Y BE PAID IN TE14 EQUAL INSTALT�I:,7,NTS ONE !R Kentucky, has the city of paDucah, WHEREAS, the General Council of ted an ordinance entitled °Ari heretofore, to Wit;— On August 1st, 1910, adop sidewalks and gutters, ordinance providing for the construction of concrete intakes, catch nt-nholes, together with granite curbing and all street to basins and sewers on both sides of Tenth street from TriMbl� Burnett street., in the city of Paducah, Kentucky; and, INfIFRFAS, in accordance with said ordinance it vras Provided that the cost of the construction of said sidewalks, curbs, gutters, sewers, intakes, manholes and catch basins shall be paid for by, the abutting property owners on both sides of said street, except that portion re— quired to be paid by the City of Paducah by law; and, WHEREAS, pursuant to said ordinance a contract was entered into by and between G. Vr. Katterjohn of the city of Paducah, Ky., and the City of Paducah, Kentucky, for the construction thereof, on the 24th day of January, 1911, after due advertisement by the said city of Paducah, acting by and through its Board of Public Works: 'or bids for the construction thereof; and, Y WJ-=2,AB, said contract has been completed in all respects, and the work thereof finished and accepted by the Board of Public Works, after inspection thereof pursuant to advertisement and notice to property holders as provided by law, on August 4th, 1911,; and, 1VdEREAS, said action of the Board of Public Works and the acceptance of said work was ratified, said vrork was accepted according to law by the General Council of the city of Paducah, K :ntucky, on August' 7th, 1911" Now therefore, Be it ordained by the General Council of the City of Paducah, Kentucky: Sec. 1. That all of the property on both Sides - Of Tenth Street from Trimble Street to Burnett Street, in the city of Paducah, KentucKy, be, ;and the same is hereby assessed the sun of '4'1.62055 per the cost of the construction of said sidevrauis front foot for curbs, gutters) sewers, manholes, intakes, catch basins and drive1vays. Sec. 2. That all funds derived from the assessments of said property afore- said, shall be used for the Purpose of paying off the special tax bills issued against $aid property, or such bonds as may be issued by the City of Paducah, Pursuant to Section 3101 of the Kentucky Statutes. i Sec. 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and reenacted by an act of the General Assembly of the Commonwealth of KentuclW of 1910, entitled, "An Act to amend and re-eiv,ct Sections 3094, 3096, 3097, 3095, 3099, 310J, 3101 and 3102 of the Kentucky Statutes, relating to the control and improve: ent of streets, public ways, landings, wharves, grounds and d5 sidewalks in cities of the second class",- said assessments may be, at the option 0 of the property owners, payable in cash within thirty (30) clays from the elate of the passaF;e, approval and publication of this ordinance,or in ten (10) anmal installments, pursuant to the provisions of said section of said statute. Sec. 4. In arde to Pri�v-ioe fund for the i^r-.ediate payment of the cost of portion of 'he special assessments herein provided for, which are to be paid upon the installment payment plan_, as hereinbefore provided for,- the General Council shall issue and sell improvement bonds in anticipation of the collection of said special tat: bills which are to be paid upon the installment payment plan, and to secure the payment of which bond: there is hereby pledged such taxes and. liens on the property fDr the payment of the principal and interest of such bonds, and. such bonds shall be sold .for not less than pax, and the proceeds thereof applied exclusively to the payment for the improvement of said sidewalks, curbs and gutters hereinbefore mentioned, and such bonds shall be issued in accordance with, and shall bear interest in accordance with, and shall be payable in accord- ance ivistJ-,, Section 3102 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky for 1910, and contained in an act, entitled, 01 An Act to amend and re-eiza.ct Sec ions 3094? 3096, 309, 3098, 3099, 3100, 3101 and 3102 of the Kentucky Statutes relating to the control and \ improvement of streets, public ways, landings, wharves, grounds and sidewalks. in cities of the second class, Sec.. 5.
