Sec. 2. Said track shall be of the standard gauge and shall conform to the grade of the street (so far as practica- ble) and where it is ne_essary for the purpose of drainage proper culverts are to be erected and maintained at the cost of the said Chicago, Sr. Louis and New Orleans Railroad company for the free flow and passage of water. Said track is to be kept and maintained in good condition and repair by said railroad company. Sec. 3. This ordinance shall take effect from its passage and approval. Railroad company,its successors or assigns, are hereby granted the right to construct a railroad in Ninth street, com- mencing in -the center of the :present'track of the said Chi- cago, St. Louis and New Orleans Railroad company in Ninth :street about one hundred (too) feet north of the north side of Trimble street; thence in a southernly direction :diagonally across Trimble street on a 'seven (q) degree and fifty (go) minute curve into the property of the -said Chicago, St. Lou- is and New Orleans Railroad company,. between Trimble and Clay streets, thence to a point on Clay street about forty-five feet east of the east side of Ninth street, thence .across Clay' street into the property of, the said Chicago, St. Louis and New Orleans Railroad company to a point connecting with the present track of the Chicago, St. Louis & New Or- leans Railroad company a few feet south from the west side of Ninth street and between Clay and Harrison street and in accordance with the blue print hereto attached, which is made a part c•f thi's ordinance. Sec, a Said track shaill be of standard gauge and shall conform to the grade of the streets, street crossings, alleys and sidewalks (so far as practicable) along and over which it' passes and crosses; and ivhere it is necessary for the purpose of drainage, proper culverts are to be erected and maintained At the cost of the said .Chicago, St. Louis and New Orleans Railroad company, for the free flow and passage of water, and said track is to be kept in good order and condition by _ said railroad company. Sec. 3. The grant herein made over the private proper ty is made only so far as the General Council has the right of power to grant same. Sec. q.
