BE IT ORDeINED BY THE BO,RD OF COLZIISSIONERS OF THE CITY OF FADUC-H, EENTUCKY: Section 1. That it shall be unlawful for any company, corporation, person, or persons whatsoever, for compensation or award, except as hereinafter provided, to set up, carry on, keep, manage, operate or conduct on premises under his occupation or control, or to aid or assist in setting up, carrying on, keeping, managing, operating or conducting any keno bank, faro bank, slot machine, or other machine or contrivance used in betting, whereby any property, money or other thing of value is or may be bet, won or lost; and it shall be unlawful for any such person, corporation or company, for compensation or commission or percentage, to set up, carry on, manage, operate or conduct, any gEme of cards, oontz," or craps, or slot machine, whereby any property, money or other thing of value may be bet, won or lost, or who shall, for compensation, per- centage or commission, aid, assist or abet in setting up, carrying on, managing, operating, or conducting any game or machine so set up, carried, on, managed, or operated, for compensation, percentage or commission, or shall have in his or its possession or control, or on his or its.premises, any machine, device or appliance used in gambling whereby property, money or other thing of value may be bet, won or lost, and any one violating the provisions of this ordinance shall be fined in any sum not exceeding one hundred (:;x100.00) dollars, and each day that any such slot machine, game, bank, or other machine or contrivance used in betting shall be or remain upon the premises, shall be deemed a separate offense, and it shall be the duty of the Police Department and police officers to enforce and carry into effect this ordinance. �. Section 2. nny person, company, corporation, or combination_ of persons who shall be guilty of a second offense under t2 -e first section of this ordinance shall be subject to the fine provided in Section one (1) of this ordinance, and in addition thereto shall be incarcerated or imprisoned for thirty (30) days for each offense. Section 3. This ordinance shall not prevent the conducting and operating of any machine whereby property or other thing of value is distributed by drawing- provided, however, that each and every person patronizing the said machine or device, for distributing goods or mer- chandise, shall be treated alike and shall receive the same amount of merchandise or compensation for the money invested or used in drawing from said machine, and provided that such machine, device or contrivance No. Ordinance No.._1� shall only be used in a legitimate tray for the distribution of merchandise or commodities to all persons or customers who may patronize the same. • Section 4.
