HomeMy WebLinkAboutOrdinances Book 7, Page 326, Ordinance Number 117No. Ordinance No. /" AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES OF BROADWAY FROM THE WEST SIDE OF THE TRACKS OF THE ILLINOIS CENTRAL RAILROAD COMPANY TO THE WEST PROPERTY LINTE OF SIXTEENTH STREET, IN THE CITY OF PADUCAH, KENTUCKY, THE SUM OF $3.683442 PER FRONT FOOT FOR THE RECON- STRUCTION OF SAID STREET BY PAVING WITH BITULITHIC,; AND PROVIDING THAT SAID ASSESSMENTS MAY BE PAID IN TEN EQUAL INSTALMIENTS, BEING ONE EACH YEAR FOR A PERIOD OF TEN YEARS.. WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky has heretofore, on the 10th day of April 1916, adopted an ordinance entitled: "AN ORDINANCE PROVIDING FOR THE RECONSTRUCTION OF BROADWAY FROM THE WEST SIDE OF THE TRACKS OF TRE ILLINOIS CENTRAL RAILROAD AS NOW LAID, TO THE WEST PROPERTY LINE OF SIXTEENTH STREET, IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING THAT SAID IMpROVEPd&1TS SHALL BE MADE UPON THE TEN YEAR PA)MIENT PLAN"; and, WHEREAS, said ordinance provides that the cost of the recon- struction of said street shall be paid for by the abutting property owners on both sides thereof, except that portion to be paid by the City of Paducah, as required by law; and, WHEREAS, pursuant to said ordinance a contract was, on the 26th day of September 1916, entered into by and between the Southern Bitu- lithic Company, of the city of Nashville, State of Tennessee, and the City of Paducah, for the reconstruction of said street; and, 119HEREAS, said contract has been completed in all respects and the improvement therein provided for has been finished and accepted by the Board of Commissioners of the City of Paiiucah, Kentucky, on the 27th day of August, 1917, pursuant to recommendation made therefor by the Commissioner of Public Forks of said City; now, therefore - BE IT ORDAINED BY THE BOARD OF C01,21ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: Section 1. That all the property on both sides of Broadway from the .lest side of the tracks of the Illinois Central Railroad Company to the :gest property line of Sixteenth street, in the City of Paducah, Kentucky, be, and the same is hereby assessed the sum of N3.683442 per front,foot for the reconstruction of said street by paving with bitulithic. Section 2. That all of the funds derived from the assess- ment of said property aforesaid shall be used for the purpose of paying off the special tax bills issued against said property or such bonds as may be issued by the City of Paducali pursuant to Section 3101 of the Kentucky Statutes. Section 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted by an Act of the General Assembly of the Commonwealth of Kentucky of 1910, entitled, "AN ACT TO AL,ND AND RE- ENACT SECTIONS 3094, 3096, 3097, 3098, 3099, 3100, 3101 and 3102 OF THE' KENTUCKY STATUTES, RELATING TO THE CONTROL AND IMPROVETNENT OF STREETS, PUBLIC WAYS, LANDINGS, WHARVES, GROUNDS AND SIDEWALKS IN CITIES OF THE SECOND CLASS", said assessments may be -at the option of the property owners- payable in cash within thirty (30) days from the date of the passage and recording of this ordinance, or in ten (10) annual install- ments, pursuant to the provisions of said Statute. Section 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, which are to be paid on the installment -payment -plan, as hereinbefore provided for, the City of Paducah shall issue and sell improvement bonds, and to secure the payment of which bonds there is hereby pledged suoh.taxes and liens on the property assessed -herein for the payment of the principal and interest on such bonds, -but such bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street, as hereinbefore mentioned, and such bonds shall be issued and shall bear interest, and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes as amended and re-enacted by the General Assembly of the Commonwealth of Kent'acky for 1910, and contained in said Act hereinbefore mentioned.
