HomeMy WebLinkAboutOrdinances Book 7, Page 226, Ordinance Number 77No. � Ordinance No.-7-7— AN o. —7-7 AN ORDINANCE PROVIDING FOR THE 1I24PROMI NT OF MONROE STREET, C01,11ENCING ON THE EAST LINE OF LOTS NUMBERS FOUR (4) AND THIRTEEN (13), IN WHAT IS KNOWN AS FOUNTAIN PARK ADDITION TO THE CITY OF PADUCAH, KENTUCKY, THENCE WESTWARDLY THREE HUNDRED (300) FEET, IN THE CITY OF PADUCAH, IMNTUCKY, BY GRADING AIJD GRAVELIPIG SAP.1E. t BE IT ORDAINED BY THE BOARD OF COMIISSIONERS OF TRE CITY OF PADUCAH, KENTUCKY: Seo. 1. ; That the driveway on 1,1onroe Street, commencing on the East line of lots numbers four (4) and thirteen (13), Fountain Park Addition to the City of Paducah, Kentucky, tlLanee Westwardly three hundred (300) feet, in the City of Paducah, Kentucky, be, and the same is hereby ordered to be constructed; that said street shall be constructed by grading and gravelling same, and all to be done in strict accordance with the plans, grades, specifications, widths and profiles of the Commissioner of Public horks, prepared by him for such purpose- all of which are adopted as a part of this Ordinance as fully as if embraced herein or attached hereto and made a part hereof, and marked "A" for more specific identification. Sec. 2. That said work shall be constructed under the direction and supervision of the Commissioner of Public 1''oriz, and shall be commenced at a time designated by contract for the performance of said work, and completed on or before three (3) months after the passage and recording of this ordinance. Sec. 3. That the cost of such construction of said alley shall be paid for wholly by the property owners abutting or fronting thereon, on both sides thereof, to be apportioned to and assessed against t1b property and property owners abutting thereon, on both aides thereof, according to the number of frent feet abutting thereon, except that the City of Paducah shall pay such portion of such costs of con- struction as required by law. Sec. 4. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the special tax bills and assessments against the property abutting the improvement herein provided for, and in no other way; aryl in no ' event shall the City of Paducah be liable to the contractor for the construction of any of the work herein provided for, except that the City of Paducah shall be liable to the said contractor for the. excess Na. y i Ordinance No.- of o._ of fifty (500) per cent of the value of any property assessed for the construction of any of the work herein provided for. Seo. 5. This ordinance shall take effect and be in force ten (10) days after same is adopted and recorded; provided petition, according - to law, for a referendum vote hereon has not been filed within said ten days.
