But no pros- ecution shall be commenced under said section " until the mayor or prosecuting attorney of the city shall give to such recusant company ten days notice to relay or readjust its track, describing the place and the defect complained of and then only upon the failure of said company to comply with such requirement. An ordinance regulating obstruction of sidewalks on Broadway from First street to Seventh street as pertain- ing to the placing of posts, poles, awnings, and signs with the sizes and height of same above the walks, and penalties 1. / W thereunder. That all ordinances or parts thereof in conflict with the provisions of this ordinance,— to the extent of conflicting,—are hereby repealed and this 'ordinance shall take effect from and after its passage and approval. An ordinance' amending ordinance No. 1017, entitled An ordinance regulating obstructions on sidewalks on Broadway from First street to Seventh street as pertaining to the placing of posts,poles and awnings, and signs with the sizes and heights of same above the walks, and penalties thereunder. Be it ordained by the Common Connell of the City of Paducah. Section I. That section .two of the above titled ordi- Post may be erectNd nance be, and the same is hereby amended by adding after the close of said section the following: "Provided, how ever, it shall be lawful for any person to erect in front of his place of business an ornamental cast iron post not less insize than six inches at the bottom in diameter and four III in diameter at the top and ten feet in height on which such person may erect a circular ornamental sign to be painted in blackand gold colors and such signs shall not exceed in diameterfive feet, and all such ornamental sizereetrolsws cast iron posts shall be uniform in size and even in height above the sidewalk on which it shall be erecred.
