HomeMy WebLinkAboutOrdinances Book 7, Page 402, No Ordinance NumberNo. t" Ordinance No. AN ORDINANCE TO AldEND All ORDINANCE ENTITLED, "AN ORDINANCE PROVIDING FOR THE SALE OF A FRANCHISE AND PRIVILEGE FOR THE PURPOSE OF ERECTING, OPERATING AND MAINTAINIlIG AN ELECTRIC STREET RAILWAY OPER CERTAIN STREETS IN THE CITY OF PADUCAH, MITTUCKY, ADOPTED BY THE BOARD OF COUNCIL1;EN ON THE 4th DAY OF I:;ARCH, 1911, AND APPRO= BY THE 110AYOR ON THE 3d DAY OF OCTOBER, 1911." BE IT ORDAINED BY THE BOARD OF COMI ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: That the first sentence of Section 15 of an ordinance entitled "An Ordinance providing for the sale of a franchise and privilege for the purpose of erecting, operating and maintaining an electric street railway over certain streets in the city of Paducah, Kentucky, be and the same is amended so as to read as follows: Section 1. Should said Company, its successors or assigns fail for thirty (30) days at any time to use or operate the franchise herein granted over any street mentioned in section three hereof, where tracks are noel, or shall be hereafter laid, by the purchaser of this franchise, its successors or assigns, the whole franchise shall become void, providod, ho.,rever, that the purchaser, its successors or assigns, shall not be required to regularly operate street cars over the line from Sixth to Eighth streets on Clark street; on Eighth street from Clark to Tennessee street; on Tennessee street from Eighth to Ninth street; on Ninth street from Te uzessee to Bockman street, but said purchaser, its successors or assigns shall operate on said streets on special occasions rihen the travel demands such operation. Section 2. This ordinance shall be in full force and effect only during the pendency of the receivership proceedings involving the Paducah Traction Company, and now pending in the I;IcCracken Circuit Court; said amendment shall become null and void and of no force and- effect ndeffect after the termination of said receivership proceedings, and after the property of said Company shall 'be taken out of the hands of the receiver. Section 3. This ordinance shall take effect and be in force from and after its passage, record and publication. Adopted by the Board of Commissioners 10%291918.
