Regulating telephone poles and wires.
Regulation of Poles and VAres.
An ordinance to further regulate the erection of poles
and the stringing of wires, with penalties for the violation
of its provisions:
Be it ordained by the Common Council of the city of
Paducah, Kentucky:
Section t. That hereafter all poles erected by any per-
son or company in the city of Paducah; Ky., for the pur-
pose of stringing of wires thereon, shall be of good red
cedar, straight and s'hapeV and subject to such inspection
by the authorized representative of the city of Paducah, as
is required by the Western Union Telegraph Company for
poles erected by said company.
Sec. 2. All poles now erected or hereafter to be erect-
ed in the city of Paducah, shwa. be painted with Richmond
paint and good linseed oil, in the fallowing proportions:
Six pounds Richmond paint to one gallon of oil, to be put
on with painter's brush and when in the judgment of the
city electrician of the city 'of Paducah the pales now erected
or hereafter to be erected, need to be repainted, the com-
pany or person owning .said poles s1hall,upon written notice
from the .city electrmicia n and on a reasonable time aftleT re-
ceipt of such notice,Tepaint poles as direct,ed,and for a flailure
to comply with the provisions of this section any person or
company failing or refusing ssha•ll be fined $5.0o fqr each day
such person or company shall fail or refuse to paint their
poles as herein directed.
Sec. g. All poles now erected or hereafter to be erect-
ed steal$ be kept as near perpendicular as ,possible to do, and
any person or company permitting any pole to lean or '
swag, shall at once cause same to be placed perpendicular,
if possible, when notified by the street inspector, or other
city authority, so to do, and for a failure to comply with
the provisions of this section any person or company shall
,be fined $5.co for each day such failure or refusal continues.

Sec. 4. All poles not in active use by the company or
person erecting same and all dead wires shall be at once
i removed by said person or company on notice so to do by
the street inspector or other city authority of ,the city of ,
Paducah; and any person or company refusing or failing
to remove a pole or wire not in use, after having been
given the required not ice, shall be fined $5.00 per day for
each day such wire or pole is left standing after said
notice.
'y Sec. g. No pole shall be placed by any person or com-
pany in any intersection of streets or alleys of the city of
Paducah, but companies or persons may place their poles
at the line of the intersection of streets and alleys, but^
when so placed any other person or company, by paying
the annual rental herein provided, shall be permitted to use .
Che pole or poles of any person or company for the stringing
of wires, when necessary tolturn a corner by the company
or person desiring to use the po)e erected on the line of
the intersection above mentioned. But mare than one
crossarm shall not be paced upon any po!e by any one
person or company, other than by the person or company
erecting such poles, except as otherwise provided in this
ordinance.
Sec. 6. That all wires placed upon any pole or building
now erected or hereafter to be erected in the city of Padu-
cah, by any person or company other than the span guard
and trolley wires, shall be not less than 24 feet from the linr
of the pavement inside of the fire 'limits, but when necessary
to reach the interior of a structure, wires may lead down on
the outside of such building to within eight feet of the
surface of pavement.
Sec, y. That it shall be the duty of all per3ons or com-
panies erecting or stringing wires over or above wires carry-
ing currents of electricity, to protect said wires with
guard wires wherever such wires cross other wires. All guy

• wires shall be placed, at a distance of not less than ten feet
' from the ground—outside of the fire limits. All wires shall
be so placed so as to not interfere with the city of Paducah's
electric light lamps and wires, and shall clear same.
Sec. 8. That any person or company now using or here-
after using -the poles of the city of Paducah, shall pay to the
city of Paducah twenty-five cents per pole annual rental
thereof, and no

cept by placing -a crossarm thereon attached to the pole by
proper lag screws, and no pin shall be placed in said cross-
arms less than eighteen inches from the center of the pole to
which attached, and 'all crossarms shall be eighteen 'inches
apart, and no crossarm shall have (on, city's poles) more
than six pins thereon, nor shall any one person or company -

be allowed to fix more than three crossarms to any one of

the city's poles. Provided, however, the superintendent of
the city's light plant (who is referred to in this ordinance as
the city's electrician), wlth the approval of the light and wa-
ter committee, may have the power to use their discretion as
to granting the putting 'onyof a greater number of cross- .
arms of any particular pole where,, in their judgment, same
is needed, but in, all such cases a written report of their acz ,

the location of such pole of poles, and the said report shall
be spread upon, the minutes as a matter of record. The cit?

fined, but not oftener than once in every two years, dating
from the passage of thi., ordinance, and persons or compa-

trician, and tto pole shall be rented for.a less term than twelve
months.
Sec. 9. That when any company or person uses the poles
of the city of- Paducah, as provided in this ordinance, the city
electrician shall keep an account of each pole used .by the

company or person usin; said poles, and he shall report semi-
annually, the number of poles, together with the names of
the company or persons using same, to the clerk of the coun-
cil, who shall at once notify such of the amount due. There-
upon it shall be the duty of the company or person to pay to
the city treasurer of the city of Paducah the said amount, of
rental, and when the amount is thus paid, the treasurer shall
certify the fact and amount to the clerk of the common conn.

Sec. to. That any company or person who shall fail or
refuse to pay the amount of rental due, as provided in this or-
dinance, for the use of the citys poles, shall at once, upon
notice being given% detach all wires affixed to said places,
and for a failure or refusal so to do, shall be fined $g.00 for
each day said wires remain attached to the poles of said
city, after receipt of notice to detach same.
Sec. it. That. whenever the city of Paducah desires to
replace any poles to whish the wires of any company or per-
son is affixed, it shall be the duty of the city electrician to
give the said company or rersop at least three days' notice
in writing of said city's intention to rebuild or replace such
pole, and said company or person shall, at their own expense,
at once detach and remove all wires affixed to the city's poles.
Sec, ta. That the city shall not. he responsible for any
damage or injury caused to any company or person or per-
sons connecting wires to the city poles, and the city reserves
to itself the right to terminate the rental contract with arty
company or person by riving thirty days' notice in writing
of such termination.
Sec. t3. That the rental contract for all companies or
persons using the poles of other companies or persons shall
be the same as fixed by the city in this ordinance, in the ab-
sence of any contract or agreement between the said compa-
nies or persons. -

Sec, 14. That any person or company violating any pro-
vision of this ordinance, wherein no penalty is affixed, shall,
for each violation thereof, be fined not less than $5.00 and not
more than $50.00.
Sec, 15. That any person or company who may be
found tapping wires for the purpose of taking current there -
from, without permission from proper authority, to whom wire
?
belongs, shall be fined rot less than $50.0o nor more than
$ioo.00, and two months' confinement in the county jail for
each and every offense committed.
Sec. 0.6 That all ordinances and parts of ordinances
conflicting with the provisions of this ordinance are hereby
repealed, and this ordinance shall take effect from its pass-
age and approval.

Fe it ordained by the mayor and commor council of t?w
city of Paducak, by.
Sec. 't. That telephone companies now operating, or
that may hereafter operate in the city of Paducah, shall be,
and they are hereby placed tinder the restrictions of all or-
dinances now in force r,,d effect, and ordinances that may
hereafter be enacted, fnan time to time, and be in force when
such telephone companies are operating their respective

systems.
Sec. z. That this ordinance shall take effect from ani
after its passage and approval.
