Nuisances.
Section t. , It shall be unlawful for any person toper -

or filth of any kind to be thrown upon or remain on any lot
or premises belonging to such person or under his control
or in his occupation, or to allow any exposed pits, or to open
any pits and let them remain exposed, so as to endanger

the life, health, or well being of the citizeni in .any portion

Sec. 2. It shall be unlawful for any person to throw

upon the lot or premises of another, or upon the streets,
alleys, gutters, pavement, or other public places in the city,
any dirt, 111th, excrement, or feculaut or noisome substance.
Sec. 3. It shall. b- unlawful for any person within the

limits of the city of Paducah to construct, dig or build any

cesspool, privy vault or well for the purpose of receiving
slop, garbage, nightsoil, or other offal or filth.
Sec. 4. It shall be unlawful for any person to dig a pit

anywhere in the City of Paducah for the purpose of tak-
ing gravel therefrom, or to renfove any gravel from any pit
now open in the city.
Sec. 5. Whoever violates the provisions of the first or psnatHw
second section of this ordinance shall be fined not less than
$5 nor more than $too for each offense, and whoever vio-
lates the provisions of section 3 or section 4 of this ordi-
nance shall be fined not less than $2o nor more than $5o for ,
each offense. And the court shall further order such nuis-

ante abated within a reasontable time thereafter at the cost
of the owner of the property on which such nuisance shall
exist.
DoIlee of Sec. 6. The marshal of t',e city of Paducah or any police -
police . man or street inspector, shall and may from time fo time
between sunrise and sunset, enter into and examine any lot,
building, cellar, vault or privy which they may believe to be
foul or damp, or otherwise prejudical to public health, and
may recommend the cleaning or altering the same, or the
removal of all nuisances about any premises The Mayor
or marshal of the city may enter upon the land of any non-
resident and abate any nuisance thereon at the cost of such
non-resident.

situated, shall 'at all times keep such privy vault in proper
condition, and from the first day of April to the last day
of October in each year the same shall be well sprinkled
with lime or other disfectant at least twice in each month.

and no person so licensed shall charge exceeding $z per an-

day of October in any year, except upon the written per-

or filth, or to run any scavenger wagon along or through

p. m, in that portion of the city, bounded by Washington,

Fifth and Monroe streets and the river.. Any person who
shall violate the provisions of this section shall be fined not
less than $g nor more than $to for each offense.
Sec. q. It shall be unlawful for any person to convey
or have conveyed any part of the contents of any such privy
vault along any street or alley of the city of Paducah ex-
cept in water tight vessels and after such contents have been
first well disinfected and deodorized.
Sec. to. The contet,ts o! privies and privy vaults, all
slops, refuse from the markets, and all other filth and offal
in the city of Paducah, when removed by scavengers or
others, shall be deposited in the current of the Ohio river
not less than tweny feet front the water's edge, at the foot
of Clay street and not elsewhere. Any person who shall
violate any provision of this or the last proceding section
shall be fined not less than $to nor more than $too for
each offense.
Sec. ii. It is here% made the duty of the street in-
spector to observe and report all violations of the proceding
section.
Sec. 12. Before any •person shall erect or occupy any
house in the city of Paducah for the ptjrpose of slaughtering
animals therein, he shall apply to the general council and
obtain permission therefor, and any person who shall
slaughter any animal in any house or place in said city be-
fore obtaining such permission shall be fined $to for every
day such house or place shall be used for that purpose. No
animal shall be slaughtered except in a house which is paved
on solid earth with brick or stone pavements descending
so as to convey the blood or offal to a tub, which shall be
washed and the place cleaned at the end of each day of
killing, or in a house or place equally well guarded against
collecting filth or offensive matter, under a penalty of $to
for each offense. Slaughter houses shall be whitewashed
and limed at least once a month between the first day of
April and the first day of November in each year, and any
occupant failing to do so shall be fined $2o.

