"An Ordinance Amending Ordinance No. 22, of the Revised Ordinance of the City of Paducah, Titled Wharf and Wharf Master, and Freeing Towboats from Wharfage Free. Whereas: Towboats operating in the Tennessee and Ohio rivers do not use the public wharf, or landing, for the purpose of transferring freight or passengers, and whereas, such boats stopping in the City is only for the purpose of employing officers and crew, and to purchase material and supplies for long trips, of our merchants, and .to have re- pairs made by our mechanics, and whereas: this patronage has now grown to enormous proportions, and of so great interest to the city the wharfage fees should not be exacted of such boaty, therefore; Be it ordained by the Common 'Council of the City of Paducah. Section f. That ordinance No. 22 of the revised ordi- nances of the City of Paducah, "titled Wharf and Wharf - master" be and the same js hereby amended by striking out of section 2, thereof the words, "or towboats" where same may appear therein. Sec. 3• That all ordinances and parts of ordinances in conflict with the provisions of this ordinance are, to the ex- tent of such conflicting, hereby repealed and this ordinance shall take effect from and after its passage and approval. Omita d —Repealed. 4.—The city engineer shall make out plans, specifica- tions, and -estimates for all public work ordered by the com- mon council. He shall do all surveying and engineering that may be ordered by the common council or any com- mittee thereof. 5.—All contracts for works ordered by the city shall refer. to the plans and specifications applicable thereto, and, if practicable, they shall designate a gross amount which shall cover the whole cost of the work contracted for, and con- tain a clause that the same is made subject to the right of the engineer to suspend the same for the failure of the- con- tractor to fulfill it, and that such suspension shall not effect the right of the city to afiy damages on account of such con- tractors failure. 6—It shall be the duty of said engineer, when required by the common council, to furnish the number of feet in. any square in the city.
