HomeMy WebLinkAboutOrdinances Book 7, Page 333, Ordinance Number 122ORDINANCE NO. mss - AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES OF BROADWAY FROM THE WEST PROPERTY LINE OF SIXTEENTH STREET TO TRE EAST PROP- ERTY LINE OF SEVENTEENTH STREET, OR FOUNTAIN AVENUE, THE ST'l OF $,3.71344 PER FRONT FOOT, AIM ASSESSIFIG THE ABUTTING PROPERTY ON BOTH SIDES OF JEFFERSON STREET FROIS THE WEST PROPERTY LINE OF SIXTEENTH STREET TO THE EAST PROPERTY LINE OF SEVE21TEEIITH STREET, OR FOUNTAIN AVENUE, THE SU1,1 OF $4.92034 PER FRONT FOOT FOR THE RECONSTRUCTION OF SAID STREETS BY PAVING ` KITH BITULITHIC, AND PROVIDING THAT SAID ASSESSLTNTS KAY BE PAID IN TEN EQUAL INSTALMENTS, BEING ONE EACH YEAR FOR A PERIOD OF TEN YEARS. WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky has heretofore, on the 12th day of I�Tay, 1916, adopted an ordinance entitled: "AN ORDINANCE PROVIDING FOR THE RECONSTRUCTION OF BROAD„AY AND JEFFERSON STREET FROM THE WEST PROPERTY LINE OF SIXTEENTH STREET TO THE EAST PROPERTY LINE OF SEVENTEENTH STREET, IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING THAT SAID IMPROVEMENTS NIAY BE MADE UPON THE TEN YEAR PAYMPT PLAN"; and, WHEREAS, said ordinance provides that the cost of the reconstruction Of said streets shall be paid for by the abutting property owners on both sides thereof, except that portion to be paid by the City of Paducah, as required by law; and, WHEREAS, pursuant to said ordinance a contract was, on the 26th day Of September 1916, entered into by and between the Southern Bitulithic Company, of the City of Nashville, State of Tennessee, and the City of Paducah, for the reconstruction of said streets; and, WHEREAS, said contract has been completed in all respects and the improvement therein provided for has been finished and accepted by the Board of Commissioners of the City of Paducah, Kentucky, on the 19th day Of September, 1917, pursuant to recommendation made therefor by the No..:' ' y Ordinance Commissioner of Public Works of said City; now, therefore - BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY CP PADUCAH, KENTUCKY: Section 1. That all the property on both sides of Broadway from the West property line of Sixteenth street to the East property line of Seventeenth street, or Fountain Avenue, in the City of Paducah, Kentucky, be, and the same is hereby assessed the sum of $3.71344 per front foot - and all the property on both sides of Jeff rson street from the West property line of Sixteenth street to the East property line of Seven- teenth street, or Fountain Avenue, in the City of Paducah, Kentucky, be and the same is hereby assessed the sum of r$i4.92034 per front foot, for the reconstruction of said streets by paving with bitulithic. Section 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the special tax bills issued against said property or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. Section 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted by an Act of the General Assembly of the Common- wealth of Kentucky of 1910, entitled: "AN ACT TO A1,TEND AND RE-ENACT SECTIONS 3094, 3096, 3097, 3098, 3099, 3100, 3101 AND 3102 OF THE KENTUCKY STATUTES, RELATING TO TP_E CONTROL AND Ih1PROVE1;1EKT OF STREETS, PUBLIC WAYS, LANDINGS, WHARVES, GROUNDS AND SIDEWALKS IN CITIES OF THE SECOND CLASS", said assessments may be -at the option of the property owners- payable in cash within thirty (30) days from the date of the passage and recording of this ordinance, or in ten (10) annual install- ments, pursuant to the provisions of Laid Statute. Section 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, which are to be paid on the installment -payment -plan, as hereinbefore provided for, the City of Paducah shall issue and sell improvement bonds, and to secure the payment of which bonds there is hereby pledged such taxes and liens on the property assessed herein for the payment of the principal. and interest on such bonds, but such bonds shall not be sold for less than par, and the proceeds thereof applied exclusively t6 payment for the improvement of said streets, as hereinbefore mentioned, and such bonds shall be issued and shall bear interest, and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky for 1910, and contained in said Act herainbefore mentioned.