Sec. 13. It shall be unlawful for any person to suffer
or permit any well, cistern or vault of any description to be
left open on any lot belonging to him or under his control,
unless the same is enclosed by good and substantial fencing
and where not so enclosed they shall be kept covered se-
curely with substantial covering. Any person violating this
section shall be fined $5 for every ten hours such well, cis-
tern or vault may remain uncovered and unenclosed.
Sec. 14. No person shall erect or keep a powder mag-
azine in the city of Paducah:nor occupy any building or
place in the City for that purpose and no such magazine shall
be erected or kept near the city unless the same shall be made
srrietly fireproof, enclosed by a tight fence at least twelve
feet high, and not located eithin two hundred feet of any
other building. Any person violating the foregoing provis-
ions shall be fined $5o for every day of such violation.. Nu
person shall have or keep in any one house or place in the
city of Paducah at any one time more than twenty eight
pounds of gunpowder, under a penalty of a fine of twenty
five dollars. No person shall sell any gunpowder in the
said city after, dark or by candle, gas or oil light under a
penalty of $g for each offense.

ter of all kinds burned or removed so as to prevent the
house in which they work, from taking fire and any person
violating this section by leaving any material at his place of
work likely or easy to take fire and does not remove them
in a reasonable time, shall be fined $5 for each -offense.
plorwe of Sec. 16. It shall be unlawful for any person to store or
*=11 oil keep at any one time in any one locality in the city of Pa-
ducah more than fifty barrels of refined coal oil, carbon oil
or any other kind of illuminating oil or compound or any of
'the products of crude pettbleum. No person engaged in the
sale of any of said articles. in Paducah shall at any time
keep more than five hirrels thereof on the first or ground
floor of his store, and any quantity of such articles in ex -

cellar or vault nine feet in depth below the surface of the
earth, walled around with a brick or stone wall at least nine
inches thick, completely arched twith not less than nine
inches of stone or brick, and the arch covered over with at
least six inches of dirt or sand, with a doorway leading into
such cellar or vault inclosed by a heavy sheet iron door, fit-
ting so closely as to make such vault as near air tight as

ment to examine all such vaults or cellarsat at least once in
six months and report to the council the result of such

examinations. And the mayor may inspect such vaults at
his pleasure. No person shall keep any of said article, for
retail except in metallic cans or cases.
It shall be the duty of every wholesale dealer in said

stating oils, so that every person who may purchase a bar-
rel of any such fluid may have the same tested in his pres-
ence. Any person who shall violate any of the foregoing
provisions of this section shall be fined not less than $Io

Whoever shall sell coal oil, carbon oil or any other
illuminating fluid or product of crude petroleum below the
legal standard in the City of Paducah shall be fined not
less than $to nor more than $too for each offense.
Sec. 17. No saloon keeper nor any other person shall sale of limor

in any saloon or other place where spirituous, vinous or
malt liquors are retailed, nor in any room Which shall have

given, furnished or drank by any person at or in any theater,
circus, show or other exhibition, or in any room connected

of Paducah are hereby declared public moral nuisances and
are forbidden. The proprietor of any such exhibition, show,
circus, or theater,and each and every person connected there -
with, or aiding therein, shall be fined for each and
every
such offense not less than $25 nor more than $So.
Transfer to Second Class Cities.

of Paducah, and Providing the Transfer of Said City From

Sec. I. That it is the sense and oQitficial declaration of

Council of said city, tht:t the population of the City of Pa-
ducah is twenty one thcusand four hundred and fifty seven
(21,457), and that the population has been ascertained by the
census reporr made by the enumerators, provided for by a
certain ordinance passed by the Mayor and Common Cotm-
cil of said city on the bah day of May, tgot, and approved by
the Mayor of said city on the 8th day of May tgot, in pur-
suance of which said census enumerators were appointed.

Sec. 2. That said City of Paducah is now a city of the

under the laws of this Commonwealth, the said city of Pa- .

(20,000), is now entitled to be transferred from the third
class to that of the second class.
