An Ordinance Reguititing the Precedence of Public Con- tracts Over Streets, Alleys and Sidewalks in the City of Pa- ducah, With Penafties Thereunder. Whereas, in the construction or re -construction of streets, alleys and side-w4lks it may occur that the construc- tion or re -construction of buildings or other work by private parties may conflict as to right-of-way over the same by rea-. son of the letting of contracts at or near the same date, " . That when two or more contracts are under mast yield to vublto work progress of construction, the work. of individual s, property owners or. holders of franchises, on the same street, alley or; side -walk, and whose work shall conflict as to the obstruction of the highway, or interfere or hinder progress of the work one with the other, the one first beginning the work on said street, alley or side-waik shall be given precedence over -the others and it is hereby made the duty of the City Engineer to command the party or parties conflicting to desist until such time as the work of the person or contractor who is given the right-of-way hereunder shall have his work suffi- ciently advanced to be out of the way of the other, and that neither may obstruct the thoroughfare, except as otherwise provided by ordinance. That any person, firm or contractor, who shall violating this , ordinance violate the provisions of any of the .preceding sections by conflicting with or obstructing the work which is given pre- cedence thereunder shall be fined in any amount not less than $go, nor more tha,i $too for each day or part thereof that such confliction with or obstructt:on of the said work may exist. Sec, S. That all ordinances or parts of ordinances is conflict with the provisions hereof are' to the extent of such conflicting, hereby repealed and this ordinance shall take effect from and after its passage and approval.
