That the sidewalks, curbs and gutters, together with the necessary manholes, intakes, catch basins and sewers, on both sides of the streets embraced in the territory extending from the East property line of Second street to the Test property line of Ninth street, and from the North property line of I.:onroe street to the South property line of Washington street, in the City of Paducah, Kentucky, -except the South side of Washington street from Sixth street to Seventh street, abutting the County Court House property, and except both sides of I:ionroe street from Eighth street to Ninth street, and er_cept, further, the sidewalks which have been con- structed of vitrified brick in front of wholesale houses, in said territory- where said sidewalks, or any portion thereof, are not now constructed of concrete or stone and granite curbing, be, and the same are hereby ordered to be constructed; that said sidewalks and gutters shall be constructed of concrete material and the curbing shall be of granite, suitable in all respects for such construction, and all to be done in strict accordance with the plans, grades, specifi- cations, widths and profiles prepared in the office of the Commis- sioner of Public Works, and all of which are adopted as a part of this Ordinance as fully as if embraced herein or attached hereto and made a part hereof, and marhed ":_" for more specific identifica- tion. dentifica- tion. That said work shall be constructed under the direction and supervision of the Commissioner of Public Works, and shall be Ordinance No.._L_2_ commenced at a time designated by contract for the performance of said work, and completed on or before six months after the passage and ' recording of this Ordinance. Sec. 3. That the cost of such construction of said sidewalks, curbs and gutters, and the necessary manholds,.intakes, catch basins and. severs, shall be paid for wholly by the property owners abutting or fronting thereon, on both sides thereof, to be apportioned to and assessed against the property and property owners abutting thereon, on both sides thereof, according to the number of front feet abutting thereon, e:,,cent the corner lots abutting upon said improvement shall pay for the entire cost of all of the intersections, in addition to the abutting property immediately in front thereof. Sec. 4. The contractor awarded the contract for the wort: herein pro- vided for shall be paid only from the funds arising from the Special tax bills and assessments against the property abutting the improvement herein provided for, and in no other way, except that the said con- tractor may be paid out of such bonds as may be issued, in accordonce with the law of the City of Paducah and charter of cities of the second class of the State of Kentucky, and for the payment of which said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said Cite of Paducah be liable to the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said con- tractor for the e,�:cess of fifty (50') per cent of the value of any property assessed for the construction of the work herein provided for. Sec. 5. The contractor awarded the contract herein provided for shall be paid monthly by Improvement Warrants, issued by the City of Paducah upon estimates furnished by the Commissioner of Public -iorhs, to the extent of sixty --five (65j') per cent of the value of the work clone or materials furnished by the contractor during the progress of the %:,or k, and said Improvement 1,7arrants shall bear six (6;j) per cent interest from date of issual, and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement 'Warrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied -for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, u»on completion and acceptance of the work herein provided for, out of 'the first collection of such local P^) taxes,lor out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improve.aent 9;arrants shall be estimated znd assessed as a part of the cost of the improvement herein provided for., Sec. 6.
