ORDINANCE PROHIBITING THE DISCHARGE OR FIRING OF FIREvxRxS i.ND OTHER PYROTECHNIC DISPLAY .,ND TO LII.iIT THEIR STORAGE IN TH CITY OF PADUCfJ1, KENTUCKY", APPROVED JUITE 10, 1910. BE IT ORDAINED BY THE BOiLRD OF COM1.1ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: Sections 1. That an ordinance entitled, "lin Ordinance Prohibiting the Discharge or Firing of Fireworks and Other Pyrotechnic Display and to limit their storage in the City of Paducah, Kentucky", approved June 10, 1910, be and the same is hereby repealed and re-enacted so as to read as follows, to -wit: Section 1. The discharge, firing or use of all fire crackers, rockets, torpedoes, Roman candles, or other fireworks or substances designed and intended for pyrotechnic display, and of all pistols, canes, cannons, or other appli- anees, using blank cartridges or caps containing chlorate of potash mix- ture, is hereby prohibited. Provided that the Mayor or Board of Commis- sioners may order the public display of fireworks by properly qualified individuals under the direct supervision of experts in the handling of fireworks. Provided also t'i_at such display or displays shall be of suoh a character and so located, discharged or fired as, in the opinion of the Chief of the Fire Department, shall not be hazardous to surrounding property, or endanger any person or persons. Section 2. The sale of fireworks at retail is prohibited, provided and except the old style Chinese fire cracker, not larger than two inches in length and not over three -sixteenths of an inch in diameter, non -explosive sparklers, and small paper caps may be sold, used, exploded and fired as hereinafter provided. And provided further that the fire crackers, sparklers, and small paper caps mentioned in this section shall not be discharged, exploded or fired in the business section of the City of Paducah embraced within the streets known as First to Ninth and Washington to I.1onroe streets, inclusive, and provided further that all of said fire crackers, sparklers and caps mentioned in this section may be permitted to be exploded, fired and discharged only upon the premises of the purchaser of same, and that it shall be unlawful to discharge, fire or explode fire crackers of any description, sparklers, or caps in or upon the streets or alleys of the City of Paducah. Section 3. The storage or sale of fireworks at wholesale is prohibited, except by permit from the mayor, issued for a period of one year. Application for permit must be filed with the Chief of the Fire Department at least thirty days previous to the issuing of the permit and must give detailed No. nce No. ----- - description of the proposed care and storage of said material, of the structural conditions and occupancies of the building. Section 4. Permits may be issued only after an inspection of the premises by the Chief of the Fire Department or his authorized agent, vrho shall file with the Mayor and Fire Department a certificate of approval or his disapproval and reasons therefor. Section 5. Any person, firm or corporation violating any of the provisions of this ordinance as regards the storage and sale of fire works shall be deemed guilty of a misdemeanor and be fined not less than Ten Dollars nor more than Twenty-five (.25) Dollars for each day's neglect of com- pliance. Provided also that violation of other sections of this ordinance shall be considered a misdemeanor punishable by a fine not exceeding Ten (5x10) Dollars. The Chief of the Fire Department may, at his discretion, remove or have removed, at the owners' expense, all stock of fireworks or other combustible exposed for sale or held in stock in violation of this ordinance. Section o. The Chief of the Fire Department shall direct such fire appliances as in his judgment may be necessary for the premises, and he shall see that two or more persons are instructed in their use, and as to the best means of getting fire alarms to the Fire Department. Section 7. All ordinances and parts of ordinances inconsistent herewith are hereby repealed. Section 2. This ordinance shall take effect and be in force from and after its passage, record and publication. Passed by the Board of Commissioners December 21, 1917. Recorded by H. D.
