AN ORDINANCE REPEALING AND RE-ENACTING SECTIONS 16 AND 19 OF AN ORDINANCE ENTITLED, "AN ORDINANCE RELATING TO AND REGULATING THE TrLARFCT HOUSE OF THE CITY OF PADUC.AH, XENTUCKY, PRESCRIBING THE RULES FOR THE CON DUCT THEREOF AND THE PENALTIES THEREUNDER, AND FIXING THE PRICES TO BE CHARGED FOR THE RENT OF BENCHES AND STALLS THEREIN," PASSED BY THE BOARD OF COT:UdISSIONE_RS DECELBER 13, 1915. RE IT ORDAINED BY THE BOARD OF 00T_.Z,?ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: Section 1. That section 16 of an ordinance entitled, "An Ordinance Relating to and Regulating the 1.5arket House of the City of Paducah, Kentucky, Prescribing the Rules for the Conduct Thereof and the Penalties Thereunder, and Fixing the Prices to be Charged for the Rent of Benches and Stalls Therein," passed by the Board of Commissioners December 13, 1915, be and the same is hereby repealed, and .in lieu thereof the following is enacted; Section 16. It shall be unlawful for any person to purchase, sell, or make any contract or agreement or combination for the purchase or sale of any vegetables, provisioils, fowls, fruits or food products of any character whatsoever, or any other marketing, at said market, before the opening of same .by the I,iarket Master; nor shall it be lawful for any person, huckster, hawker or peddler, or any other person or combination of persons, who buys or resells on the Paducah market, to purchase any article at said market house, or within four blocks thereof, during market hours, either for exportation or for the purpose of reselling same at said market house; nor shall any person sell or offer for sale at the market house, any article which such person may have purchased or forestalled at any place while on the way or designed or intended for sale at the market house; and it shall be unlawful for any,person mentioned herein, to set aside any article to be delivered at the close of market hours, or to iuithdraw same from public i sale to any and all persons who may desire to purchase same at retail prices during market hours, or to put a price on any article mentioned herein so high as to cause same to remain unsold for the purpose of defeating the provisions of this ordinance; and it shall be the duty of all persors. attending said market with provisions or food _oroducts or other marketing for r sale, to sell or deliver to any person desiring the same, any quantity o3 such provisions or marketing brought by them ,to said market, and no huckster, hawker or peddler, nor any combination of persons whatsoever, shall be per- mitted, after market hours, to buy or sell any food products whatever at said market house or within four blocks thereof, that have been previously offered -for sale by any person at or within -Pour blocks of said market house; and it shall also be deemed unlawful for any huckster, hawker or peddler to No. 441 fe Ordinance No.___._._._ buy or sell or receive in his possession for sale any food T.Toducts herein mentioned, to be sold by such huckster, hawker or peddler at the market � house or within four blocks thereof upon commission. Any of the food Products chat have been herein mentioned that shall be delivered to any huckster, hawker or peddler at the market house, or within four blocks thereof, at any time, whether previously engaged or not, shall be deemed a violation of the spirit and intent and purpose of this ordinance; and it shall be unlawful for any huckster, hawker or peddler, or other person or persons, to form any combination or make or enter into any agreement whereby the price of marketing or the sale of food products of any person whatsoever shall be fixed and regulated by agreement• nor shall any person sell or offer for sale, at the market house, any article which has been purchased from any farmer, gardener or other producer, at any time, contrary to the provisions of this section. Provided., however, that this ordinance shall not apply to the purchase or sale of fruits or vegetables from bona fide commission merchants from their regular stock, and who have dell established places of business; and upon a conviction in the police court oT the City of Paducah, Kentucky, of any huckster, ha,.rker or peddler selling food products upon. the market house, or within Tour blocks thereof, in violation of the provisions of this section, his license to operate or transact business at, upon or near the market shall be revoked by the Board of Commissioners or the General Council of the City of Paducah-- and it is hereby made the special duty of the 1.arket 1,1aster to see that the provisions of this section are strictly and rigidly enforced. Section 2. That section 19 0£ said ordinance be and the same is hereby repealed, and in lieu thereof the following is enacted; Section 19. Ido person engaged in selling goods, fruits, vegetables or other merchandise in the city of Paducah, shall take any such goods, groceries, fruits, vegetables or merchandise to the market house in the city of Paducah and there sell or offer. to sell the same; provided, however, that the provisions of this section shall not apply to the sale of fruits or vegetables other than those raised and offered for sale at said market by persons residing within a radius of fifty miles of the City of Paducah. i • Section 3. All ordinances or parts of ordinances in con- �J flirt herewith are hereby repealed, in so far as same conflict with the provisions of this ordinance. l Section 4.
