HomeMy WebLinkAboutOrdinances Book 7, Page 296, Ordinance Number 1031 1V0.';'2 9'4 Ordinance No. /d3 AN ORDINANCE ASSESSING TIIE ABUTTING PROPERTY ON THE NOP,TH SIDE OF CLAY STREET FROM THE WEST PROPERTY LINE OF FOUNTAIN AVENUE (SLVENTE111TH STREET) TO THE EAST CURB LINE OF NINIETEENTH STREET, IN THE CITY OF PADUCAH, XHITUGKY, THE SUI.1 OF 511.69968 PER FRONT FOOT FOR THE COST OF t CONSTRUCTIOI4 OF CONCRETE SIDELVALIZ AIM GUTTERS, TOGETHER V ITH GRANITE CURBING AND ALL SELERS, MANHOLES, INTAKES, CATCH BASINS fd:D DRIVE-VAYS IN SAID CONSTRUCTION, EXCEPT THAT PORTION PAID BY THE CITY OF PADUCAH, AND PROVIDING THAT SAID ASSE3SI:E11T I;uY BE PAID IN TEN (10) EQUAL INSTALL- MENTS, ONE EVERY YM R FOR A PERIOD OF TEN YEARS. 1:HEREAS, the Board of Commissioners of the City of Paducah, Kentucky, has heretofore, to -wit: on the 22nd day of I.1ay 1916, adopted an ordinance entitled: "_LN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SIDRVr_LYS, - CURBS AND GUTTERS, AND ALL NECESSARY I:114HOLES, INTAKES, CATCH BASIIIS AIM SEL',ERS, ON THE NORTH SIDE OF CLAY STREET FROM THE LIES^1 PROPERTY LINE OF FOUI,fTjZN AVENUE, OR SEVENTEENTH STREET, TO THE EAST CURB LINE OF ' NINETEENTH STREET, III THE CITY OF PADUCAH, KENTWKY, AND PROVIDING FURTHER ` THAT THE COST THEREOF I.AY BE PAID UPON! THE TEN YEAR PAYLEITT PLAN". ViTEREAS, in accordance vdth said ordinance it was provided that the cost of the construction of said sidewalks, curbs, Eutters, sewers, intakes, manholes and catch basins shall be paid for by the abutting property =aers on both sides of said street, except that - portion to be paid by the City of Paducah, as required by law; and, WHEREAS, pursuant to said ordinance, a contract was entered 'r into by and between Prosser & Halliday, of the city of Cairo, State of Illinois, and the said City of Paducah, for the construction thereof, on the 15th day of September 1916; and, WHEREAS, said contract has been completed in all respects, and the work thereof finished and accepted by the Board of Commissioners of the City of Paducah, on the 16" day of April 1917, pursuant to recommenda- tion made therefor by the Commissioner of Public Works of the City of Paducah; now, therefore, ; BE IT ORDAINED BY THE BOARD OF COI.Il,IISSIONERS OF Tli'E CITY OF PADUCAH, KENTUCKY: Section 1. That all of the property on the North amide of Clay street from the West property line of Fountain Avenue , or 17th street, to the East curb line of Nineteenth street, in the City of Paducah, be and the same is hereby assessed the sum of 9"1.69968 per front foot for the cost of construction of said sidewalks, curbs, gutters, sewers, manholes, intakes, catch basins and driveways. Section 2, That all of the funds derived from the assess - merit of said property aforesaid shall be used for the purpose of paying off the special tax bills issued against said property or such bonds as N o. _.LZ� Ordinance No./e,3 may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky statutes. Section 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted by an Act of the General Assembly of the Commonwealth of Kentucky of 1910, entitled "AN ACT TO AMEND AND RF. - ENACT SECTIONS 3094, 3096, 3097, OD96, 3099, 3100, 3101 and 3102 OF THE KENTUCKY STATUTES, RELATING TO THE CONTROL AND II:IPEOVEP,IENT OF STREETS, PUBLIC CLAYS, LtiNDINGS, 17HARVES, GROUNDS AND SIDF"lALFS IPI CITIES OF THE 1 , SECOND CLASS," said assessments nay be- at the option of the property owners- payable in cash rithin thirty (30) days from the date of the passage and recording of this ordinance, or in ten (10) annual install- ments, pursuant to the provisions of said Statute. Section 4. In order to provide a fund for the immediate payment of the cost of that portion of the Special assessments herein provided for, rhich are to be paid on the installment -payment -plan, as hereinbefore provided for, the City of Paducah shall issue and sell Improvement Bonds, and to secure the payment of which bonds there is hereby pledged such taxes and liens on the property assessed herein for the payment of the principal and interest on such bonds, but such bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said sidewalks, curbs, gutters, manholes, catch basins, intakes and sewers as hereinbefore men- tioned, and such bonds shall be issued and shall bear interest, and shall be payable in accordance with the provisions of Section 3101 of the i • Kentucky Statutes as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky for 1910, and contained in said Act herein- before mentioned.
