BE IT ORDAINED BY THE BOARD OF COI;7IISSIONERS OF THE CITY OF PADUCAH, KENTUCKY. Section 1. That Section 16 of an ordinance entitled: "AN ORDINANCE RELATING TO AND REGULATING THE MARKET HOUSE OF THE CITY OF PADUCAH, KENTUCKY, PRESCRIBING THE RULES FOR THE CONDUCT THEREOF AND THE PEIIALTIES THEREUNDER, AND FIXING THE PRICES TO BE CHARGED FOR THE RENT OF BENCHLS AND STALLS THERE3111", passed by the Board of Commissioners December 13, 1915, be and the same is hereby amended so as to read as follows, to-vrit: Section 16. It shall be unlawful for any person to purchase, sell, or make any contract or agreement or combination for the purchase or sale of any vegetables, provisions, fowls, fruits or food products of any character whatsoever, or any other marketing at said market, before No. .d / 9 Ordinance No. _4 the opening of same by the Market Master; nor shall it be lawful for any person, huckster, hawker or peddler, or any other person or combination of persons, who buys or resells on the Paducah market, to purchase any arti- cle at said market house, or within four blocks thdreof, during market hours, either for exportation or for reselling at said market house; nor shall any person sell or offer for sale, at the market house, any article which such person may have purchased or forestalled at any place while on the way or designed or intended for sale at said market house, and any article shall be deemed sold in violation of the provisions of this ordi- nance when same shall he set aside to be delivered at the close of market hours or shall be withdrawn from public offer for sale to any and all persons who may desire to purchase same at retail prices during market hours, or when the vendor of such article or articles at said market shall put a price on same so high as to cause same to remain unsold for the pur- pose of defeating the intent of this ordinance; and it shall be the duty of all persons attending said market with provisions or food products, or other marketing for sale, to sell or deliver to any person desiring the same any quantity of such provisions or marketing bought by them on said market- and no huckster, hawker or peddler, or any combination of persons, shall be permitted, after market hours, to buy or sell any food products whatsoever at said market house, or within four blocks thereof, that have been previously offered for sale by any person at or within" four blocks of said market house; and it shall also be unlawful for any huckster, hawker or peddler to buy or sell or receive in his possession for sale any of the food products herein mentioned to be sold by such hawker, huckster or peddler at the market house or within four blocks thereof upon commis- sion; and any of the food products herein mentioned that shall be delivered to any huckster, hawker or peddler at the market house or within four blocks thereof at any time during market hours, whether previously engaged or not, shall be deemed a violation of the spirit, intent and purposes of this ordinance and shall be unlawful and a violation hereof; and it shall further be unlawful for any huckster, hawker or other person or persons to form any combination or make or enter into any agreement whereby the price of marketing or the sale of food products of any person whatsoever shall be fixed and regulated by such agreement- nor shall Rny person sell or offer for sale at the market house any article which has been purchased from any farmer, gardener or other producer at any time contrary to the provisions of this section. Provided, however, this ordinance shall not apply to the purchase or sale of fruits or vegetables from bona fide .commission merchants from their regular stock and who have well established places of business- and upoh a conviction in the Paducah Police Court of any huckster, hawker or peddler selling food products upon the market house in violation of the provisions of this section, his license to No. L9 (' Ordinance No. // operate or transact business at, upon or near the Paducah market shall be revoked. And it is hereby made the special duty of the Market Faster to see that the provisions of this section are strictly and rigidly enforced. Section 2. all ordinances and parts of ordinances in conflict herewith are hereby repealed, and this ordinance shall take effect upon its passage, approval, record and publication.
