Ordinance No, and Jefferson Streets, aforesaid. SECTION 3, The International Shoe Company is hereby a-iven the full right of the use of said Northern one hundred (100) feet of said Maiden Alley, for the purpose of building thereupon, and for any and all other pur- poses for which it may desire to use said one hundred (100) feet of said alley, and the City of Paducah hereby relinquishes to The International Shoe Company all its right, title and interest in and to said Northern one hundred (100) feet of said alley, but upon the express condition that neither The International Shoe Company, its successors or assigns, will interfere with the sanitary sewer now lying under said Norther one hundred (100) feet of Maiden Alley, and upon the further condition that The International Shoe Company, its successors or assigns,:gill be liable for any damage, cost or expense resulting to the City of Paducah by reason of any interference, damage or injury done by The Internation al Shoe Company, its agents, servants, successors or assigns, to said sanitary- sewer; and upon the further condition that the City of Paducah shall, at all times, have free and full access to said portion of said alley, so far as same shall be necessary in fully caring for and pro- tecting the sanitary seder now thereunder. But in caring for or pro- tecting said sanitary sewer, the City of Paducah will, at all, times, replace, at its own expense, the buildings or improvements upon said portion of said alley, and will leave such buildings or improvements in as good condition as when taken up, moved or interferred with by said City. The International Shoe Company shall construct its floor over - said sewer in removable sections. { SECTION 4. Upon the execution, delivery and recording of a deed from The International Shoe Company to the City of Paducah of the above-described strip of ground twenty (20) feet wide by 173 feet 3 inches on the South portion of the land recently conveyed by The "'estern District ilarehouse Company to The International Shoe Company, the L'ayor of the City of Paducah is hereby directed to execute to The International Shoe Company a quit -claim deed to the above described northern one hundred (100) feel of Maiden Alley, but said deed is to Dive 'to the City of Paducah all the rights and privileges above enumerated with regard to the sanitary sewer under said one hundred (100) feet of ground.
