obstruetlnr Sec. 2. It shall Le nnlawful for any person or persons
wwen+ to retard, arrest or obstruct the free flow of water in any of
the sewers of the City by placing or throwing therein any
dirt, gravel, rock, brick or parts of brick or other substance
or by any other means to prevent the free passage or flow
of any water in any such sewer or sewers.
Penslty Sec. 3. For every v:o'ation of any of the,provisions of
this ordinance the offender shall be fined not less than $g
nor more than $to.
Sec. q. This ordinance shall take effect from and after
its passage and approval.

An Ordinance Entitled an Ordinance Prescribing the
Time, Kind and Manner of Making Gas, Water and Sewer
Connections Along Broadway From the West Side of First,
S:rcet to the West Side of Fifth Street. Forbidding the Ex-
cavation of the Street and Sidewalks for a Term of Years,
With Penalties. Also Defining. Requirements of the Padu-
Cali Street Railway Co-nl:any With Penalties.
Whereas, the City of Paducah anticipateR the re -con-
struction of Broadway at an early date, from the west side of
First.street to the wast side of Fifth street by putting in im-
proved street paving and modern, side -walk's, and whereas.
after the said work is completed it' will be necessary that
said improved street and side -walk shall not be disturbed
by making excavations in either for placing in new connec-
tions for gas, water or sewerage, or for the repair of old
work.
Therefore, Be it ordained by the Common Council of the
City of Paducah:

Section t. That each and every lot, or parcel of ground, sewer
connections
vacant or otherwise, on either or both sides of Broadway must be made
from the west side of First street to the west side of Fifth
street, which may need gas, water or sewer. connections
within fifteenyears frc R the date of completing the con-
templated. improvement, the owner, lessees or agents thereof
shall make or cause to be made all of such connections as the
said street work progresses and in advance of the said im-
provement, or be barred from making either or any of the
said connections for the said period of fifteen years from the
completion of the said street improvement.
All persons making gas, water aad sewerage connections
as above set forth in this section and on the .street named
from First street to Fifth. street, shall do such work a suffi-

cient time in advance of the work of the contractors con-
structing the said street and side -walk improvement, and in
such manner that they shall in no way hinder or retard the
said contractors from puahing'to complletion the improvement

contract, and for each day or fractional part thereof any per-

ment, as above set forth, such person shall forfeit to the
contractor $25, whether such obst.cction be wilful or shall
be caused by neglect to provide material and lay the connec-
tions.
Sec. 2. That all gas, water and sewer connections to

extend under the side -walk to one foot, or more, inside of
the property line.
Sec. 3. That all gas, water and sewer connections along

City Engineer will not reasonably last fifteen years, as spe-
cified in section one of this ordinance, such connection or
connections shall immediately be renewed of improved ma-
terial at the cost of the party or parties owning or conduct-
ing or controlling such unsatisfactory connection, and all

such renewals shall be made as the street and side -walks are
excavated :or re -construction in advance of the grading of
same by the contractors and sufficiently expeditious as to in
no way retard or interfere with the progress of the street
work. All re-newals of connections shall extend to not less
than one foot inside of the property line along said thor-
oughfare.

tdpurcnulred within the territory. described, whether now made or to be
made, shall be put in of extra heavy lead pipe to stop box on
pavement and from this point to one foot or more inside of
the property line with the best extra heavy lead pipe; all to
be thoroughly tested for flaws and leaks before same shall be
permitted to be covered, and the cost of said work shall be
paid by the owner or operator of such water connection.

Sec. 5. That after said street and side -walk shall have

been re -constructed, as proposed, of modern and* permanent
paving material, then no excavations shall be permitted to be
made along same, either- on the side -walks or carriage way,
for any purpose whatever for a period of tg years from the
date of the reception of the improvement by the City as

completed; provided, however, that in the event of an acci-

dental bursting of a water main, or of the crushing of a sew-
er or other main pipes, all being damaging to the thorough-
fare; then it shall be lawful to open said street for the imme-
diate repair of such broken main, but when said improved
street or side -walk shall have been opened under this
provis-
ion, the party or parties so opening shall repair the break

immediately and shall, work day and night until same is
complete and the excavation refilled. They shall replace in
filling of the opening ccery particle of the earth taken
therefrom by persistent tamping, and shall re -build the con-
crete base of the best material, under. the supervision of the
City Engineer, to the same thickness of the original base,8nd
the top surface to be immediately and permanently restor-
ed to the grade and of the material of surrounding. surface

made and the whole after completion, shall be in all respects
as even, smooth and as substantial as it was before being
disturbed and the cost thereof shall be borne by the party
making the excavation.

suitable rails and ties which will last the said operators of
the railway for a term of 15 years, and as the ties in the re-
constructed road bed, and the rails p!-aced thereon, the
said person, firm or corporation operating said street rail-
way, shall cause to be made of suitable meta6 all electric
connections of said rails and other connections appurtenant
to the operation of such e:ectric railway and the material
shall be of sufficient durabiiity to last the term of is years.
After said street railway track shall have been reconstruct-
ed and the street as improved accepted by the city then no
interfering with same for repairs, or for any other cause

Sec. 7. The owner or operators of the electric street

to be used in the re -construction of their tracks when the
contractors are: in readiness to use same. or of making nec-
sary electrical, connections, retard the said work of improv-
ing said street, nor in any other manner or way retard the
progress of said work. For each day -or fractional part
thereof that the owners or operators of the said railway
shail obstruct the progress of the said street, improvement
they shall forfeit to the contractor, $25.90 . twenty-five dol
lars, whether the obstruction may be wilful or through
neglect to provide material for the re -construction of its
tracks.

with the provisions of this ordinance are hereby repealed
