That sideFrells, curbs, rnd gutters, togather with all necessary man- see. and driverraP, on both dices of South holes, intakes, catch basins, Fourth Street from the South line of Broad street' to the North end of said bridge to the North line of Farley place, in the City of Paducah, Kentucky, be, and the same are hereby orderer] to be constructed. Sec. 2. Said sidewalks, and gutters shrill be constructed of concrete material, and the curbing therefor shall be of granite, and all of said �:,ork shall be clone in strict accordance with the plans, grades, specifactions, widths, and profile, of the City Engineer, made and provided for such purposes, and all of which are adopted as a part hereof as if fully set forth herein, And -the same are now referred to, and marked "A"for more specific idenifaction. Sec. 3. Saud work shall be constructed under the cdirection of the Board of Public arks, and the supervison of the City Engineer, and sha•lbe commenced at a time designated by the contract for the performamce of said work, and completed on or before September 1st 1914. Sec. 4. The cost construction of se.irl sidewalks, curbs, and gutters with all necessary manholes, intakes, catch basins, sewers, and drivetrraystherefor, shall be paid for wholly by the property owners abutting or fronting thereon, or both sides thereof, to be apportioned to and assessed against the property i land property owners fronting and abutting thereon, on both sides thereof, I iexcept the corner lots abutting upon said improvement shall pay for the entieP cost of all interesctions in additions to the construction immediately abutt- ing said property, and the City of Paducah shall Pay the cost of construction abutting all public alleys, i i Sec. 5. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the special tax bills and assessments against the property, abuttin 1; the improvement herein described ;rind in no other way, except thatthe s aid corlta;;nc for May ;bonds as may be issued by the City y be Paid out of such of. Paducah in accordance with the laws governing same, and for the pay)'•tent of which of the property abutting the the tax bids and assessments herein described improve3aent may be pledged by the City of Paducah; and in no event shall the City of Paducah be liable to the contrac*or for the cost, of the construction of said sidewalks, except the portion I thereof abutting public Al6eys, and for the excess of fifty (50�) per cent of the j value of any -such improved property assessed for the improvement herein provided -fora Sec. 6. The conyractoic awarded the contract herein shall be paid by monthly improve— j ment warrents issued by the City of Paducah, upon estimates furnished by the City Engineer, to bhe extent of Sixty—fife per cent(65%) of the v alae of the work done by the contractor, during the progress of the work, and said improvement warrents 6RA shall bear, six—per cent(%) interest from date of issue, and shall be issued by the City Treasurer upon order of the General Council. Said improvement warrents shall be ' negotiable, and shall constitute a lien on the local taxes to be hereafter levied upi ' on the prd)perty abutting said improvement, for the making of said improvement, and ' shall be payable at the office of the City Treasurer, without notice to the holder I i thereof, upon complotionand acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any im— provement bonds issued in anticipation of such local taxes. the interest on such improvement warrents shall be estimated and assessed as a part of the cost of the im! provement herein provided for. Sec. 7. This ordinance shall take effebt and be in force fxori and; -after its passage approval `and publication. Given its First and Second passage by the Councilmen 3/16/14. Given its First and Second and final passage by the Aldermen 4/6/14.
