PROVIDING FOR THE II.TPROVPIfiI3NT OF CALDWELL STREET FROlri FOU-' RTH STREET TO FIFTH' STRFFT, IDI TTIF CITY OF PADUCAH, BY GRADEING OF SAME AND PLACFING (THEREON CRUSHED STONE. Be ordained by the General Council of the city of paducah, ':entucky: SEC. I. That Caldwell street from fourth street to fifth street, in the city of paducah, kentucky, be, and the same is hereby ordered to be con - strutted. SFC. 2. Said street shall be constructed of crushed rock, and all-: of said work to be done in strict accordance rrtth the plans, grades, specifications, widths and profile of the city engineer, made and provided by him for such purpose, and all of which are adopted as a part of this ordinance as fully as if embraced here -in or attached hereto and made a part hereof, and narked "A" for more specific iden- of ication. 358 r constructed under the directions SEC. 3. said work shell be of the city engineer, ani of the Hoard of Public Works and the supervision shall be commenced at a time designated by contrEtct for the performance of ,t 2914. said work . end completed on or before sept I`''� SEC. 4. SEC. 5. The contractor awarded the contract for the work herein provided f,•r, shall be paid only frpra the funds arising from the Spe- cial tax bills and assessments against the property abuting the iriprovement herein provided for , and in no other way;except that the said contractor rs11 be paid out of the proceeds of such bonds as may be issued in accordance 1t thelaws of the city of Paducah, and for the payment of which the tax bills and assessment s of property abuting the herein described, improvements may be pledged by the said city of paclucir_h,; ano in no event shall the city of. i FadupRh be liablWto the con tractor for the construction of any of the pro i �perty herein provided for, except the said city of padllcahlshall be liable to the contractor for cost of construction of all intersections of streets snd public alleys, and for the e_•_oess of 54o of the value of any property assessed for the improvement of the work herein provided for. SRC. 6. The contractor awarded the contrect herein shall be ii •aid monthly biT iriprovpnent warrants issued 11y the city of paclucah, upon 2stirra+,es furr_ished by the city engineer, to tlhe extent of 65,!6 of the value of the work done by the contractor, during the pro,,ress of the vrork, and sPA improvement warrants shall bear 61/ interest from slate of issue, and shall be iissued by the t,re:,surer, Upon order of t71e Ger:eral Council, said improveYnent arrants shEll be negotiable and shall constitute a lien on the local taxes t,o be hereafter levied Upon t,71e Property abtlting said improvement, for such improvement, andshall be payable at the office of the city treasurer, i°rit.h -out notice to the holder thereof, upon completion and acceptance of. the ,ro7 i lzarein provided for, out of the first •collection Of such local taxes, or r ojut of the proceeds of the sale of any improveYaent bonds issued in r,ntici- pation of the collection of such local te,;;es.
